A RESOLUTION OF THE MIAMI CITY COMMISSION,
WITH ATTACHMENT(S), CLOSING, VACATING,
ABANDONING AND DISCONTINUING FOR PUBLIC USE
THAT PORTION OF A PUBLIC RIGHT-OF-WAY, BEING
SOUTHWEST 37TH COURT RUNNING PARALLEL AND
BETWEEN SOUTHWEST 37TH AVENUE AND 38TH AVENUE
NORTH OF SHIPPING AVENUE, AND A FIFTEEN FOOT
ALLEY RUNNING ACROSS DIAGONALLY BETWEEN
SOUTHWEST 37TH COURT AND SOUTHWEST 37TH AVENUE
NORTH OF SHIPPING AVENUE, AND A PORTION OF
SHIPPING AVENUE BETWEEN SOUTHWEST 37TH AVENUE
AND SOUTHWEST 38TH AVENUE, AND A PORTION OF
THE FIFTEEN FOOT ALLEY RUNNING PARALLEL AND

HEREOF.
WHEREAS, the Miami Zoni
2000, Item No. 6, duly adopt

Board at its meeting of July 10,
Resolution No. ZB-2000-0339 by an
eight to one (8-1) vote, RECOMMENDING APPROVAL of closing,
vacating, abandoning, and discontinuing a portion of the public
right-of-way as set forth herein; and
WHEREAS, the Public Works Department and the Platland Street
Committee have studied the subject vacation and closure and
determined that it will not affect pedestrian or vehicular
traffic circulation or access for public service; and
WHEREAS; the Plat and_ Street Committee has reviewed the
subject, tentative plat ands determined that all technical

requirements have been met,l and vacation of the subject
right-of-way would benefit thelgeneral public; and

WHEREAS, the Department 'of Public Works and the Plat and
Street Committee recommend approval of said vacation request; and
WHEREAS, the City Commission finds that it is in the best
interest of the general welfare of the City of Miami and its
inhabitants to grant the vacation and closure of a portion of the
subject right-of-way, and deems it advisable to do so;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
and incorporated as if fully s'et forth in this Section.
Section 2. A portion of public right-of-way, being
Southwest 37th Court running paralleland between Southwest 37th
Avenue and 38t'' Avenue north of Shipping Avenue, and a fifteen
foot alley running across 11 diagonally between Southwest
37th Court and Southwest 37th avenue north of Shipping Avenue,
and a portion of Shipping Avenue between Southwest 37t'' Avenue
and Southwest 38t'' Avenue, and a portion of the fifteen foot
alley running parallel and between Peacock Avenue and Shipping
Avenue, west of Southwest 37t'' Court, Miami, Florida, as
legally described in "Exhibit 11 A, B, C, D, and E", attached
hereto and made a part hereof, is hereby closed, vacated,
abandoned and discontinued forllpublic use.

DOUGLAS ROAD STATION
The Public Works Department and the Plat and Street Committee have studied the
proposed closure and vacation of S.W. 37 Court between Peacock Avenue and Shipping
Avenue, the 15' diagonal alley running parallel to the Metrorail right of way between
S.W. 37 Avenue and S.W. 37 Court and Shipping Avenue between S.W. 37 Court and
the Metrorail right of way and determined that the closure of these roads and alley will
not adversely affect traffic circulation or access for public service vehicles such as trash
and garbage trucks, fire, police and/or other emergency vehicles. These roads and alley
are not part of the critical pedestrian and vehicular transportation network for the
neighborhood. The Plat and Street Committee has reviewed the tentative plat of
"Douglas Road Station" and determined that all technical requirements contained in the
City Code Subdivision Regulations have been met and the closure of these roads and
alley and development of the property would benefit the general public. The property
owner must provide a specific attorney's opinion addressing the reversionary rights of the
roads and alley as part of the application process. Based on the criteria contained in the
Subdivision Regulations of the City Code, the Public Works Department and the Plat and
Street Committee recommend approval of this road and alley closure and vacation
request.

The City of Miami Plat and Street Committee, at its meeting of July 6, 2000,
approved the above tentative plat subject to the following revisions being made
to the tentative plat, additional information being provided and/or variances
being granted. Please be advised that the processing of your tentative plat cannot
proceed until these conditions have been satisfied:
1. In the location sketch, show underlying existing subdivisions for the area being
platted; add the words Township, South, Range and East in the .fractional
description; and provide zoning designation for the area being platted.
2. Provide the Miami -Dade County flood criteria, in addition to FEMA information.
3. Provide botanical and common names and height, diameter and spread for
existing tree.
4. Provide block number (14), and identify Lots 23, 14 and 15 as such in the area
west of SW 38 Avenue, between Shipping Avenue and Orange Street.
5. Provide the Section Township, Range, City of Miami and Miami -Dade County in
the Title Block.
6. In surveyor's note No. 11, reference zoning information as according to Zoning
Ordinance 11000, as amended.
7. An opinion of title as to reversionary rights for the alleys and roads to be
closed and vacated will be required by the Zoning Board. The opinion of title

8. Identify all properties being dedicated as.right-of-way by this plat and provide
square footage access for the same.
9. The opinion -of title must cover the period from the beginning to the present.
10. The proposed plat and the opinion of title must reference the correct name of
the owner, which is Miami -Dade County, Florida.
11. Verify that all easements to be closed and vacated are included in the Zoning
Board package.
12. Remove comments and notes on the tentative plat that do not relate to the
"Douglas Road Station" plat.
13. The approval of this tentative plat is conditioned , upon ,the recording of the
"Douglas W A.S.D. Plat" prior to the recording of the "Douglas Road Station" plat.
14. The Plat and Street committee in viewing the request to, close and, vacate
Shipping Avenue between SW 37 Court and the Metrorail right-of-way,, SW 37
Court between Peacock Avenue and the Metrorail right-of-way, and the
unnamed alley running parallel to the Metrorail. right-of-way have considered
the public interest requirements found in Chapter 55 of the Miami City Code.
These requirements having been . met, the Plat and Street Committee
recommends approval of the vacation and closure of the said portion of
Shipping Avenue and SW 37 Court and the unnamed alley.
In addition to the above requirements, you should be aware of the following:
State and local laws require the installation of various physical. improvements in
the' public .rights-of-way when property is platted. These 'subdivision
improvements include paving, drainage, landscaping, sidewalks, etc. In some
cases this could represent a substantial investment on your part.
The alteration, relocation or installation of utilities such as storm and sanitary
sewers, electric, telephone, water, etc., caused by this plat will be at the
property owner's expense. Also,. utility easements may be required on the
property being platted.
A building permit will not be issued on the property. being platted until the
final plat .is recorded. Also, the Certificate of occupancy for any building
construction will be issued only after" all the required subdivision
improvements have been completed.
Approval for fire flow requirements must be obtained from the Fire -Rescue
Department prior to the issuance of a building permit.

With the understanding that this opinion of title is fur-

FACTS.
It is -our understanding .that the above described Owner is
replatting the Property and other adjacent properties (which
Property and other adjacent properties are fully described on
Exhibit "A" attached hereto and are herein collectively called
the "Replatted Property").
we have been advised that an Application for Closure and
Vacation of Public Right -of -Way has been' -filed by the Owner with
the Hearing Board's Planning Department of the City of Miami and
that all documents in conjunction therewith have been properly
filed with said Department.
It is our further understanding that the City of Miami has
requested an Opinion as to the ultimate ownership of the portions
of the roads and alleyways abutting the Property as shown on the
tentative plat and described in Exhibit."B" attached hereto as
being vacated as a result of,such Application for Closure and
Vacation of Public Right -of -Way and replatting.of the Replatted
Property (collectively "Proposed.Closed Rights'of.Ways").
DISCUSSION,
The legal description of the Property consists of lots lying
within the following two (2) plats:
(a) BLOCK 15 PLAT -
We have examined the'Block 15 Plat, one of the plats that
originally platted portions of the Proposed Closed Rights of
Ways. The Plat contains no dedication of the roads and *streets

to the public use and no reversion clause in the event the roads
and streets on the Plat should be closed or discontinued by law.
We have further examined Attorneys' Title Insurance Fund,
Inc. Title Note 24.01.03 which provides that where there is no
specific dedication of streets on a plat or where the dedication
is silent as to the reversionary interest after vacation of the
streets, the general rule is that the owners of lots abutting the
streets take title [rather than the dedicator/platting party].
We have further examined Miami Beach v. Miami Beach
Improvement Co., 14 So.2d 172 (Fla. 1943) which holds that an
offer to dedicate streets may be implied from the filing of a
plat showing the streets unless the plat recited.a contrary
intention.
We have further examined Uniform Title Standard 11.4 (and
other Florida authorities) which provide that when a street is
dedicated without the statement of a reversionary interest and
the street is thereafter discontinued through legal process, the
abutting owners take the fee title to the center of the street.
(b) BLOCK 16 PLAT
We have examined the Block 16 Plat, the plat that originally
dedicated the remaining portions of the Proposed Closed Rights of
Ways to the public. The Plat language is largely illegible but
appears to contain the following dedication:
"Realty Securities Corporation, for itself, its successors
and assigns . . . do hereby perpetually dedicate for the use
of all purchasers of lots in said resubdivision all the
roads and streets as shown on this plat..."
We have further examined Uniform Title Standard 11.4 (and
other Florida authorities) which provide that when a street is
dedicated without the statement of a reversionary interest and
the street is thereafter discontinued through legal process, the
abutting owners take the fee title to the center of the street.
Although the Plat language is largely illegible, it does not
appear that the Plat contains a reversion clause in the event the
roads and streets on the Plat should be closed or discontinued by
law. Nevertheless, in the event the illegible language on the
Plat does contain a reversion clause, we have further examined
Florida Statutes Section 177.085 which reads as follows:
"When any owner of land subdivides the land and dedicates
the streets, other roadways, alleys or similar strips on the
map or plat, and the dedication contains a provision that

the reversionary interest in the street, roadway, alley or
other similar strip is.reserved unto the dedicator or his or
her heirs, successors, assigns, or legal representative, or
similar language, and thereafter- conveys abutting lots oir
tracts, the conveyance shall carry the reversionary interest
in the abutting street to the centerline or other 1
appropriate boundary, unless the owner clearly provides.
otherwise in the conveyance.
OPINION
Based upon the presumption that the Proposed Closed Rights -
of -Ways have been properly dedicated to public use and accepted
and on the further presumption that proper and appropriate steps
will be taken to close the Proposed Closed Rights -of -Ways as
above described and on the further presumption that none of the
deeds in the chain of title of the abutting land contained a
personal reversionary interest in the abutting streets, it is.our
opinion that by virtue of (i) the omission of a dedication of
streets and omission of a reversion clause on the Block 15 Plat
and the authorities quoted above; and (ii) the apparent omission
of a reversion clause in the Block 16 Plat and the authorities,
and, if applicable, the statute quoted above, the Proposed Closed
Rights -of -Ways will become the property of the abutting land
owners to the centerline on each side. Since the same owner owns
all lots and the abutting land, that ownership by virtue of the
closing of the aforedescribed Proposed Closed Rights of Way
adjoining the respective land, should place title to the said
Proposed Closed Rights of Way in the abutting land owner on both
sides, which is "Owner".
