A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE DEPARTMENT OF FIRE -RESCUE'S PROCUREMENT OF THREE (3) 65' TELESQURT PUMPER TRUCKS, EACH WITH A DASH 2000 CAB AND CHASSIS, FOR AN AMOUNT OF $1,321,572, AND ONE (1) ENCORE AIR TRUCK, WITH AN INTERNATIONAL IHC 4900 CHASSIS AND OPTIONAL ACCESSORIES, FOR AN AMOUNT OF $211,798, PLUS,FUNDS IN THE AMOUNT OF $40,000, FOR THE PURPOSE OF PROVIDING A CONTINGENCY AMOUNT, FOR A TOTAL COST NOT TO EXCEED $1,573,370, FROM PIERCE MANUFACTURING, INC., UNDER EXISTING LAKE COUNTY, FLORIDA, BID CONTRACT NO. 99-150, AND ANY EXTENSIONS THERETO; ALLOCATING FUNDS THEREFOR FROM CAPITAL IMPROVEMENT PROJECT NO. 313233, ACCOUNT CODE NO. 289401.6.840, AS FUNDED BY THE FIRE ASSESSMENT. WHEREAS, the Department of Fire -Rescue is in need of three (3) new 65' Telesqurt pumper trucks, each with a Dash 2000 cab and chassis, and one (1) Encore Air Truck with an International IHC 4900 chassis and optional accessories, to retire or replace existing deteriorating equipment; and WHEREAS, this equipment is available from Pierce Manufacturing, Inc., under existing Lake County, Florida, Bid Contract No. 99-150, for an amount of $1,321,57.2 for the three (3) pumper trucks, and $211,798 for the air truck; and CITY COMMISSION MEETING OF J U L 2 7 2000 hesolution No. Ur ------------- WHEREAS, the timeframe required to manufacture these complex fire -rescue vehicles is approximately one year, and the allocation of a contingency amount of $40,000 is necessary to provide available funds for increased costs that may arise due to National Fire Protection Association performance and safety standards; and WHEREAS, the City Manager and the Chief of the Department of Fire -Rescue recommend that the procurement of this equipment, in a total amount not to exceed $1,573,370, from Pierce Manufacturing, Inc., under existing Lake County, Florida, Bid Contract No. 99-150, be approved; and WHEREAS, funds are available from Capital Improvement Project No. 313233, Account Code No. 289401.6.840, as funded by the Fire Assessment; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The Department of Fire -Rescue's procurement of three (3) 65' Telesqurt pumper trucks, each with a Dash 2000 cab and chassis, for an amount of $1,321,572, and one (1) Encore Air Truck, with an International IHC 4900 chassis and optional accessories, for an amount of $211,798, plus funds in the amount Page 2 of 3 rb of $40,000 for the purpose of providing a contingency amount, for a total cost not to exceed $1,573,370, from Pierce Manufacturing, Inc., under existing Lake County, Florida, Bid Contract No. 99-150, and any extensions thereto, in a total amount not to exceed $1,573,370, is hereby authorized, with funds therefore hereby allocated from Capital. (Non-Local/Non- Minority vendor) located at 2600 American Drive, Appleton, Wisconsin 54915, using Lake County Bid/Contract No.99-150 (effective through July 31, 2000, and contingent upon four one-year options to extend by Lake County), in the amount of $1,573,370 including $40,000 in contingency reserve. Funding for this acquisition will be allocated from CIP Project No. 313233, Account No. 289401.6.840, funded by the Fire Assessment. BACKGROUND The Department of Fire -Rescue requires three (3) new 65' Telesqurt pumper trucks with Dash 2000 Cab and Chassis to replace three (3) eleven -year-old aerial/pumper trucks ("quints") which will be utilized as back-up equipment, Also, The Fire -Rescue Department requires one (1) new Air Truck to replace an existing twenty (20) year old Air Truck which no longer meets National Fire Protection Association (NFPA) performance and safety standards. Due to its age and lack of capacity, the existing Air Truck will be retired. All pricing shall be in accordance with the pricing structure as outlined in the Lake County Contract. Any resulting contract shall be between the City of Miami and Pierce Manufacturing Inc. Pierce Manufacturing Inc. agrees to provide a 100% Performance Bond to insure any optional prepayment funds and performance of the contract. Ten -8 Fire Equipment Inc. is the sole distributor (dealer) of Pierce Fire Apparatus for the State of Florida and will provide sales and service support. Robert Boggus, a representative of Ten -8 Fire Equipment, is authorized to sign bid proposals including #99- 150 on behalf of Pierce Manufacturing Inc. Pierce Manufacturing Inc. has established standard pricing for fire apparatus that is generated from our computer-based program. The pricing generated to our dealers provides two pricing structures, list price (suggested retail price) and net price (Pierce factory cost to the dealer). The net price is marked up 15% to create the list price. Our dealer in Florida, Ten -8 Fire Equipment Inc., submitted a pricing form called the "City of Miami Price Computation" for the "Tele-Squrt aerial fire truck". Pierce will clarify the pricing on that form as follows: • Item #1 lists the base price of the fire apparatus at $354,221. This is our net price or the factory cost to Ten -8. As listed in item #2, Ten -8 has marked up the factory cost 4%. This is its commission. The 4% mark-up is in compliance with the pricing structure established in the Lake County bid #99-150. • Item #3 lists the base price of all the options on the fire apparatus at $105,516. This is our net price or the factory cost to Ten -8. As listed in item #4, Ten -8 marked up the factory cost 10%. This is its commission. The 10% mark-up is in compliance with the pricing structure established in the Lake County bid #99-150. The prepayment is based on interest Pierce will earn from the period of payment until completion and delivery of the fire ' apparatus. The chassis handling charge of $4,165, as listed in the detailed pricing report, is included in the prepayment of $23,918. Please note that the prepayment monies are allocated to a bank account and not to the dealer or Pierce until after the delivery of the vehicle. • Item #6 lists a multiple order discount of $20,016. This is a discretionary discount agreed upon by Pierce and Ten -8 based on efficiencies we can realize in our manufacturing processes and delivery expenses for a multiple order contract, and also on the competitive nature of the bid. Ten -8 Fire Equipment Inc. also submitted a pricing form called the "City of Miami Price Computation" for the "Encore air fire truck". Pierce will clarify the pricing on that form as follows: • Item #1 lists the base price of the fire apparatus at $102,878. This is our net price or - the factory cost to Ten -8. As listed in item #2; Ten -8 has marked up the factory cost 4%. This is its commission. The 4% mark-up is in compliance with the pricing structure established in the Lake County bid #99-150. • Item #3 lists the base price of all the options on the fire apparatus at $104,424. A. Price Increases 1. Any requests for price increases ;must be in writing and must be directed to Procurement Services Contracting Officer (hereinafter Officer) responsible for the contract. Requests must fully document the rationale for such increases and include a copy of the manufacturer's notification to the contractor of same. The increase must apply to all dealers of the same class as the contractor. Contractor originated increases shall not be allowed. 2. SUBLETTING OF CONTRACT: The contract that will be derived from this bid request shall not be sublet except with the written consent of the Procurement Services Director. No such consent shall be construed as making the County a party to such subcontract or subjecting the County to liability of any kind to any Subcontractor. No subcontract shall under any circumstances relieve the contractor of liability and obligation under this contract and all transactions with the County acting through its Procurement Services Director must be through the general .contractor. CONFORMANCE TESTING: The County reserves the right to test all equipment delivered during the life of the proposed contract, at an independent laboratory, to be designated by the Procurement Services Director. If sample tested is not equal or does not conform to the specification, the expense of making such tests shall be paid by the contractor and the County reserves the right to purchase parts elsewhere. At the County's option, the contractor will remove parts from equipment and replace, at no charge, with parts meeting specifications and pay for any equipment damages caused by the inferior part. If, however, the test shows the sample to be equal to or conform to the specifications, the county shall bear the expense of the test. Supply of inferior parts by the contractor(s) may be cause for cancellation of the contractor's contract. 13. COMPOSITE: The successful bidder shall submit to Procurement Services a composite report of contract purchases or copies of invoices issued during the contract period. Same shall be submitted sixty (60) days prior to end of initial contract period and sixty (60) days prior to expiration of any subsequent renewal periods. 14. U.S. MARKET: The equipment shall be built for the U.S. Market and sold by a factory authorized dealer. 15. SERVIQJE. PARTS D OPERATORS PAMPHLETS The delivered apparatus shall include at least two sets of keys for each vehicle and three (3) copies of service, illustrated parts (parts description to be of the expanded drawing type showing all component parts and one (1) first level video training tape for the chassis and pump), and operator's manuals. Include tools and equipment necessary for normal field adjustment. A permanent plate must be mounted in the driver's compartment which specifies the quantity and type of fluids required including engine oil, engine coolant, transmission, pump transmission lubrication, pump primer and drive axle. 16. OPERATOR TRAINING: The contractor shall provide operator training sufficient to ensure efficient operation of bid product(s). This shall be provided at no charge by the contractor. 17. PARTS AND SERVICE: Bidders must furnish with the bid a statement identifying where parts and service for the bid equipment are available to the County. 18. MAINTENANCE AGREEMENT: A maintenance agreement shall be available to the County after the expiration of the apparatus warranty period. Bidder shall submit a copy of the proposed maintenance 'agreement with their submittal. 22. DELIVERY: Apparatus, to insure proper break in of all components while still under warranty, shall be delivered under its own power. Rail or truck freight is not acceptable. A qualified delivery engineer representing the bidder shall deliver the apparatus and remain for a length of time sufficient to thoroughly instruct required personnel in the proper operation, care and maintenance of, the equipment delivered. 23. FACTORY DELAYS: Factory scheduling delays must be reported to the County -within twenty- four (24) hours of your notification: 24. PERFORMANCE TESTS AND REQUIREMENTS: A road test will be conducted with the apparatus fully loaded and a continuous run of ten (10) miles or more will be made under all driving conditions, during which time the apparatus shall show no loss of power or overheating. The transmission drive shaft or shafts, and rear axles shall run quietly and be free from abnormal vibration or noise .throughout the operating range of the apparatus. Vehicle shall adhere to the following parameters:': A. The front to rear weight distribution of the fully loaded vehicle (as defined by applicable NFPA guidelines) shall be within the limits set by the chassis manufacturer. FAILURE TO MEET TEST: In the event the apparatus fails to meet the test requirements of these specifications on the first trials, second trials may be made at the option of the bidder within thirty (30) days of the date of the first trials. Such trials shall be final and conclusive and failure to comply with these requirements shall be cause for rejection. Failure to comply with changes as the County may consider necessary to conform to any clause of the specifications within thirty (30) days after notice is given to the bidder of such changes shall also be cause for rejection of the apparatus. Permission to keep or store the apparatus in any building owned or occupied by the County or its use by the County during the above specified period with the permission for the bidder shall not constitute acceptance. 26. PRE -CONSTRUCTION CONFERENCE: The County requires that representative of the contractor and any sub contractor attend a Pre -Construction Conference to finalize technical specifications for each type model to be purchased. The Senior Director of Emergency Services shall confer with the Contractor to schedule a date for each conference. A .final pre- production drawing of the apparatus shall be prepared by the Contractor and be approved by the County prior to construction commencing. Detailed .information shall be provided on the materials used to construct all facets of the apparatus body. Any bidder who fails to submit detailed construction specifications, or who, photo, copies and submits these specifications as their own construction details may be considered non-responsive and,may render their bid ineligible for award. 31. The bidder must be able to supply 90% of parts required to maintain this equipment within 24 hours and. have access to the remaining 10% of parts within 72 hours. WARRANTY (CONTINUEDI: The bidder shall have full responsibility for warranty of all components of the equipment. A statement shall be attached with the bid setting out the conditions of the warranty(s). The manufacturer's standard warranty shall be furnished. Warranty shall include parts and service for a minimum of two (2) .years. Warranty shall become effective when the vehicle is accepted by the County rather than time of delivery. Vehicles and equipment must meet all ANSI, SAE and other applicable standards. It is the County's desire to have a warranty policy made with one company and to be able to execute all warranties through one service department. If the bid offered includes more than one warranty or more than one service department and parts department then a list must be provided of difference dealer names and locations. The Pierce® Micro Controller IV and multiplexing technology stores date -sensitive information.
