RESOLUTION NO.
A RESOLUTION OF THE MIAMI CITY COMMISSION,
AUTHORIZING THE CITY MANAGER TO EXECUTE AN
AMENDMENT TO THE AGREEMENT, IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, WITH
MUNICIPAL CODE CORPORATION, FOR THE PROVISION
OF ADDITIONAL OPTIONAL SERVICES ON AN AS
NEEDED BASIS, RELATED TO THE CODIFICATION,
SUPPLEMENTATION, AND REPUBLICATION OF THE
CHARTER AND CODE OF THE CITY OF MIAMI,
FLORIDA', AS AMENDED, AND THE COMPREHENSIVE
ZONING ORDINANCE NO. 11000, AS AMENDED FOR
THE OFFICE OF THE CITY CLERK; ALLOCATING
FUNDS THEREFOR FROM THE FISCAL YEAR 1999-2000
BUDGETED FUNDS OF VARIOUS USER DEPARTMENTS,
FOR SAID PURPOSE.
WHEREAS, City of Miami engages the services of the Municipal
Code Corporation ("MCC") to print and codify the Charter and Code
of Ordinances for the City .of Miami, Florida, as amended (the
"Code)", and the Comprehensive Zoning Ordinance No. 11000, as
amended (the Zoning Ordinance"); and
WHEREAS, the City requires certain additional optional
ancillary services, including but not limited to, placement of
the Code on computer disks,. information retrieval software,
Internet access to Code, including updates, electronic
supplementation as updated, sample ordinance services, etc.; and
WHEREAS, the Office of the City Clerk wishes to exercise its
option to amend its existing contract to enhance

the services provided by MCC and meet the demands of the various
user departments;
NOW, THEREFORE BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto. and incorporated herein as if fully set forth in this
Section.
Section 2. The City Manager is hereby authorized" to
execute an amendment to the Agreement, in a form acceptable to
the City Attorney, with Municipal Code Corporation, for the
provision of additional optional services on an as needed basis,
related to the codification, supplementation, and republication
of the Charter and Code of the City of Miami, Florida, as
amended, and the Comprehensive Zoning Ordinance No. 11000, as
amended, for the Office of the City Clerk, with funds therefor
hereby allocated from the Fiscal Year 1999-2000 budgeted funds of
various user departments, for said purpose.
�i The herein authorization is further subject to compliance with all
requirements that may be imposed by the City Attorney, including but not
limited to those prescribed by applicable City Charter and Code
provisions.

Section 3. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.'/

If the Mayor does not sign this Resolution, it shall become effective at
the end of ten calendar days from the date it was passed and adopted.
If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.

certain optimal ancillary

It is respectfully recommended that the City Commission adopt the attached Resolution
amending the contract with the Municipal Code Corporation for certain optional ancillary
services associated with the City's Code of Ordinances and zoning supplements for our
City's zoning ordinance, Ordinance No. 11000.
BACKGROUND
On February 12, 1991, the City of Miami entered into an agreement with the Municipal
Code Corporation to republish, print and codify a code of ordinances for our City's Code
and zoning ordinance consistent with specifications of October 18, 1990 and Bid No. 90-
91-015. The City Clerk's Office ten-year contractual obligation with the Municipal Code
Corporation terminates on February 12, 2001 and the Clerk anticipates exercising the first
of two five-year options to extend said contract. However, because said original
agreement was entered into before the advent of certain optional ancillary subscriber
services, it now becomes necessary, after assessing our City's departmental needs, to
broaden the scope of services in order to obtain other services from the contractor
(including such information retrieval software as folio bound views, site license for same,
electronic Code research, electronic supplementation services, placement of Code on
computer disks, Internet access to Code, including updates, sample ordinance services,
etc.) on a schedule that would meet our City's needs.
Request is hereby made to authorize the City Manager to amend the aforementioned
contract to provide for said optional services on an "as needed basis" to meet our City's
departmental needs.
In closing, the funding for any cost to be incurred for the aforementioned services shall
be borne by each user department from their respective FY '2000 departmental budgets.
