A DULY ADVERTISED PUBLIC HEARING, RATIFYING,
APPROVING AND CONFIRMING THE CITY MANAGER'S
FINDING OF AN EMERGENCY, WAIVING THE
REQUIREMENTS FOR COMPETITIVE SEALED BIDDING
PROCEDURES, AND APPROVING THE ACQUISITION OF
MAINTENANCE SERVICES FOR FOUR (4) CITY OF
MIAMI STORMWATER PUMPING STATIONS FOR THE
DEPARTMENT OF PUBLIC WORKS, FROM CONDO
ELECTRIC MOTORS, INC., IN AN ANNUAL AMOUNT
NOT TO EXCEED $104,840; ALLOCATING FUNDS
THEREFOR FROM THE STORMWATER UTILITY TRUST
FUND; AND AUTHORIZING THE CITY MANAGER TO
EXECUTE A CONTRACT, IN A FORM ACCEPTABLE TO
THE CITY ATTORNEY, FOR SAID PURPOSE.
WHEREAS, the maintenance of the four City of Miami
stormwater pumping stations by the Miami -Dade Water and Sewer
Department has been discontinued, creating an immediate danger to
the health, safety and welfare of the citizens and the residences
in the flood prone areas of the City of Miami; and
WHEREAS, the City Manager made a written finding that the
maintenance of the four (4) City of Miami stormwater pumping
stations constitutes a valid public emergency which requires the
immediate acquisition of maintenance services to protect the
health, safety and welfare of residents and the public; and
WHEREAS, the City Manager and the Director of Public Works
recommend that the requirements for competitive sealed bidding

procedures be waived and that acquisition of maintenance services
for the four (4) City of Miami stormwater pumping stations from
Condo Electric Motors, Inc. be approved; and
WHEREAS, funds are available from the Stormwater Utility
Trust Fund;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. By a four-fifths (4/5ths) affirmative vote of
the members of the City Commission, after a duly advertised
public hearing, the City Manager's finding of an emergency,
waiving the requirements for competitive sealed bidding
procedures and the acquisition of maintenance services for the
City's four (4) stormwater pumping stations for the Department of
Public Works, from Condo Electric Motors, Inc., in an annual
amount not to exceed $104,840, is hereby ratified, approved and
confirmed, with funds. therefor hereby allocated from the
Stormwater Utility Trust Funds..
Section 4. The City Manager is hereby authorized" to
execute all necessary documents, in a form acceptable to the City
Attorney, for said purpose.
The herein authorization is further subject to compliance with all
requirements that may be imposed by the City Attorney, including but not
limited to those prescribed by applicable City Charter and Code
provisions.

the end of ten calendar days from the date it was passed and adopted. If
the Mayor vetoes this Resolution, it shall become effective immediately
upon override of the veto by the City Commission.

It is respectfully recommended that the City Commission adopt the attached Resolution
ratifying the City Manager's written finding that a valid emergency exists concerning the
maintenance of the City's four stormwater pumping stations and waiving formal
competitive bidding procedures and authorizing the City Manager to accept the lowest
responsible and responsive bid of CONDO ELECTRIC MOTORS, INC., in the amount
of $104,840.00 per year, for maintenance services to the City's four pump stations.
BACKGROUND
The City has four stormwater pumping stations (1 each) located at 1301 NW 6 Street,
1701 NW 7 Street, 1.630 NW 4 Avenue and 342 SW 7 Avenue.
Since 1975, the Miami -Dade Water and Sewer Department has been operating and
maintaining the City's stormwater pump stations under an informal agreement. Certain
operating and safety deficiencies have caused the Director of the Miami -Dade Water
and Sewer Department to issue a letter of notice to the City on February 8, 2000, that his
department has discontinued operational and maintenance service of the pump stations.
The Public Works Department has retained a consultant to immediately prepare plans
and specifications for the upgrading of the pump stations, with the safety improvements
given priority status. However, due to the approaching rainy season, it is essential that a
maintenance contractor be retained to operate and maintain the pump stations during
the renovation period in order to avoid any interruption in service.
Funds for the execution of this project are available from Stormwater Utility Trust Funds.

Stormwater Pump Station
Maintenance

Based on my investigation, and an evaluation by the Miami -Dade Water and Sewer
Department, of the condition of the City's four stormwater pumping stations, I. have found
that an EMERGENCY exists concerning maintenance of the pump stations which
justifies the selection of a maintenance contractor by informal bids.
The City has four stormwater pumping stations (1 each) located at 1301 NW 6 Street,
1701 NW 7 Street, 1630 NW 4 Avenue and 342 SW 7 Avenue.
Since 1975, the Miami -Dade Water and Sewer Department has been operating and
maintaining the City's stormwater pump stations under an informal agreement. Certain
operating and safety deficiencies have caused the Director of the Miami -Dade Water
and Sewer Department to issue a letter of notice to the City on February 8, 2000, that his
department has discontinued operational and maintenance service of the pump stations.
The Public Works Department has retained a consultant to immediately prepare plans
and specifications for the upgrading of the pump stations, with the safety improvements
given priority status. However, due to the approaching rainy season, it is essential that a
maintenance contractor be retained to operate and maintain the pump stations during
the renovation period in order to avoid any interruption in service.
The estimated cost of the operational and maintenance service is $8,000 per month for
all four pump stations until the improvements are complete, at which time a permanent
operation and maintenance program will be implemented.
Such conditions indicate the need for extraordinary measures to protect the health,
safety and welfare of the community and the residences in the floor prone areas of the
City. In order to initiate the interim operation and maintenance service as soon as

possible, formal competitive sealed bid procedures shall be waived for the procurement
of contracting services required for said emergency pursuant to. sections 18-83 and 18-
84 of the City Code. Informal bids shall be obtained and a contract shall be awarded by
the City Manager to the lowest responsive and qualified bidder. This action shall be
ratified at the next available City Commission meeting.
Funds for the aforesaid pump station maintenance and operations service costs are
available from the Stormwater Utility Trust Funds. The amount required for the balance
of FY'00 is $48,000..It is requested that the Budget Department be directed to provide
the required funds from the, Stormwater Utility Trust Funds for this emergency
expenditure:

NOTICE OF PUBLIC HEARING
A public hearing will be held by the Commission of the City of Miami, Florida, on July 27,
2000, at q.d'a* the City Commission Chambers at City Hall, 3500 Pan American
Drive, Miami, Florida, for the purpose of hearing objections from any interested parties
affected by the ratifying of the City Manager's written finding that a valid emergency
exists concerning the maintenance of the four (4) City of Miami stormwater pumping
stations and waiving formal competitive bidding procedures and authorizing the City
Manager to accept the lowest responsive and responsible bid.
All interested persons are invited to appear and may be heard concerning the pumping
station maintenance services. Should any person desire to appeal any decision of the
City Commission with respect to any matter considered at this hearing, that person shall
ensure that a verbatim record of the proceedings is made, including all testimony and
evidence upon which any appeal may be based.
