C 00- 652 A RESOLUTION OF THE MIAMI CITY COMMISSION BY A FOUR-FIFTHS (4/5THS) AFFIRMATIVE VOTE, AFTER A DULY ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING OF SOLE SOURCE, WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING PROCEDURES AND APPROVING THE PROVISION OF TECHNICAL SERVICES FOR THE DEACTIVATION, REALIGNMENT AND RETUNING OF THE CITY'S MULTI - SITE ANALOG MICROWAVE DATA/VOICE TRANSMISSION SYSTEM FOR THE DEPARTMENT OF GENERAL SERVICES ADMINISTRATION, FROM MOTOROLA COMMUNICATIONS & ELECTRONICS, INC., IN AN AMOUNT NOT TO EXCEED $25,602; ALLOCATING FUNDS THEREFOR FROM CAPITAL IMPROVEMENT PROJECT NO. 311052.429401.6.840. WHEREAS, the construction of the new multi -story parking complex in Coconut Grove has created an obstruction of the path for the loop microwave data/voice communications radio system used by the City of Miami ("City") in support of police, fire -rescue, and other local government departments and requires the transmission equipment at the Broadcast Data Building at 2850 Tigertail Avenue, Miami, Florida, be removed and deactivated, and WHEREAS, the:' microwave data/voice radio system requires realignment and retuning at the Fire Training Center at 3845 Jefferson Street, Miami, Florida, and the County Administration Building at 111 Northwest lst Street, Miami, Florida, to direct CITY COMISSION MEETING OF JUL 2 7 2000 i M2 the communications loop away from commercial areas and into residential areas; and WHEREAS, the Chief Procurement Officer has adopted a finding that Motorola Communications & Electronics, Inc. is the sole provider of the technical services for the deactivation, realignment and retuning of the City's multi -site analog microwave data/voice transmission system, which finding has been approved and adopted as the finding of the City Manager; and WHEREAS, the City Manager and the Director of the Department General Services Administration recommend that the requirements for competitive sealed bidding procedures be waived and the provision of technical services for the deactivation, realignment and retuning of the. City's multi -site analog microwave data/voice transmission system from Motorola Communications & Electronics, Inc., the sole provider, be approved; and WHEREAS, funds are available from .Capital Improvement Project No. 311052.429401.6.840; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this section. Section 2. By a four-fifths (4/5ths) affirmative vote of the members of the City Commission, after a duly advertised public hearing, the City Manager's finding of sole source and waiving the requirements for competitive sealed bidding Page 2 of 3 U( procedures, are hereby ratified, approved and confirmed, and the provision of technical services for the deactivation, realignment and retuning of the City's multi -site analog microwave.data/voice transmission system for the Department of General Services Administration from Motorola Communications & Electronics, Inc., the sole source provider, in an amount not to exceed $25,602, is hereby approved, with funds therefor hereby, allocated from Capital Improvement Project No. 311052.429401.6.840. (Non-Local/Non-Minority vendor), the sole source provider, located at 4660 S.W. 158`h Avenue, Miami, Florida 33183, at a total estimated cost of $25,602. Funding for this acquisition is available from CIP Project No. 311052.429401.6.840. BACKGROUND The construction of the new multi -story parking complex in Coconut Grove has created a direct path obstruction of the loop microwave data/voice communications radio system used by the City of Miami in support of police, fire/rescue, and other local government departments. As a result, the transmission equipment at the Broadcast Data Building needs to be removed and deactivated; and the realignment and re -tuning of the microwave transmission facilities at the Fire Training Center and the County Administration Building is required. This move will direct the communications loop away from the commercial growth area in Coconut Grove over the residential areas which are less prone to obstruction from high-rise construction (greater than 20 floors); and will simultaneously increase system reliability and voice quality. In addition, this project shall make spare parts available to other sections of the radio system, equivalent to over $100,000 at manufacturer's original cost. 66- 652 0 The Honorable Mayor and Members of the City Commission Page 2 of 2 • Motorola Communications & Electronics, Inc., is the sole manufacturer of the exiting 800 MHZ trunked communications system. The interrupted microwave loop system is an integral part of this 800 MHZ system. The performance of the microwave loop controls and reflects on the overall system's ability to carry the radio load. Funding for the provision of these services is available from CIP Project No. 311052.429401.6.840, in an amount not to exceed $25,602.00. Carter, Director DATE : June 20, 2000 FILE Purchasing Department SUBJECT: Sole Source Justification FROM : uls Selema, REFERENCES: GSA, Communications Division ENCLOSURES: In 1984 the City. of Miami purchased an 800MHz Trunked Communications System for approximately $7.4 million from Motorola Communications and Electronics, Inc. This system is comprised of many modules, components, 800 MHz radio transmitters and receivers, 2 and 6 GHz Microwave radio transmitters and receivers, voice quality remote reception voting system, and many portable and mobile radios. This communications system provides an economic value to the city's agencies in excess of $100 million per year since installation. The system uses a line -of -sight bi-directional microwave loop system, the Starpoint and Starplex series manufactured specifically by Motorola, to provide over 600 channels of full duplex voice and data communications around the six (6) receiver and two (2) transmission locations in and around the city of Miami. This microwave system is now interrupted as a result of the commercial high-rise construction in the Coconut Grove area, and requires redeployment for existing sites to communicate. As a result of this situation, this request for purchase is herein respectfully submitted for expedited attention. The technical staff of the Communications Services Division has researched the viability of the open competitive procurement process for the technical services sought herein, and found conditions, which preclude the request for purchase for Microwave Loop Redeployment from open competitive procurement procedures by virtue of the following: A. The microwave loop system is an integral part of the citywide 800 MHz trunked communications system used for public safety radio support by police, fire/rescue, and other agencies. The performance of the microwave loop controls and reflects on the overall system's ability to carry the radio load, and usage of non -manufacturer materials, designs, configuration, untrained or uncertified personnel, programming, or standards may jeopardize the operation of the entire radio system. o- 652 B. Usage of any non -manufacturer's (Motorola) technical personnel or parts to modify, repair, or otherwise change any component of this radio system shall affect performance warranties negatively in that liability transfers from, Motorola to the City: C. All documentation for the existing system, and the parts to repair, replace, or keep the system operational are only available from the original equipment manufacturer, Motorola. D. The terms and conditions of the city's RFP require performance testing and certification to, the original manufacturer's specification, which necessitate the use of proprietary test equipment only available from Motorola. E. Research into the market for vendors to do this work indicates there are no third party companies, other than the manufacturer, with the training, accreditation, and certification to perform the specified services in a professional manner. The radio, communications market is dominated by a very limited number of entities, which do not observe any compatibility with each other in terms of parts, modules, software, operation, design, functionality, or. otherwise. Furthermore, those companies fervently protect their designs, implementations, concepts, theologies, modules, software, hardware, standards, etc:, to the full extent of the law, and do not facilitate information to non -manufacturer personnel, much less,to any other competitive entities. In summary, these conditions have created a situation in which the only recommendation can be for sole source procurement -Ergo, it is therefore respectfully requested that these services be purchased as sole source.
