HomeMy WebLinkAboutR-00-0604c4, J-00-604 7/18/00 RESOLUTION NO. tl604 A RESOLUTION BY A FOUR FIFTHS (4/5Tas) AFFIRMATIVE VOTE OF THE MIAMI CITY COMMISSION, AFTER A DULY ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING OF SOLE SOURCE, WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING PROCEDURES AND APPROVING THE ACQUISITION OF TWENTY (20) HOTDOGTM MONITORING SYSTEMS FOR THE DEPARTMENT OF POLICE FROM CRIMINALISTICS, INC., THE SOLE SOURCE PROVIDER, IN AN AMOUNT NOT TO EXCEED $10,160, TO MONITOR THE TEMPERATURE CHANGES INSIDE CANINE DETAIL POLICE VEHICLES; ALLOCATING FUNDS THEREFOR FROM THE LAW ENFORCEMENT TRUST FUND, PROJECT NOS. 690001, 690002, AND 690003, SUCH EXPENDITURES HAVING BEEN APPROVED BY THE CHIEF OF POLICE AS COMPLYING WITH THE U.S. DEPARTMENT OF THE TREASURY'S "GUIDE TO EQUITABLE SHARING," AND SECTION 932.7055, FLORIDA STATUTES, AS AMENDED. WHEREAS, to ensure the protection of the Police Department's canine force, it is necessary to equip police vehicles with a system which lowers the electric windows and activates the car horn or lights to alert police officers when the temperature in the canine compartments exceeds the programmed setting; and WHEREAS, the Chief Procurement Officer has adopted a finding that Criminalistics, Inc. is the sole provider of a system which provides the safety features required by the Police Department, said system known as the HotdogTM Monitoring System; and CITY COMMISSION NEET'.ING OF Resolution NO. S� Q it WHEREAS, the finding of the Chief Procurement Officer has been approved and adopted as the finding of the City Manager; and WHEREAS, the City Manager and the Chief of Police recommend that the requirements. for competitive sealed bids be waived and the acquisition of the HotdogTM Monitoring System from the sole source provider be approved; and WHEREAS, funds to cover this expenditure have not been included in the Police Department's normal operating budget and are available in the City of Miami Law Enforcement Trust Fund; and WHEREAS, funds are available from the Law Enforcement Trust Fund, Project numbers 690001, 690002, and 690003, such expenditure having been approved by the Chief of Police as complying with the U.S. Department of the Treasury's "Guide to Equitable Sharing" and Section 932.7055, Florida Statutes, as amended; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. By a four fifths (4/5ths) affirmative vote of the members of the City Commission, after a duly advertised public hearing, the City Manager's finding of sole source and waiving the requirements for competitive sealed bidding procedures, are hereby ratified, approved and confirmed, and the acquisition of the. HotdogTM Monitoring System, for the Department Page 2 of 3 of Police from Criminalistics, Inc., the sole source provider, in an amount not to exceed, $10,160, to monitor the temperature changes inside Canine Detail police vehicles, is hereby approved, with funds therefor hereby allocated from the Law Enforcement Trust Fund, Project Nos. 690001, 690002, and 690003, such expenditure having been approved by the Chief of Police as complying with the U.S. Department of the Treasury's "Guide to Equitable Sharing" and Section 932.7055, Florida Statutes, as amended. Funding is available from the Law Enforcement Trust Fund, Project Nos. 690001, 690002 and 690003. BACKGROUND The Police Department needs to purchase twenty (20) Hot Dog Monitor Systems for its Canine Detail. This system detects and reacts to temperature changes inside the police vehicle. The Hot Dog Monitor System lowers the electric windows, and activates car horn or lights to alert the officer when the temperature in the canine compartment exceeds the program setting. The Director of the Purchasing Department has determined that Criminalistics, Inc., due to the proprietary nature of this system, is the sole manufacturer of the Hot Dog Monitor System. As part of the research, staff contacted Criminalistics, Inc., who advised they are the original designer, manufacturer and sole source provider of the patented HotdogTM System. According to Criminalistics, HotdogTM is the only temperature monitoring/alerting system with two independent heat sensors, with one sensor programmable and once sensor preset at 95 to 100 degrees for canine safety. In addition, staff was advised and confirmed the Miami -Dade Police Department had secured the HotdogTM System and its installation as a sole source. Additionally, from research conducted over the Internet, no other similar product with the same features could be found. Accordingly, I am recommending that the requirements for competitive bidding be waived, and these findings be approved: Criminalistics, Inc., in an amount not to exceed $10,100.00, is the sole source provider of the HotdogTM Monitoring System. The system detects and reacts to temperature changes inside the police vehicle. The system lowers the electric windows and activates the car horn or lights to alert the officer when the temperature in the canine compartment exceeds the program setting for canine safety.
