A FOR-PROFIT CORPORATION, AS DEVELOPER TO UNDERTAKE THE DEVELOPMENT OF FIVE (5) NEW SINGLE-FAMILY HOMES AFFORDABLE TO FAMILIES AND INDIVIDUALS OF VERY LOW, LOW AND MODERATE INCOME ON THREE (3) CITY - OWNED VACANT PARCELS ("PARCELS") LOCATED IN THE MODEL CITY NEIGHBORHOOD, MIAMI, FLORIDA; AUTHORIZING THE CONVENYANCE OF THE PARCELS TO DEVELOPER AT .NO COST, PURSUANT TO THE POLICY ESTABLISHED IN THE FIVE (5) YEAR CONSOLIDATED PLAN (1999-2004), SUBJECT TO DEVELOPER: (1) AGREEING TO PAY THE COST OF ELIMINATING ALL TITLE DEFECTS EXISTING ON THE PARCELS, (2) PROVIDING EVIDENCE ACCEPTABLE TO THE CITY OF FIRM COMMITMENTS FOR PROJECT CONSTRUCTION AND PERMANENT FINANCING FOR PURCHASE BY QUALIFIED HOMEBUYERS, (3) COMPLETING CONSTRUCTION ON THE PARCELS WITHIN TWELVE (12) MONTHS FROM THE DATE OF CONVEYANCE BY THE CITY, .(4) COMPLYING WITH OTHER TERMS AND CONDITIONS, INCLUDING PARCEL REVERTER PROVISIONS, AS DEEMED APPROPRIATE BY THE CITY MANAGER AND THE CITY ATTORNEY, AND (5) PROVIDING THE ADMINISTRATION WITH A STATUS REPORT CONCERNING THE TITLE TO THE PARCELS WITHIN NINETY (90) DAYS FROM THE DATE OF CONVEYANCE; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE ALL NECESSARY DOCUMENT(S), IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. WHEREAS, a severe shortage of housing exists in the City of Miami ("City") within the affordability range of families and individuals of low and moderate -income; and WHEREAS, the City Commission recognizes that the participation of both the public and private sectors is J U L 1 1 2000 kieso3 necessary to foster the development of housing affordable to low and moderate -income families and individuals in the City; and WHEREAS, pursuant to Resolution No. 99-429, adopted July 22, 1999, the City Commission approved the City's proposed Five (5) Year Consolidated Plan (1999-2004) ("Plan") for submission to the U.S. Department and Housing and Urban Development ("US HUD");,and WHEREAS, a major component of the Plan emphasizes a housing. strategy which is designed to facilitate the creation of 1,000 new homeownership units for purchase by very low, low and moderate income families annually; and WHEREAS, special attention shall be provided to several residential neighborhoods with an emphasis on the development of new infill housing on publicly -owned residential parcels for purchase by area residents; and WHEREAS, the initial development strategy of an, infill housing initiative program will focus on the development of City and Miami -Dade County -owned parcels in the seven (7) newly established Homeownership Zones in the City; and WHEREAS, a number of surplus City -owned vacant residential parcels, located in the Model City neighborhood of the City. of Miami, Florida, are suitable for the development of new affordable single-family homes, affordable to very low, low and moderate -income families; and WHEREAS, in an effort to promote the development of affordable housing in the City,, the City Administration recommends granting development rights to Palmetto Homes of Page 2 of 5 n Ch — Miami, Inc. ("Developer") for the development of five (5) new single-family homes on City -owned parcels, at no cost, and subject to certain terms and conditions; and WHEREAS, Section 29-B of the Charter of the City of Miami, Florida, as amended, allows for the conveyance or disposition of City -owned property in connection with the implementation of City -assisted housing programs or projects intended to benefit persons or households of low or moderate -income without competitive bidding requirements and fair market value return to the City; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The designation of Palmetto Homes of Miami, Inc., a for-profit corporation as developer to undertake the development of five (5) new single-family homes affordable to very low, low and moderate income families and individuals on the following three (3) vacant City -owned parcels located in the Model City neighborhood, Miami, Florida, is hereby approved: Page 3 of 5 UU PARCEL NO. The conveyance of the parcels at no cost to the Developer, pursuant to the policy established in the Five (5) Year Consolidated Plan (1999-2004), is hereby authorized subject to Developer: (1) agreeing to pay the cost of eliminating all title defects existing on the parcels, (2) providing evidence acceptable to the City of firm commitments for project construction and permanent financing for purchase by qualified homebuyers, (3) completing construction on the parcels within twelve (12) months from the date of conveyance to the Developer by the City, (4) complying with other terms and conditions, including reverter provisions for each parcel, as deemed appropriate by the City Manager and the City Attorney, and (5) providing the administration with a status report concerning the title to the parcels within ninety (90) days.from the date of conveyance. Carlos:A."G7menez .•' ENCLOSURES: Special City Commission Meeting City Manager f: of July 11, 2000 RECOMMENDATION: It is respectfully recommended that the City Commission adopt the attached resolution approving the designation of Palmetto Homes of Miami, Inc., a for-profit housing corporation, to develop five (5) new single family homes on three (3) vacant city -owned residential parcels located in the Model City neighborhood. Moreover, the attached resolution further authorizes the City Manager to convey the subject city - owned parcels at no cost to Palmetto Homes of Miami, Inc., subject to certain terms and conditions. BACKGROUND: At the June 29, 2000 City Commission meeting, a status report was presented by the City Administration regarding the City's involvement and certain development rights granted to Palmetto Homes of Miami, Inc. pursuant to Resolution No. 96-576. As a result, the City Commission through Motion No. 00-558, instructed the City Manager to return at the July 11, 2000 Special Commission meeting with a recommendation regarding this matter. The Department of Community Development recommends approval of the attached resolution designating Palmetto Holmes of Miami, Inc. as developer, to undertake the construction of five (5) new single family homes on three (3) city -owned vacant residential parcels in the Model City neighborhood. CDBG Program funds were used by the City to acquire the subject parcels several years ago to develop new single family homes for purchase by qualified low and moderate income families under the City's Scattered Site. Affordable Homeownership Development Program. The Program is no longer being implemented by the City and the subject parcels are now considered surplus property. The three (3) city -owned parcels to be conveyed are listed below: Parcel No. Address 02-60 1560 N.W. 51 Street 02-61 1532 N.W. 41 Street 02-70 946 N.W. 45 Street U0 qJ Two (2) of the subject city -owned parcels have title problems and Palmetto Homes of Miami. Inc. has agreed to accept all the parcels, including those with the title defects, and will assume the responsibility of defraying the cost of securing good and. marketable title for each property prior to the commencement of construction. City Commission approval of this action: would be subject to and contingent of Palmetto Homes of Miami, Inca carrying out the following activities: a) Prepare and finalize housing plans and specifications for City approval. b) Secure construction and permanent financing required. c) Housing units planned to be affordable to low and moderate income families. The attached resolution authorizes and -directs the City Manager to convey the subject parcels at no cost to the . aforementionedcorporation. In addition, the organization is required to commence construction on the subject city -owned parcels within twelve (12) months from the date of conveyance by the City or said.parcels will revert back to the City., The City is in a position to assist the private sector in the .development of new homeownership housing affordable to very low, low and moderate income families in the Model City neighborhood by making three (3) parcels of vacant land currently under City -ownership available for such development. In an effort to further promote the development of new single family homes in the Model City neighborhood, City ommission adoption of the attached resolution is. respectfully recommended. City Commission approval of said J J sponsor is subject to the development of a housing unit comparable to those units being proposed by Housing Initiative Group, Inc.. & Palmetto Homes of Miami, Inc.'s proposal at a selling price of $2,000 less and final review and approval of the housing plans and specifications by the City Commission at a later date. Sgction .4. Housing Initiative Group, Inc., & Palmetto Homes of Miami, Inc., and Wind and Rain, Inc. are hereby directed to prepare and finalize housing plans and specifications, construction and permanent financing, construction schedule for the obtaining of building permits within six (6) months and construction to be completed within twelve (12) months from the date of conveyance. Subject parcels to revert back to the City if construction is not completed within twelve (12) months from the data of this action. Section S. The City Commission hereby establishes a range of 0,250 to $4,150 8s the maximum reimbursement amount to be paid to the City of Miami for said parcels for its cost of site acquisition, based on five (5%) percent of the selling price for the particular housing model to be developed by both Project Sponsors, subject to certain terms acid conditions. Section 6. The City Manager is hereby authorized' to execute the appropriate documents, in fo ms acceptable to the City Attorney, conveying said parcels, more particula'fly and legally described in the attached Exhibit "A", to the Housing Initiative Group, Inc. & Palmetto Housing of Miami, Inc. and Wind and Rain, Inc., Sponsors. The acquisition amount for said parcels to be paid the City, shall be placed in the form of a first or secoN mortgage lien and satisfied at the consummation of each purchase transaction.
