HomeMy WebLinkAboutR-00-0538J-00-447 6/13/00 RESOLUTION NO. 00— 538 A RESOLUTION OF THE MIAMI CITY COMMISSION, BY A FOUR FIFTHS (4/5THS ) AFFIRMATIVE VOTE, AFTER A DULY ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING OF AN EMERGENCY, WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDS AND APPROVING RENOVATIONS AND REPAIRS TO THE MANUEL ARTIME COMMUNITY CENTER BUILDINGS AND THEATER, FOR THE DEPARTMENT OF CONFERENCES, CONVENTIONS AND PUBLIC FACILITIES, IN AN AMOUNT NOT TO EXCEED $185,000, ALLOCATING FUNDS THEREFOR FROM A GRANT AWARDED BY THE MIAMI-DADE COUNTY CULTURAL AFFAIRS COUNCIL $145,000, AND THE AMOUNT OF $40,000, FROM FY 2000 CAPITAL IMPROVEMENT PROJECT NO. 322060; AUTHORIZING THE CITY MANAGER TO EXECUTE THE NECESSARY DOCUMENT(S), IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR THIS PURPOSE. WHEREAS, a critical need exists for certain renovations and repairs to the Manuel Artime Community Center buildings and the Manuel Artime Performing Arts Theater to comply with federal guidelines established by the American Disabilities Act; and WHEREAS, the renovations and repairs consist of the replacement of the elevator in the office building, replacement of the air-conditioning and sound systems, significant corrections to extensive leaks in both buildings and other necessary repairs; and CITY COMOSSION MEETING OF J U N 2 9 2000 Resolution Ao. 11 WHEREAS, the City Manager made a written finding that the renovations and repairs constitute a valid public emergency which requires the immediate procurement of services, materials, goods and equipment to protect the health, safety and welfare of residents and the public and to make use of the grant funds awarded in the designated time frame; and WHEREAS, the City Manager recommends that informal bid procedures be utilized to procure needed services, equipment, goods, materials and construction of the project; and WHEREAS, upon receipt of informal bids, contracts for the services, equipment, goods, materials and construction are to .be executed with the lowest responsive and responsible bidder(s) by the City Manager; and WHEREAS, funds are available in the amount of $145,000 from a grant awarded by the Miami -Dade County Cultural Affairs Council, and the amount of $40,000 allocated by the by the Capital Improvements Program Project No. 322060. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Page 2 of 4 Section 2. The City Manager's finding that a valid public emergency exists and the waiver of formal competitive sealed bid procedures for construction of necessary renovations and repairs to the Manuel Artime Community Center and Manuel Artime Performing Arts Theater, are hereby ratified, approved and confirmed. Section 3. By a four-fifths (4/5t''s) affirmative vote of the members of the City Commission, the City Manager's finding of an emergency and waiving the requirements for competitive sealed bids, are hereby ratified, approved and confirmed, and the renovations and repairs to the Manuel Artime Community Center buildings and theater, in an amount not to exceed $185,000, for the Department of Conventions, Conferences and Public Facilities, are hereby approved, with funds therefor hereby allocated from a grant awarded by the Miami -Dade County Cultural Affairs Council, in the amount of $145,000, and the amount of $40,000, from FY 2000 Capital Improvement Project No. 322060. Section 4. The City Manager is hereby authorized'/ to execute all necessary document(s), in a form acceptable to the City Attorney, for this purpose. �i The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. BACKGROUND This repair project consists of the replacement of the elevator in the Office Building, replacement of the air conditioning system and the sound system, major repairs to extensive leaks in both buildings, and other necessary repairs. As outlined in the City Manager's emergency finding, the Departments of Public Works and Conferences, Conventions and Public Facilities have determined the following: • The City must comply with Federal guidelines established by the ADA for the benefit of handicapped citizens. At the present time, the elevator in the Office Building must be replaced and/or repaired to bring it into compliance. The Lions Club Home for the Blind is one of the tenants at the Manuel Artime Office Building, as is the Catholic Bureau Child Care Center, which serves children younger than 5 years of age. • There are extensive water leaks in the buildings, which pose a liability to the office tenants, visitors and the general public. • Adherence to normal procurement procedures for project implementation will impose a significant hardship on the City and the health, safety and welfare of its handicapped citizens. Funds have been allocated from a Miami -Dade County Cultural Affairs Council grant in the amount of $145,000 (these funds must be expended by September 1, 2000), and Capital Improvements funding, including $40,000 from Capital Improvements Program Project No. 322060. This finding is based upon the following information supplied to me by the Departments of Public Works and Conferences, Conventions and Public Facilities. o The City must comply with Federal guidelines established by the ADA for the benefit of handicapped citizens. At the present time, the elevator in the Office Building must be replaced and/or repaired to comply with ADA requirements. The Lions Club Dome for the Blind is one of the tenants at the Manuel Artime Office Building. There are extensive water leaks in the buildings, which pose a liability to the office tenants, visitors and the general public. v The adherence to normal procurement procedures for project implementation will impose a significant hardship on the City and the health, safety and welfare of its handicapped citizens and to the convenience of municipal affairs. • Funds are available in the amount of $145,000 from a grant awarded by the Miami -Dade County Cultural Affairs Council, $100,000 allocated by the 23`d CDBG funds, $167,000 allocated by the 20 CDBG funds, and $40,000 allocated by the Capital Improvements Program Project No. 322060. Some of the funds allocated must be expended by September 1, 2000 In order to initiate and complete improvements in a timely manner, formal competitive bid procedures shall be waived for the procurement of goods and services required for this project, pursuant to Section 18-79 of the City Code. Informal bids shall be obtained for contraction services, materials and/or equipment and contracts shall be executed by the City Manager with the lowest responsive and responsible bidder(s). RECOMMENDATION: It is respectfully recommended that the City Commission, ratify, approve and confirm by a four/fifths (4/5th) affirmative vote, the City Manager's finding of an emergency, for the approval of repairs of the Manuel Artime Community Center for the Department of Conferences, Conventions and Public Facilities, for a total amount not to exceed $185,000.00; allocating funds therefor from a grant awarded by the Miami -Dade County Cultural Affairs council, ($145 000) and from FY 2000 CIP Project No. 320 ($40,000). of Date AwardRatify£mr ®-
