A FOUR FIFTHS (4/5Ta2) AFFIRMATIVE VOTE, AFTER
A DULY ADVERTISED PUBLIC HEARING, RATIFYING,
APPROVING AND CONFIRMING THE CITY MANAGER'S
FINDING. OF SOLE SOURCE, WAIVING THE
REQUIREMENTS FOR COMPETITIVE SEALED BIDS; AND
APPROVING THE PURCHASE OF A "RETURN FIRE
SYSTEM" TO UPGRADE THE POLICE FIREARMS
TRAINING SYSTEM SIMULATOR, FROM FIREARMS
TRAINING SYSTEMS, INC., THE SOLE SOURCE
PROVIDER, FOR THE DEPARTMENT OF POLICE, IN AN
AMOUNT NOT TO EXCEED $4,799; ALLOCATING FUNDS
THEREFOR FROM THE DEPARTMENT OF POLICE
ENTREPRENEURIAL FUND, ACCOUNT CODE
NO. 126001.290402.6.840.
WHEREAS, the Department of Police requires a "Return Fire
System" to upgrade its Firearms Training Simulator to be used to
train recruits and officers for use of deadly force, firearms,
and discretionary shooting in high liability areas; and
WHEREAS, the Firearms Training Systems, Inc. is the sole
manufacturer of the "Return Fire System," its peripherals, and
programmed courseware, previously acquired by the Police
Department; and
WHEREAS, the Chief Procurement Officer has adopted a finding
that Firearms Training Systems, Inc. is the sole provider of the

"Return Fire System" needed to upgrade and integrate with the
existing Firearms Training System Simulator; and
WHEREAS, the finding of the Chief Procurement Officer has
been approved and adopted as the finding of the City Manager; and
WHEREAS, the City Manager and the Chief of Police recommend
that the requirements for competitive formal sealed bids be
waived and the purchase of the "Return.Fire System" from Firearms
Training Systems, Inc., the sole source provider, be approved;
and
WHEREAS, funds are available from the Department of Police
Entrepreneurial Fund, Account Code No. 126001.290402.6.840;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. By a four fifths (4/5ths) affirmative vote of
the members of the City Commission, after a duly advertised
public hearing, 'the City Manager's finding of sole source and
waiving the requirements for competitive sealed bids, are hereby
ratified, approved and confirmed, and the procurement of a
"Return Fire System" to upgrade the Firearms Training System
Simulator from Firearms Training Systems, Inc. the sole source
provider, for the Department of Police, in an amount not to

exceed $4,799, is hereby approved; with funds therefor hereby
allocated from the Department of Police Entrepreneurial Fund,
Account Code No. 126001.290402.6.840.
Section 3. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.'/

It is respectfully recommended that the City Commission waive the necessity of competitive bid
and approve the attached Resolution for the sole source purchase of a Return Fire System to
upgrade the Firearms Training System Simulator used by the Police Department, from Firearms
Training Systems, (FATS) Inc., a Ton -Local Non -Minority vendor located at 7340 McGinnis
Ferry Road, Suwanee, Georgia 30024, in an amount not to exceed $4,799.
Funding is available from the Department of Police, Entrepreneurial Fund, Account Code
126001.290402.6.840.
BACKGROUND
The Police Department needs to purchase a Return Fire System to upgrade their Firearms Training
System (FATS) Simulator used by the Training Unit. This system is used to train basic recruits
and officers in the high liability areas of deadly force, firearms, and discretionary shooting.
Firearms Training Systems (FATS), Inc., is the sole manufacturer of the FATS System,
peripherals, and programmed courseware, which was previously acquired by the Police
Department from this same vendor via sole source finding.
The Director of the Purchasing Department has determined that Firearms Training Systems
(FATS), Inc., due to the proprietary nature of this system, is the sole manufacturer of the Return
Fire System.

A public hearing will be held by the City Commission of the City of Miami,

An investigatio was conducted by staff from the Department of Purchasing to determine whether
Firearms Trainin Systems (FATS), Inc., anon -minority / non -local vendor, located at 7340
McGinnis FerryRo d, Suwanee, Georgia 30024, is the sole source provider for the purchase of a
Return Fire Syste to upgrade the FATS Simulator as requested by the Police Department.
Funding is availabl from the Entrepreneurial Fund, Account Code NO. 126001.290402.6.840, in
an amount not to ceed $4,799.00.
The Police Department originally acquired its Firearms Training System simulator from FATS Inc.
Additionally, per Resolution 98-887, FATS, Inc. was authorized to upgrade the Police Department's
Firearms Training System II, to a Firearms Training System III, via a sole source finding.
The Police Department is seeking to purchase a Return Fire System to upgrade their Firearms
Training System (FATS) Simulator used by the Training Unit. This system is used to train basic
recruits and officers in the high liability areas of deadly force, firearms, and discretionary shooting.
According to FATS, they are the only source available for the purchase of a FATS system, FATS
system peripherals such as weapons; laser inserts, flashlights and OC spray, and programmed
courseware (such as video laser discs and range courses). All software that operates on the FATS
system is proprietary and owned exclusively by FATS. FATS Inc. is the only source available for
the upgrade of the FATS simulators and weapons. No other available firm was located by staff who
could provide the Return Fire System to integrate with the existing system other than FATS, Inc.In
addition, while the price for the system has increased in the past few months, FATS, Inc. agreed to
provide this system to the City at the previous rate of $4,799.00, thereby saving the City an
additional $500.00.
Accordingly, I am recommending that the requirements for competitive bidding be waived, and
