A RESOLUTION OF THE MIAMI CITY COMMISSION
DIRECTING THE CITY MANAGER TO REQUEST
REIMBURSEMENT FROM ANY APPROPRIATE FEDERAL
AND STATE AGENCY FOR THE EXPENSES INCURRED BY
THE CITY OF MIAMI TO MAINTAIN THE PUBLIC
PEACE, ORDER AND GENERAL WELFARE OF THE
CITIZENS OF THE CITY OF MIAMI CONCERNING THE
CUSTODY AND ASYLUM OF ELIAN GONZALEZ;
DIRECTING THE CITY CLERK TO TRANSMIT A COPY
OF THIS: RESOLUTION TO THE HEREIN DESIGNATED
OFFICIALS.
WHEREAS, the costs to maintain public peace and order
related to issues concerning the custody and asylum of Elian
Gonzalez have become overwhelming for the City of Miami and other
local and State of Florida governmental entities; and
WHEREAS, when controversies in the City of Miami are
triggered by non local policies, the United States government and
State of Florida should bear the burden of the costs to assure
the public health and welfare of the citizens of the City of
Miami;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:

Resolution No.
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The City Manager is hereby directed to
request reimbursement from any appropriate federal and state
agency for the expenses incurred by the City of Miami to maintain
the public peace, order and general welfare of the citizens of
the City of Miami concerning the custody and asylum of Elian
Gonzalez or for any other asylum issues.
Section 3. The City Clerk is hereby directed to transmit
a copy of this Resolution to the appropriate federal and State
agencies.
Section 4. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor'.
�i If the Mayor does not sign this Resolution, it shall become effective at
the end of ten calendar days from the date it was passed and adopted. If
the Mayor vetoes this Resolution, it shall become effective immediately
upon override of the veto by the City Commission.

Resolution of the City West Miami demanding an immediate inquiry by
Congress of the United States into the actions of the President and the
Attorney General of the United States leading to a midnight armed assault
on the Home of a citizen of the ,State of Florida and the forceW taking of a
six year old child from his shelter, and further demanding from the Office
of the State Attorney Kathy Fernandez Rundle to empanel a Grand Jury to
investigate and to conduct a hearing to determine Whether the president of
the United States, the Attorney General of the United States and
Immigration and Naturalization Agents participating into the midnight
assault have violated Florida Law in conducting a warrant less violation of
the Rights of a Citizen of the State of Florida by Assaulting with Deady
Weapons the occupants of the home.
Whereas, Whi% awaiting his "Day in Court", the home where than Gonzalez was
residing, and by express consent of the President of the United States
William Jefferson Clinton and the Attorney General of the United States
Janet Reno, agents of the Immigration and Naturalization Service, in lull
combat and machine gun gear, Braided the home of a citizen of the State
of Florida, Lazaro Gonzalez and physically removed. V ian Gonzalez a aid
year old boy, and
Whereas, like many before them, twelve people including Ehari s mother boarded a
small boat escaping the tyrannical dictatorship of Fidel Castro and headed,
to the United States, reel ang freedom, and eventually perished, and
Whereas, While still negotiating for a peaceful tranAer of Rlian Gonzalez, the
immigration and Naturalization Service Agents under the orders of
Attorney General Janet Re -no, broke into the home at 5:15A.M. using
unreasonable andunnecessary force and removed Flian Gonzalez from. his
Miami Horne, and
Whereas, Attorney General Janet Reno, authorized the Immigration and

the home of a citizen of the State of Florida.
Now, Therefore be it Resolved by the City Commission of the City of West Miami as
follows:
1. Demand from fixe Congress of the United. Sates to convene an iYnmediate
investigation into the actions and conduct of the INS Officials , ordered
by Attorney General Janet Reno under the leader&p of the President of
the United. States William Jefferson Clinton..
2. Demand. from The State Attorney for the Eleventh Judicial Circuit, Kathy
Fernandez Rundle, to empanel a Grand jury to investigate and determine
wether the actions undertaken by agents of the Iintnigration and
Naturalization Service participating in the Midnight raid into the
residence of a citizen of the State of Aorxda violated Florida Laws.
3 Instrtict the Clerh of the City of West Miami to disseminate this
Resolution to all local, . state and federal elected official and proper
Departments no later than Sunday, April 23, 2000.
