OF MIAMI, FLORIDA, ARTICLE 6, SECTION 607.4.3, PRINCIPAL USES PERMITTED ONLY BY SPECIAL EXCEPTION, TO ALLOW A DRIVE THROUGH FACILITY FOR A FINANCIAL INSTITUTION, FOR THE PROPERTIES LOCATED AT APPROXIMATELY 37-49 SOUTHWEST 12TH STREET AND 1150 SOUTH MIAMI AVENUE, MIAMI, FLORIDA, PURSUANT TO PLANS ON FILE, SUBJECT TO A TIME LIMITATION OF TWELVE (12) MONTHS IN WHICH A BUILDING PERMIT MUST BE OBTAINED AND A NEW SITE PLAN DEPICTING THE FOLLOWING MUST BE SUBMITTED FOR REVIEW AND APPROVAL BY THE PLANNING AND ZONING DEPARTMENT PRIOR TO THE ISSUANCE OF ANY BUILDING PERMITS: THE TWO PARKING SPACES PARALLEL TO SOUTHWEST 12TH STREET AT BOTH SIDES OF THE PARKING LOT ACCESS SHOULD BE RE -ORIENTED PERPENDICULAR TO SOUTHWEST 12TH STREET, AT THE WEST SIDE OF AFOREMENTIONED ACCESS, AND LANDSCAPE ISLANDS SHOULD BE LOCATED AT BOTH SIDES OF THE PARKING ACCESS. WHEREAS, the Miami Zoning Board at its meeting of April 17, 2000, Item No. 5, adopted Resolution No. ZB 2000-0300 by a vote of nine to zero (9-0), granting a Special Exception requiring City Commission approval as hereinafter set forth; and WHEREAS, Zoning Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, requires City Commission approval of the Special Exception as hereinafter set forth; and IrATTACHMENT 'S"'MEETING or I CGHTAINE D ��j CITY COIISSION MAYh2 5 2000 Resolution NO. j� ; u x WHEREAS, the City Commission after careful consideration of this matter, finds the application for Special Exception does meet the applicable requirements of Zoning Ordinance No. 11000, as amended, and deems it advisable and in<the best interest of the general welfare of the City of Miami and its inhabitants to affirm the decision of the Zoning Board and grant the Special Exception as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The decision of the Zoning Board to grant a Special Exception from Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, Article 6, Section 607.4.3, Principal Uses Permitted Only By Special Exception, to allow a drive through facility for a financial institution, for the properties located at approximately 37-49 Southwest 12th Street and 1150 South Miami Avenue, Miami, Florida, legally described as shown in Exhibit "A" attached hereto and made a part hereof, is hereby affirmed, and the Special Exception is hereby granted, pursuant to plans onfile, subject to a time limitation of twelve (12) months in which a building permit must be obtained, and a new site plan depicting Page 2 of 3 pi. r, N •- Z the following must be submitted for review and approval by the Planning and Zoning Department prior to the issuance of any building permits: the two parking spaces parallel to Southwest 12th Street at both sides of the parking lot access should be re- oriented perpendicular to Southwest 12th Street, at the west side of aforementioned access, and landscape islands should be located at both sides of the parking access. Case No. 2000-0322 Pursuant to Article 6, Section 607.4.3 of Ordinance 11000, as amended, The Zoning Or- dinance of the City of Miami, Florida, the subject proposal has been reviewed for drive- thru facility for a financial institution as follows: The following findings have been made: It is found that the use is compatible with Resolution No. 93-802 and will be benefi- cial by providing a needed service to the community. It is also found that the use is in scale and character with the surrounding area. • It is found that the presented layout provides adequate parking and circulation; how- ever, the two (2) parking spaces parallel to 12" Street at both sides of the parking lot access (the second to the east from S.W. V Avenue) should be re -oriented perpen- dicular to 12`' Street, at the west side of aforementioned access; also landscape islands should be located at both side of the parking access in order to have a better ingress and egress. • It is found that upon compliance with the condition set forth below, this project will not have any adverse impacts on the surrounding area.
