FOR LEGAL SERVICES TO THE CITY OF MIAMI IN CONNECTION WITH THE LAWSUITS CONCERNING THE IMPLEMENTATION AND COLLECTION OF THE PARKING FACILITIES SURCHARGE, PATRICK McGRATH, III, INDIVIDUALLY AND ON BEHALF OF ALL OTHERS SIMILARLY SITUATED VS. THE CITY OF MIAMI, CASE NO. 99-21456 CA -10, AND MIAMI-DADE COUNTY, THE PUBLIC HEALTH TRUST OF MIAMI - DADE COUNTY AND LAUREEN VARGA VS. THE CITY OF MIAMI, CASE NO. 99-23765 CA -08, IN THE ELEVENTH JUDICIAL CIRCUIT COURT, AUTHORIZED PURSUANT TO ORDINANCE NO. 11813; ALLOCATING FUNDS THEREFOR, IN AN ADDITIONAL AMOUNT NOT TO EXCEED $70,000, FROM THE PARKING SURCHARGE ADMINISTRATIVE ACCOUNT FOR SAID SERVICES. WHEREAS, on July 13, 1999, the City Commission adopted Ordinance No. 11813, which authorized the implementation and collection of a Parking Facilities Surcharge; and WHEREAS, two lawsuits were filed challenging the parking surcharge, Patrick McGrath, III, individually and on behalf of all others similarly situated vs. the City of Miami, Eleventh Judicial Circuit Court, Case No. 99-21456 CA -10 and Miami -Dade County, The Public Health Trust of Miami -Dade County and Laureen Varga vs. the City Of Miami, Case No. 99-23765 CA -08, in the Eleventh Judicial Circuit Court; and CITY COMMISSION MEETING OF MAY 2 5 2000 Resolution No. WHEREAS, Resolution No. 99-728, adopted September 28, 1999, approved the City Attorney's engagement of a qualified law firm to provide legal services to the City of Miami in connection with the lawsuit, Patrick McGrath, III, individually and on behalf of all others similarly situated vs. the City of Miami, Eleventh Judicial Circuit Court, Case No. 99-21456, in an amount not to exceed $75,000; and WHEREAS, it is estimated that an additional amount of $70,000 is needed for legal services for conclusion of both lawsuits; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Attorney's continuing engagement of the law firm of Weiss, Serota & Helfman for legal services provided to the City of Miami, in connection with the lawsuits of Patrick McGrath, III, individually and on behalf of all others similarly situated vs. the. City of Miami, Eleventh Judicial Circuit Court, Case No. 99-21456 Ca -10, and Miami -Dade County, The Public Health Trust of Miami -Dade County and Laureen Varga vs. the City Of Miami, Case No. 99-23765 Ca -08, in the Eleventh Judicial Circuit Court concerning the implementation and collection of the Parking Facilities Surcharge, authorized pursuant to Ordinance No. 11813, with funds therefor, in an Page 2 of 3 kf 0 amount not to exceed $70,000, hereby allocated from the Parking Surcharge Administrative Account for said services. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
