HomeMy WebLinkAboutR-00-0446J-00-418 5/15/00 RESOLUTION NO. 0 0 — 4 4 (9 A RESOLUTION OF THE MIAMI .CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A QUIT CLAIM DEED AND ALL NECESSARY DOCUMENTS TO CONVEY AND QUIT CLAIM TO THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION ("FDOT") APPROXIMATELY 3,278 SQUARE FEET OF CITY -OWNED LAND LOCATED ON WATSON ISLAND, ADJOINING THE SOUTHWESTERLY RIGHT-OF-WAY LINE OF STATE ROAD A -1-A (MACARTHUR CAUSEWAY), MORE PARTICULARLY DESCRIBED IN EXHIBIT "A" ATTACHED HERETO AND MADE A PART HEREOF, FOR, MACARTHUR CAUSEWAY [STATE ROAD NO. (A -1-A)] RIGHT-OF-WAY IN MIAMI-DADE COUNTY, FLORIDA. WHEREAS, Resolution No. 98-23, adopted January 13, 1998, authorized the conveyance of portions of City -owned property on Watson Island, within the City of Miami, Florida to the State of Florida Department of Transportation ("FDOT.') for construction of an access road from State Road No. A -1-A (MacArthur Causeway), Financial Project 2495991, Section No. 87060-2576 in Miami -Dade County, Florida; and WHEREAS, approximately 3,278 square feet of City -owned property was inadvertently omitted from the legal description of the deeds recorded on March 13, 1998; and CONTAINED CM COMMISSION MEETING -OF MAY 2 9 206Q Aesolution 140. • Ll WHEREAS, to correct this error it is necessary that the City quit claim the omitted property to the FDOT; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA; Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Manager is hereby authorized" to execute a Quit Claim Deed and all necessary documents to convey and quit claim to the FDOT approximately 3,278 square feet of City -owned property located on Watson Island, adjoining the Southwesterly Right -of -Way line of State Road A -1-A (MacArthur Causeway), more particularly described in Exhibit "A" attached hereto and made a part hereof for MacArthur Causeway [State Road No. (A -1-A)] in Miami -Dade County, Florida. �i The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. II1`h Avenue, Miami, Florida 33172, hereinafter called "Grantee". WITNESSETH: That the Grantors, for and in consideration of the sum of One Dollar ($1.00) and other valuable consideration; receipt of which is hereby acknowledged, do hereby remise, release, convey and quit -claim unto the Grantee forever, all their right, title and interest in that certain land situate in Miami- Dade County, Florida, to wit: As described in Exhibit "A" attached hereto and made a part hereof. TO: The Honorable Mayor and Members of the City Commission RECOMMENDATION: CITY OF MIAMI, FLORIDA INTER -OFFICE MEMORANDUM 0 11 DATE: MAY 15 2000 FILE: SUBJECT: Authorizing Conveyance of Land to FDOT on Watson Island REFERENCES: ENCLOSURES:Resolution & Quit Claim Deed It is respectfully recommended that the City Commission adopt the attached Resolution authorizing the City Manager to execute a Quit Claim Deed and any and all other documents necessary to convey and quit claim to the State of Florida Department of Transportation (FDOT) approximately 3,278 square feet of City -owned property located on Watson Island, adjoining the Southwesterly right-of-way line of State Road A -1-A (MacArthur Causeway), as more particularly described in Exhibit "A" attached hereto and made a part hereof (the "Property"). This property is needed by FDOT for MacArthur Causeway [State Road No. (A -1-A)] right-of-way. BACKGROUND: On January 13, 1998 the City of Miami Commission passed and adopted Resolution No. 98-23 authorizing the conveyance of certain properties on Watson Island to Florida Department of Transportation for construction of an access road from State Road No. A -1-A (MacArthur Causeway). Approximately 3,278 square feet of City -owned property was inadvertently omitted from the legal description of the deeds recorded on March 13, 1998.
