RESOLUTION NO. 434
A RESOLUTION OF THE MIAMI CITY COMMISSION,
WITH ATTACHMENT(S), RATIFYING, APPROVING AND
CONFIRMING THE SALARY AND BENEFITS TO BE
RECEIVED BY CITY MANAGER CARLOS A. GIMENEZ.
WHEREAS, on May 9, 2000, Mayor Joe Carollo appointed
Carlos A. Gimenez to the position of City Manager of the City of
Miami, Florida; and
WHEREAS, on May 18, 2000, pursuant to Resolution No. 00-432,
Mayor Joe Carollo's appointment of Carlos A. Gimenez to the
position of City Manager of the City of Miami, Florida, was
ratified, approved and confirmed by the City Commission; and
WHEREAS, it is now in order for the City Commission to
ratify, approve and confirm Carlos A. Gimenez' salary and
benefits package for Carlos A. Gimenez' services as City Manager,
effective upon final approval by the Financial Emergency
Oversight Board; and
WHEREAS, Carlos A. Gimenez shall continue to serve as City
Manager until final action is taken by the Financial Emergency
Oversight Board; and
WHEREAS, Carlos A. Gimenez shall continue to serve as Chief
of the Department of Fire -Rescue until final action is taken by
the Financial Emergency Oversight Board; and

WHEREAS, the benefits and compensation package attached
hereto specifically refers to terms and conditions defined in
accordance with established City of Miami policy as set forth by
the Office of Labor Relations; and
WHEREAS, upon Carlos A. Gimenez' retirement as Chief of the
Department of Fire -Rescue, the City Commission wishes to approve
retroactive pay for one (1) year in the amount of $70,000 as a
matter of compensating Carlos A. Gimenez for future pension
benefits he would accrue should he remain as the Chief of the
Department of Fire -Rescue;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. Upon approval by the Financial Emergency
Oversight Board, the salary and benefits to be received by
Carlos A. Gimenez as City Manager, listed on "Attachment No. 1
attached hereto and made a part hereof,- are hereby set forth and
authorized. As compensation, Carlos A. Gimenez shall receive the
annual sum as set forth in "Attachment No. 1" and shall receive

the same cost of living increases, if any, available on an annual
basis to all eligible City of Miami employees.
Section 3. Carlos A. Gimenez shall receive a one year
retroactive increase in the amount of $70,000.00 as Chief of the
Department of Fire -Rescue.
Section 4. Carlos A. Gimenez shall remain in his
position as City Manager until the Financial Emergency Oversight
Board approves this Resolution in its entirety and "until the
effective date of this Resolution..
Section 5. Carlos A. Gimenez shall remain in his
position as Chief of the Department of Fire -Rescue until the
Financial Emergency Oversight Board approves this Resolution in
its entirety and until the effective date of this Resolution.
Section 6. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor Y
�i If .the Mayor does not sign this Resolution, it shall become effective at
the end of ten calendar days from the date it was passed and adopted.
If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.

NOTICE OF SPECIAL MEETING
PLEASE ALL TAKE NOTICE THAT Pursuant to Section 2-330) of the City of
Miami Code, (Order of.Business/Special Meetings), a special meeting will be held
by the City Commission of the City of Miami, Florida on Thursday, May 25,
2000, beginning 9:30 a.m. in the City Commission Chambers at City Hall, 3500
Pan American Drive, Miami, Florida. The purpose of said meeting is to discuss
the salary, benefits and severance package for City Manager Carlos Gimenez.
All interested persons are invited to attend.
