RESOLUTION NO. 00- d 3 r A RESOLUTION OF THE MIAMI CITY COMMISSION RATIFYING, APPROVING AND CONFIRMING MAYOR JOE CAROLLO'S APPOINTMENT OF CARLOS A. GIMENEZ AS CITY MANAGER OF THE CITY OF MIAMI, FLORIDA, EFFECTIVE UPON FINAL APPROVAL BY THE FINANCIAL EMERGENCY OVERSIGHT BOARD OF A COMPENSATION PACKAGE. WHEREAS, on May 9, 2000, Mayor Joe Carollo appointed Carlos A. Gimenez to the position of City Manager of the City of Miami, Florida; and WHEREAS, pursuant to Section 4(g)(6) of the Charter of the City of Miami, Florida, as amended, the Mayor is required to appoint the City Manager, subject to the approval within 14 days of a majority of the City Commissioners then in office; and WHEREAS, the City Commission wishes to ratify, approve and confirm Carlos A. Gimenez' appointment as City Manager of the City of Miami, Florida, effective upon final approval of a compensation package by the Financial Emergency Oversight Board, which compensation package will be approved by separate resolution; and WHEREAS, Carlos A. Gimenez shall continue to serve as City Manager until final approval on the compensation package is given by the Financial Emergency Oversight Board; and CITY COMMISSION', MEETING OF mAy 1 1 2000 1 Resolution No. �1 0 • WHEREAS, Carlos A. Gimenez shall continue to serve as Chief of the Department of Fire -Rescue until final approval on the compensation package is given by the Financial Emergency Oversight Board; and WHEREAS, the Mayor and City Commissioners agree to meet with the Administration and representatives of the labor unions during the month of January of each year, at an offsite location, to define major goals and performance objectives for the next fiscal year; and WHEREAS, the objectives agreed upon, which will implement the goals, shall be obtainable within the timeframe set forth and within the operating and capital budgets provided; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Mayor Joe Carollo's appointment of Carlos A. Gimenez as City Manager of the City-bf Miami, Florida, is hereby ratified, approved and confirmed, effective upon final approval of a compensation package by the Financial Emergency Oversight Board, which compensation package will be approved by separate resolution. The purpose of said meeting is for the City Commission's consideration of Carlos A. Gimenez as the new City Manager. City Code Section 2-330) states: "Special meetings. Nothing in this section shall prohibit either the mayor, or the commissioner designated as the presiding officer of the city commission, or three city commissioners, upon the written notice delivered to the city clerk, from calling special meetings at any time set by the city clerk, provided that reasonable advance notice of same is given to the mayor, each member of the commission, city manager, city attorney and the public . No business shall be conducted or a voted taken at a special city commission meeting on business other than the subject(s) for which the special meeting is called."
