CITY COMMISSION DIRECTING THE CITY MANAGER TO INSTRUCT THE DIRECTOR OF THE DEPARTMENT OF PLANNING AND ZONING TO IMMEDIATELY ISSUE A DETERMINATION OF USE REGARDING A NETWORK ACCESS POINT ("NAP") FACILITY, A MAJOR PUBLIC NETWORK EXCHANGE FACILITY STRATEGICALLY LOCATED TO INTERCONNECT INTERNET SERVICE PROVIDERS; FURTHER DIRECTING THAT UPON SUCH DETERMINATION, APPROPRIATE LEGISLATION BE PRESENTED TO THE PLANNING ADVISORY BOARD AT ITS NEXT IMMEDIATELY SCHEDULED MEETING, AND THEN SCHEDULED FOR CITY COMMISSION REVIEW AND CONSIDERATION FOR ULTIMATE CODIFICATION IN THE ZONING ORDINANCE OF THE CITY. OF MIAMI, FLORIDA. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Manager is hereby directed to instruct the Director of the Department of Planning and Zoning to immediately issue a Determination Of Use regarding a Network Access Point ("NAP") facility, a major public network exchange facility strategically located to interconnect Internet Service Providers. Section 2. The City Manager is hereby further directed that upon such determination, appropriate legislation be presented to the Planning Advisory Board at its next immediately CITY COMUSSION MEETING OF APR 7 7 2000 Resolution No. scheduled meeting, and then scheduled for City Commission review and consideration for ultimate codification in the Zoning Ordinance of the City of Miami, Florida. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.'/ PASSED AND ADOPTED this 27th day of April 2000.
