RESOLUTION NO.�
A RESOLUTION OF THE MIAMI. CITY COMMISSION
DIRECTING THE CITY MANAGER TO INSTRUCT THE
DIRECTOR OF THE DEPARTMENT OF PLANNING AND
ZONING TO IMMEDIATELY ISSUE A DETERMINATION
OF USE REGARDING A NETWORK ACCESS POINT
("NAP") FACILITY, A MAJOR PUBLIC NETWORK
EXCHANGE FACILITY STRATEGICALLY LOCATED TO
INTERCONNECT INTERNET SERVICE PROVIDERS;
FURTHER DIRECTING THAT UPON SUCH
DETERMINATION, APPROPRIATE LEGISLATION BE
PRESENTED TO THE PLANNING ADVISORY BOARD AT
ITS NEXT IMMEDIATELY SCHEDULED MEETING, AND
THEN SCHEDULED FOR CITY COMMISSION REVIEW AND
CONSIDERATION FOR ULTIMATE CODIFICATION IN
THE ZONING ORDINANCE OF THE CITY. OF MIAMI,
FLORIDA.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The City Manager is hereby directed to
instruct the Director of the Department of Planning and Zoning to
immediately issue a Determination Of Use regarding a Network
Access Point ("NAP") facility, a major public network exchange
facility strategically located to interconnect Internet Service
Providers.
Section
2.
The City Manager is hereby
further directed
that upon
such
determination, appropriate
legislation be
presented to the Planning Advisory Board at its next immediately

scheduled meeting, and then scheduled for City Commission review
and consideration for ultimate codification in the Zoning
Ordinance of the City of Miami, Florida.
Section 3. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.'/

�i If the Mayor does not sign this Resolution, it shall become effective at
the end of ten calendar days from the date it was passed and adopted.
If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
