A RESOLUTION OF THE MIAMI CITY COMMISSION,
WITH ATTACHMENT(S), AFFIRMING THE DECISION OF
THE ZONING BOARD THEREBY GRANTING A SPECIAL
EXCEPTION FROM THE ZONING ORDINANCE OF THE
CITY OF MIAMI, FLORIDA, ARTICLE 6,
SECTION 612, SD -12 SPECIAL BUFFER OVERLAY
DISTRICT, TO ALLOW SURFACE PARKING TO SERVE
THE ABUTTING DISTRICT, FOR THE PROPERTIES
LOCATED AT APPROXIMATELY (I) 3640 & 3652
SOUTHWEST 22"D STREET AND (II) 3633 & 3665
SOUTHWEST 22ND TERRACE, MIAMI, FLORIDA,
PURSUANT TO PLANS ON FILE AND SUBJECT TO A
TIME LIMITATION OF TWELVE (12) MONTHS IN
WHICH A BUILDING PERMIT MUST BE OBTAINED AND
THE FOLLOWING CONDITIONS RECOMMENDED BY THE
PLANNING AND ZONING DEPARTMENT: PRIOR TO THE
ISSUANCE OF ANY BUILDING PERMITS THE PROPERTY
OWNER SHALL SUBMIT A COMPLETE NEW LANDSCAPE
PLAN ACCEPTABLE TO THE DEPARTMENT, INCLUDING,
BUT NOT LIMITED TO, A 6' HIGH MASONRY WALL
ON THE SOUTH SIDE OF THE SUBJECT PROPERTIES
AND INCREASING THE HEIGHT OF THE PROPOSED
TREES TO 14' IN HEIGHT.
WHEREAS, the Miami Zoning Board at its meeting of
March 20, 2000, Item No. 1, adopted Resolution No. ZB 2000-0288
by a vote of eight to zero (8-0), granting a Special Exception
requiring City Commission approval as hereinafter set forth; and
WHEREAS, Zoning Ordinance No. 11000, as amended, the Zoning
Ordinance of the City of Miami, Florida, requires City Commission
approval of the Special Exception as hereinafter set forth; and
WHEREAS, the City Commission after careful consideration of
this matter, finds the application for Special Exception does

meet the applicable requirements of Zoning Ordinance No. 11000,
as amended, and deems it advisable and in the best interest of
the general welfare of the City of Miami and its inhabitants to
affirm the decision of the Zoning Board and grant the Special
Exception as hereinafter set forth;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The decision of the Zoning Board to grant a
Special Exception from Ordinance No. 11000, as amended, the
Zoning Ordinance of the City of Miami, Florida, Article 6,
Section 612, SD -12 Special Buffer Overlay District, to allow
surface parking to serve the abutting district, for the
properties located at approximately (I) 3640 & 3652 Southwest
22nd Street and (II) 3633 & 3665 Southwest 22nd Terrace, Miami,
Florida, legally described as shown in Exhibit "A" attached
hereto and made a part hereof, is hereby affirmed, and the
Special Exception is - hereby granted, --pursuant to plans on file,
subject to a time limitation of twelve (12) months in which a
building permit must, be obtained and the following conditions

recommended by the Planning and Zoning Department: prior to the
issuance of any building permits, the property owner shall submit
a complete new landscape plan acceptable to the Department,
including, but not limited to, a 6' high masonry wall on the
south side of the subject properties and increasing the height of
the proposed trees to 14' in height.
Section 3. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor Y

APPROX. 3640/3652 SW 22nd STREET AND 3633/3665 SW 22nd
TERRACE
CASE NO. 2000-0313
Pursuant to Section 612, "Special Buffer Overlay District"; of Ordinance 11000, as
amended, the Zoning Ordinance of the City of Miami, Florida, the subject proposal has
been reviewed to allow surface parking to serve abutting district as follows:
NOTE: This Special Exception also encompasses the following special permits:
Class 11 Special Permit, to allow waiver of Guidelines and Standards.
The following findings have been made:
• It is found that the subject properties are immediately adjacent on the north side to a
C-1 "Restricted Commercial" designated area under the same ownership.
• It is found that the proposed use will be beneficial to the area by providing parking for
existing commercial uses along SW 22"a Street (Coral Way).
• It is found that the proposed layout provides adequate circulation, including ingress
and egress.

• It is found that the proposed landscape plan is in discrepancy with the submitted site
plan. The location of the 6' height masonry wall at the south side of the properties do
not match the site plan, also it is found that the proposed tree height should be
increased.
• It is found that the depicted landscape does not meet the City of Miami Guides and
Standards. The proposed parking layout is missing the required island between
parking spaces. However, in order to accommodate the required number of parking
spaces for the proposed commercial use, the applicant is asking for a waiver of above
mentioned Guides and Standards.
• It is found that the requested change will increase the possibility of subject properties,
along with the immediately adjacent properties fronting Coral Way, being developed
as one project which directly benefits the area.

Within the City generally, or within certain zoning districts, certain structures, uses, and/or occupancies
specified in this ordinance are of a nature requiring special and intensive review to determine whether
or not they should be permitted in specific locations, and if so, the special limitations, conditions, and
safeguards which should be applied as reasonably necessary promote the general purposes of this
Zoning Ordinance and, in particular, to protect adjoining properties and the neighborhood from
avoidable potentially adverse effects. It is further intended that the expertise and judgment of the
Zoning Board be exercised in making such determinations, in accordance with the rules, considerations

Terrace. On December 14, 1999, the City of Miami Commissioners approved an amendment
to the City's Zoning Atlas placing a SD -12 (Special Buffer Overlay Districts) on these four
lots (the "SD -12 Lots").
The Applicants are requesting a special exception pursuant to Section 612 of the City's
Zoning Ordinance No. 11000 (the "Request"). The Request will allow for a hotel in . the
Commercial Lots with surface parking to serve the hotel on the SD -12 Lots. The hotel use is
