A RESOLUTION OF THE MIAMI CITY COMMISSION
AUTHORIZING THE CITY MANAGER TO EXECUTE AN
AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY, SUBJECT TO APPROVAL OF THE OFFICE
OF SAFE NEIGHBORHOODS PARKS BOND PROGRAM,
WITH BELAFONTE TACOLCY CENTER, INC. ("BTC"),
FOR THE IMPLEMENTATION OF THE CAPITAL
IMPROVEMENT SERVICES ASSOCIATED WITH THE
RENOVATION OF THE CITY'S BTC FACILITY LOCATED
AT 6161 N.W. 9TH AVENUE, MIAMI, FLORIDA, IN AN
AMOUNT NOT TO EXCEED $150,000; ALLOCATING
FUNDS THEREFOR FROM THE CITY'S GRANT FROM THE
SAFE NEIGHBORHOOD PARKS BOND PROGRAM, AS
PREVIOUSLY APPROVED THROUGH CITY RESOLUTION
NO. 98-1109.
WHEREAS, Belafonte Tacolcy Center, Inc. ("BTC") has an
existing agreement with the.City of Miami to operate and maintain
a sports development program from the City's BTC facility located
at 6161 Northwest 9th Avenue, Miami, Florida; and
WHEREAS, the renovations of the City's BTC facility is a
project of the Belafonte Tacolcy Center, Inc.; and
WHEREAS, certain renovations in the facility are being
funded by Community Block Grant Funds through an Agreement with
Belafonte Tacolcy Center, Inc.; and
WHEREAS, City has received an allocation in the amount of
$150,000 of Safe Neighborhood Parks Bond Program funds from
Miami -Dade County, through Miami -Dade County Ordinance
No. 96-115, for the renovations of the BTC facility; and

WHEREAS, the Department of Parks and Recreation proposes to
enter into an Agreement with Belafonte Tacolcy Center, Inc. in
order to administer funds for capital improvements at the park
facility; and
WHEREAS, said use of Community Development Block Grant funds
complies with all applicable rules, regulations or laws regarding
same as approved by the Director of Community Development;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The City Manager is hereby authorized" to
execute an agreement, in form acceptable to the City Attorney,
with Belafonte Tacolcy Center, Inc. for the implementation of the
capital improvement services and costs associated with the
renovation of the City's BTC facility located at
6161 Northwest 9th Avenue, Miami, Florida, in an amount not to

exceed $150,000, with funds therefor hereby allocated from the
Safe Neighborhood Parks Bond Programs as previously approved
through City Resolution No. 98-1109, subject to approval from the
Miami -Dade County Safe Neighborhood Parks Bond Program Office.
Section 3. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor./

ENCLOSURES:
It is respectfully recommended that the City of Miami Commission
adopt the attached resolution authorizing the City Manager to
enter into an agreement, in an amount not to exceed $150,000 and
in a form acceptable to the City Attorney, with Belafonte Tacolcy
Center, Inc. (BTCI) a Florida non -for-profit Corporation. The
Agreement is necessary in order to provide the funding to the
BTCI, which is implementing and overseeing the renovations to the
City's Belafonte Tacolcy Park building located at 6161 N.W. 9th
Avenue.
BACKGROUND:
The Department of Parks and Recreation proposes to enter into an
agreement with the BTCI in order to have them administer funds in
the amount of $150,000 for capital improvements from the Safe
Neighborhood Parks Bond Program (Year two 1998 Bond Series) as
approved through City Resolution No. 98-1109.
The Safe Neighborhood Parks Bond (SNPB) funds were allocated for
the renovation of the City owned Belafonte Tacolcy Park building,
which is operated by the BTCI. This organization already has an
Agreement with the City's Community Development Department to
manage and implement renovations to this building utilizing
Community Development Block Grant (CDBG) funds. The SNPB funds
will be combined with the CDBG funds to conduct the needed
renovations.
BTCI will be required to follow existing SNPB procedures and to
submit all invoices to the City for processing. The Miami -Dade
Count �},�TPB Program Office will have to approve this Agreement.

APPLICATIONS, IN THE AMOUNT OF $3,365,900, AND

MIAMI -DADS COUNTY FOR THE SAFE NEIGHBORHOOD PARKS
BOND PROGRAM, BOND SERIES 1998 (YEAR TWO FUNDING);
AUTHORIZING THE CITY MANAGER TO ACCEPT SAID GRANT
AWARDS AND EXECUTE THE NECESSARY DOCUMENT (S) , IN A
FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR THIS
PURPOSE; AUTHORIZING THE PAYMENT OF: (1)
SUPPLEMENTAL FUNDS. REQUIRED ,TO., COMPLETE SAID

WHEREAS, the citizens of Miami -Dade County authorized the
issuande of general obligation bonds (the "Bonds") for the
purpose of financing capital improvement programs for certain
parks, beaches, natural areas and recreation facilities; and
WHEREAS, to implement and give effect to the bond program,
Miami Dade County, Florida enacted Ordinance 96-115, adopted July
16, 1996, the Safe Neighborhood Parks Ordinance (the
"Ordinance"); and

WHEREAS., to further these, values, the projects more
specifically designated herein have 'been identified for
reimbursement -pursuant to the teens of,the Ordinance; and
-WHEREAS, pursuant to the terms. of the Ordinance, the passage
of this Resolution.and the acts-contemplated`by this Resolution
are„conditions to obtaining said grants'; and
WHEREAS, the City. of Miami has made applications for the
grant monies for the projects listed to Miami -Dade County,
pursuant to all terms and conditions of the Ordinance; and
WHEREAS, the majority of said ' projects as indicated herein
Will not have a budgetary/operational impact upon the City of
Miami; and
WHEREAS, the estimated impact on the City of Miami's
operations, and budget of new- sports and security lighting
projects in certain parks will. be addressed in, the FY '2000
budget of the Department of Parks and Recreation; and
WHEREAS,” the City's budgetary/operational impact for the
proposed recreation building. projects` will be substantially
diminished by entering into partnerships with not-for-profit
organizations to operate programs and share, costs; and ;
WHEREAS°,._'upon completion of the design of the 'proposed
recreation buildings the expected impact will be included in the
FY 12001 budget .of the Department of Parks and Recreation;..p

Section 4. The City of Miami shall complete each of the
projects in accordance with the terms of said grant agreement(s),
the Ordinance, and the administrative rules authorized by the
Citizen's Oversight Committee (the "Committee") to implement the
Ordinance. If the total cost of a project exceeds the value
allocated in said grant (s) , then. the City of Miami will provide
any supplemental funds required to complete the project. In the
event that supplemental funds are necessary for completion the
City of Miami will demonstrate that such supplemental funds have
been committed to the project prior to and as a condition of.

requirement for the City of Miami to provide any supplemental
funds needed to complete the project may, at the sole discretion
of the Committee, be modified in whole or in part by a reduction
in scope of work consistent with the Ordinance.
. Section 5. The City of Miami recognises and directs that
any beach, park', or other public facility acquired, developed,
rehabilitated or restored with bond funds,- including the
projects, shall be open and accessible to the public without
discrimination as to race, color, gender, age, religion, belief,
residence, natural origin, marital status or disability.
Section 6. To the extent allowed by law, City of Miami
shall commit any ;and all funds which may be required to operate,
maintain and provide programming at each park project upon its

completion.
Section 7. All grants received shall be used solely for
the projects. for which they have,been designated.

immediately upon its adoption and signature of the Mayor.2/
