A RESOLUTION OF THE MIAMI CITY COMMISSION,
WITH ATTACHMENT, CONVEYING FIVE (5) CITY -
OWNED VACANT PARCELS TO THE RAFAEL HERNANDEZ
HOUSING AND ECONOMIC DEVELOPMENT CORPORATION
FOR THE CONSTRUCTION OF SIX (6) NEW SINGLE
FAMILY HOMES FOR PURCHASE BY LOW AND
MODERATE INCOME FAMILIES; REAFFIRMING AND
GRANTING A TWELVE (12) MONTH EXTENSION, FROM
APRIL 25, 2000 TO APRIL 25, 2001, TO
COMMENCE AND COMPLETE CONSTRUCTION AND SALE
OF THE REMAINING FIVE (5) SINGLE FAMILY
HOMES PLANNED IN THE ALLAPATTAH
NEIGHBORHOOD; FURTHER AUTHORIZING THE CITY
MANAGER TO EXECUTE ALL NECESSARY
DOCUMENT(S), IN A FORM ACCEPTABLE TO THE
CITY ATTORNEY, CONVEYING SAID PARCELS
SUBJECT TO CERTAIN TERMS AND CONDITIONS.
WHEREAS, the City Commission recognizes that the
participation of both the public and private sector is necessary
to foster the development of housing affordable to low and
moderate -income families and individuals in the City; and
WHEREAS, in September of 1995, through Resolution
No. 95-612, the Rafael Hernandez Housing and Economic Development
Corporation was designated by the City Commission as sponsor to
construct six (6) new single-family homes on five (5) city -owned
parcels in the Allapattah neighborhood; and

WHEREAS, in July of 1996, through Resolution No. 96-537, a
six (6) month extension was granted from September 14, 1966 to
March 14, 1997 to Rafael Hernandez Housing and Economic
Development Corporation to complete construction on the six (6)
single family homes; and
WHEREAS, to date only one (1) single. family home has been
completed; and
WHEREAS, it is necessary that Rafael Hernandez Housing and
Economic Development Corporation secure an extension by the City
Commission in order to proceed with the construction of the
remaining five (5) single family homes; and
WHEREAS, it is recommended that the subject parcels be
conveyed to Rafael Hernandez Housing and Economic Development
Corporation at no cost, pursuant to City Commission policy
established in the City's Five -Year Consolidated
Plan (1999-2004);
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in
the Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.

Section 2. A twelve (12) month extension, from
April 25, 2000 to April 25, 2001, is hereby granted to Rafael
Hernandez Housing and Economic Development Corporation
("Corporation"), in which to secure financing, complete the
construction and sales of the remaining five (5) single family
homes to qualified low and moderate income families in the
Allapattah neighborhood.
Section 3. The City Manager is hereby authorized"
to execute all necessary document(s), in a form acceptable to
the City Attorney, at no cost the conveyance of the said
parcels, more particularly described in the attached Exhibit
"A", to the Corporation. Construction on the subject parcels
must be underway within six (6) months from the date of City
Commission action and construction completed and the single
family homes sold to qualified low and moderate income
homebuyers by April 25, 2001 or the said parcels will revert
back to the City.
1� The herein authorization is further subject to compliance with all
requirements that may be imposed by the City Attorney, including but
not limited to those prescribed by applicable City Charter and Code
provisions.

Section 4. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor./

It is respectfully recommended that the City Commission adopt the attached resolution,
reaffirming and authorizing the City Manager to convey five (5) city -owned vacant parcels to the
Rafael Hernandez Housing and Economic Development Corporation, in connection with the
construction of five (5) new single family homes in the Allapattah neighborhood. The attached
resolution also authorizes the granting of a twelve (12) month extension, from April 25, 2000 to
April 25, 2001, for the organization to commence and complete construction of the five (5)
homes. The resolution further authorizes the City Manager to convey the subject parcels to the
organization at no cost, per City Commission policy established in the City's Five (5) Year
Consolidated Plan (1999 — 2004).
BACKGROUND:
In September 1995, through the adoption of Resolution No. 95-612, the City Commission
designated the Rafael Hernandez Housing and Economic Development Corporation, as
developer, to undertake the construction of six (6) new single family homes on five (5) vacant
city -owned parcels located in the Allapattah neighborhood. Resolution No. 95-612 required the
organization to complete construction within twelve (12) months.
In July 1996, the City Commission adopted Resolution No. 96-537, granting a six (6) month
extension from September 14, 1996 to March 14, 1997, to Rafael Hernandez Housing and
Economic Development Corporation to complete the financing plans, construction and sales of
the homes to qualified low and moderate income families in the Allapattah neighborhood. To
date, only one (1) home has been constructed. With the expiration of the extension previously
granted by the City Commission in accordance with the above-mentioned resolution, it is
necessary that the City Commission grant an additional extension for the organization to move
forward with the proposed scattered site housing project.

The attached resolution grants a twelve (12) monthex tension to Rafael Hernandez
Housing and Economic Development Corporation to secure the balance of the financing,
complete. construction and sell-out of the single family homes to qualified low and
moderate income homebuyers. The attached resolution further directs the City. Manager
to convey the subject city-owned vacant parcels to the organization' at no cost.
Construction on the subject parcels must be underway within six (6) months from the
date of City Commission action-, with construction completed and the new single family
homes sold to qualified low and moderate income homebuyers by April 25, 2001, or the
subject parcels will revert back to the City.
In an effort to further promote the development of five (5) new single family homes in
the Allapattah neighborhood, City Commission adoption of the attached resolution is
respectfully recommended.

NOW, THEREFORE, BE IT -RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section. 1. The recitals and findings contained in the

Section 3. Rafael Hernandez Housing and - Economic
Development Corporation is hereby 'directed to preparet and
finalize ' housing plans and specifications, construction. and
permanent financing, construction schedule for the.obtAining of
building permits within six .:(6) months and construction to be
completed within twelve (12) months from the date of this action.
Subject parcels to revert back to the City if construction is not
completed within twelve (12) months from the date of this action.

Section 4. The City Commission hereby establishes $40,46;
as the acquisition amount to be paid by the sponsor to the Cit-,.
of Miami for said parcels for the subsequent development of the
six (6) new single family homes being planned.
Section 5. The City Manager is hereby authorized 1l to
execute the appropriate documents, in forms acceptable to the
City Attorney, conveying said parcels, more particularly and
legally described in the attached Exhibit "A" to the sponsor. The
acquisition amount for said parcels to be paid the City shall be
placed in the form of a first mortgage lien and satisfied at the
consummation of each purchase 'transaction. Subordination of said
lien shall be subject to review and acceptance by the City
Manager of any further financing provided for the devel.nnmont
the proposed single family homes.
Section 6. This Resolution shall become effective
immediately upon its adoption.
