A RESOLUTION OF THE MIAMI CITY COMMISSION
RELATED TO THE MIAMI/BAHAMAS GOOMBAY FESTIVAL,
CONDUCTED BY THE MIAMI/BAHAMAS GOOMBAY FESTIVAL
IN COCONUT GROVE, INC. (THE "ORGANIZER") ON
JUNE 3-4, 2000; AUTHORIZING THE ISSUANCE OF A
TWO-DAY PERMIT FOR THE SALE OF ALCOHOLIC
BEVERAGES DURING SAID EVENT IN THE AREA
DESIGNATED HEREIN; AUTHORIZING THE WAIVER OF
ALL FEES AND PERMITS PERMISSIBLE BY LAW;
CONDITIONING SAID AUTHORIZATIONS UPON THE
ORGANIZERS: (1) OBTAINING ALL PERMITS REQUIRED
BY LAW; (2) PAYING FOR ALL OTHER NECESSARY
COSTS OF CITY SERVICES AND APPLICABLE FEES
ASSOCIATED WITH SAID EVENT; (3) OBTAINING
INSURANCE, INCLUDING BUT NOT LIMITED TO LIQUOR
LIABILITY, TO PROTECT THE CITY IN AN AMOUNT AS
PRESCRIBED BY THE CITY MANAGER OR DESIGNEE; (4)
INSTITUTING AN IDENTIFICATION SYSTEM TO ASSURE
THAT ONLY THOSE INDIVIDUALS OVER THE AGE OF
TWENTY-ONE MAY PURCHASE ALCOHOLIC BEVERAGES;
(5) ADVISING ALL ADJACENT BUSINESSES, PROPERTY
OWNERS, AND RESIDENTS OF STREET CLOSURES
ASSOCIATED WITH SAID EVENT; AND (6) COMPLYING
WITH ALL CONDITIONS AND LIMITATIONS AS MAY BE
PRESCRIBED BY THE CITY MANAGER OR DESIGNEE.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The City Manager is hereby authorized to
issue a two-day permit for the sale of alcoholic beverages during
the Miami/Bahamas Goombay Festival, conducted by the
Miami/Bahamas Goombay Festival in Coconut Grove, Inc. (the

"Organizer") to be held on June 3-4, 2000, from 9:00 A.M. to
7:00 P.M., in the area of Grand Avenue from McDonald Street to
Douglas Road, Coconut Grove, Miami, Florida, including all
streets, avenues, alleys, ways and thoroughfares which intersect
said areas in Coconut Grove, Miami, Florida.
Section 2. The waiver of all fees permissible by the
Code of the City of Miami, Florida, as amended, is hereby
authorized.
Section 3. The herein authorizations are hereby
conditioned upon the Organizers: (1) obtaining all permits
required by law, including but not limited to a temporary permit
to sell alcoholic beverages by the Florida Department of Business
Regulation, Division of Alcoholic Beverages and Tobacco, pursuant
to Section 54-13 of the Code of the City of Miami, Florida, as
amended; (2) paying for all other necessary costs of City
services and applicable fees associated with said event;
(3) obtaining insurance, including liquor liability, to protect
the City in the amount as prescribed by the City Manager or
designee; (4) instituting an identification program to assure
that only those individuals over the age of twenty-one may
purchase alcoholic beverages; (5) advising all adjacent
businesses, property owners, and residents of street closures
associated with said event; and (6) complying with all conditions
and limitations as may be prescribed by the City Manager or
designee.

Section 4. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor

If the Mayor does not sign this Resolution, it shall become effective at
the end of ten calendar days from the date it was passed and adopted.
If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.

BACKGROUND:
Ms. Dorothy Lee, President of the Miami/Bahamas Goombay Festival in Coconut
Grove, Inc., is requesting authorization to sell alcoholic beverages during the
Miami/Bahamas Goombay Festival to be held on June 3-4, 2000 in Coconut Grove.
Additionally, they are requesting the waiver of all permit fees, administrative fees and
rental fees related to the Festival.
The other two issues mentioned in their letter, authorization to close streets and the
restriction of retail peddlers, do not need City Commission approval since they can be
authorized by the City Manager under the City of Miami Code.
The administration will meet with the organizers of the Miami/Bahamas Goombay
Festival in Coconut Grove, to discuss City services and permits. At that meeting the
organizers of the festival will be advised that in order to sell tropical drinks they needed
to obtain City Commission approval, since the City Manager can only authorize the sale
of beer and wine.
The City traditionally has granted authorization to sell tropical drinks to the
Miami/Bahamas Goombay Festival as well as to other events such as the Coconut
Grove Arts Festival, the Taste of the Grove, the Coconut Grove Bed Race and the
Banyan Festival.

RECOMMENDATION:
The, administration recommends approval of the Miami/Bahamas Goombay
Festival's request to sell tropical drinks during the festival, subject to the
following:
• Paying .for the cost of all City services and applicable permits fees required by law.
• ` Obtaining insurance, including liquor liability, to protect the City of Miami in the
amount stipulated by City requirements.
• Instituting an identification program to assure that only those over the age of twenty=
one will buy alcoholic drinks:
As it relates to the waiver of. fees, the ,administration recommends denial due to
budgetary constraints. Approval of thin request may set a precedent for other
festivals. seeking financial, support from the City. In the past, the promoters have paid .
for all City services and fees.r,
