HomeMy WebLinkAboutR-00-0305J-00-323 4/4/00 RESOLUTION NO. 00— 305 A RESOLUTION OF THE MIAMI CITY COMMISSION, BY A FOUR FIFTHS (4/5T11) AFFIRMATIVE VOTE, AFTER A DULY ADVERTISED PUBLIC HEARING, WAIVING THE REQUIREMENTS FOR COMPETITIVE NEGOTIATIONS, AND RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING THAT IT IS ADVANTAGEOUS AND PRACTICABLE FOR THE CITY MANAGER TO NEGOTIATE A MANAGEMENT AGREEMENT WITH FLORENCE LITTHCUT INNER-CITY CHILDREN'S TOURING DANCE COMPANY, INC., A NON-PROFIT CORPORATION, FOR THE MANAGEMENT OF A PORTION OF HADLEY PARK FOR THE PURPOSE OF PROVIDING PUBLIC, CULTURAL, EDUCATION AND RECREATIONAL OPPORTUNITIES TO ALL SEGMENTS OF THE COMMUNITY, WITH AN INITIAL TERM OF SEVEN (7) YEARS. WHEREAS, Florene Litthcut Inner -City Children's Touring Dance Company, Inc. ("ICCTDC") teaches various artistic techniques to City of Miami residents, organized community groups, organized arts groups, and the general public since 1984; and WHEREAS, on July 16, 1996, the Miami -Dade County Commission enacted Ordinance No. 96-115, the Safe Neighborhood Parks Ordinance, which authorized issuance of general obligation bonds for the purpose of financing capital improvement programs for certain parks; and WHEREAS, the City of Miami has commenced construction of a new recreation building of approximately 21,000 square feet CITY COM USSION MEETING OF APR 9 3 2000 Resolution No. 0- 0� a/k/a Hadley Park Community Activity Center (the "Facility") using funds from the programs; and WHEREAS, upon completion of the new. Facility, the City's budgetary/ operational impact will be substantially diminished by entering into partnerships with nonprofit and for-profit organizations to operate park activities and share costs; and WHEREAS, ICCTDC desires to enter into a management agreement with the City of Miami for a portion of Hadley Park to provide public, cultural, educational and recreational opportunities to all segments of the community, for an initial term of seven years; and WHEREAS, the City Commission hereby determines that it is in the best interest of the City to enter into negotiations with ICCTDC for its management of a portion of the property; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Manager's finding that competitive negotiations would not be practicable or advantageous for the Page 2 of 4 G r ej 0 5 provision of professional services for the management of public, cultural, educational and recreational programs at the Hadley Park Community Activity Center, located at 1300 Northwest 50`h Street, Miami, Florida (the "Property"), is hereby ratified, approved and confirmed. Section 3. The City Manager is hereby authorized" to negotiate a Management Agreement, in a form acceptable to the City Attorney, with Florene Litthcut Inner -City Children's Touring Dance, Inc., a non-profit corporation, for the management of a portion of the Property for the purpose of providing public, cultural, educational and recreational opportunities to all segments of the community, for an initial term of seven (7) years. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor./ The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. zi If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. BACKGROUND: Florene Litthcut Inner -City. Children's Touring Dance Company, Inc. (" ICCTDC") has been teaching various artistic techniques to City of Miami residents, organized groups, organized community groups, organized arts groups, and the general public since 1984. The result of this ordinance and bond .program has allowed the City to begin construction of a new recreation building of approximately 21,000 square feet a/k/a Hadley Park Community Activity Center as a community recreation center for cultural, educational, and recreational programs. (City Seal) Ad #05007 Walter Foeman City Clerk 0- X05 c CI`Y OF MIAMI rLOR!OA INTER -OFFICE MEMORANDUM Honorable Mayor and DATE APR _ 4'2000 FILE Member f theCity Commission SueJECT Inner City Children's Touring Dance Company FROM: Do al Warshaw REFERENCES City Manager ENCLOSURES: On January 13, 2000 the City Commission adopted Ordinance No. 11878 which amended Chapter 18, Article III of the Code of the City of Miami to allow service related to cultural, educational, recreational or park activities provided by non-profit organizations within City parks to be awarded, without competitive negotiations, subject to a written finding by the City Manager, that competitive negotiations are not practical or advantageous. The Inner -City Children's Touring Dance Company, (ICCTDC) has successfully operated, as a non-profit organization, a variety of programs for twenty-seven years serving over 20,000 children. The programs provide cultural activities to enrich the soul and provide alternatives to the violence experienced in inner city; neighborhoods. Programs include the summer performance series, and helping participants increase self- esteem and discipline through the arts. ICCTDC also partners with the Miami -Dade County Public School Board to sponsor the Equal Footing Program, designed to give underserved children access to professional dance instruction, thereby significantly increasing their chances of acceptance into Dade County Public Schools Expressive Arts Magnet Programs. Prior to starting the ICCTDC, Florene Litthcut Nichols, was self-employed for eleven years as the Executive Director of the Community of Performing Arts (a for profit organization). She was also Director of Boston's Project Head Start; a social service organization. Currently, in addition to her duties as Executive Director of the ICCTDC, she is a volunteer board member for the Performing Arts Center Trust. In April, 1998, the City of Miami through the Parks and Recreation Department made applications to Miami -Dade County Office of Safe Neighborhood Parks. for grant monies (also known as "Challenge Grants") related to recreation building projects requiring a strong emphasis on serving the youth at risk population by partnering with non-profit organizations with experience in this field. One such application submitted by the City was for the design and construction of the Hadley Park Community Center, with ICCTDC as a partner. This application resulted in a Challenge Grant award of $690,300 for this facility. The City Commision later accepted the grant on November 17, 1998, by Resolution No. 98-1109. As a result, approximately $2.6 million is now available for this project with approximately $1.3 million originating from the Safe Neighborhood Parks Bond Program (SNPBP). The proposed Hadley Park Community Center is a 21,000 s.f. facility housing a black box theater/multi-purpose room which seats approximately 250 persons and is equipped with dressing rooms, control/sound, ticket booths and a concession space. The building also contains other multi-purpose areas, a community conference room and supporting office .spaces. Other spaces include a game room, fitness area and athletic equipment storage area and offices for outdoor sports groups. The City, of Miami .Parks system currently lacks_a facility., where cultural arts programs can be offered to. the community. Once completed, the.Hadley Park Community Center Will represent a state of the art facility where first class cultural programs and activities will be offered to our citizens. It should be noted that the Hadley Park. Homeowners Association', ."Who have been instrumental in making this project a reality, have endorsed the involvement of ICCTDC as the City's partner.in operating the cultural component of the proposed facility. As a condition to the receipt of the SNPBP monies, the City must proceed with ..development of this site in a timely manner, and the City must also provide evidence that the property will continue to be maintained following the completion of the improvements.. Since the City has a limited, means by which to support the continued operation and ,maintenance of a highly technical and sophisticated space for cultural activities in the Hadley Park Community Center, it is in the best interest of the City to procure the services of an outside organization willing to operate and maintain the cultural component of the new facility.. Therefore, based upon the foregoing, 1- find that the use of competitive negotiations for the management of the black box theater/multi-purpose room (which seats approximately 250 persons and is equipped with dressing rooms, ;control/sound ticket booths and a concession space } in the. new Hadley Park Community Center would not be practicable or advantageous and would recommend the City Commission authorize the .execution of a management agreement with ,the ICCTDC.
