A RESOLUTION OF THE MIAMI CITY COMMISSION RELATED TO THE EIGHTEENTH FAIR OF THE CUBAN MUNICIPALITIES IN EXILE ("FAIR"), CONDUCTED BY THE CUBAN MUNICIPALITIES FAIR CORPORATION ("ORGANIZERS"), SCHEDULED FOR APRIL 6 - 9, 2000, AT THE GROUNDS OF THE FLAGLER DOG TRACK; GRANTING THE REQUESTS OF THE ORGANIZERS TO (1) WAIVE, BY A FOUR-FIFTHS AFFIRMATIVE VOTE, THE LIMITATIONS CONTAINED IN SECTION 906.9 OF ORDINANCE NO. 11000, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, AS IT RELATES TO THE NUMBER OF TEMPORARY EVENTS PERMITTED PER SITE ON PRIVATE PROPERTY PER YEAR, AND (2) DECLARING AN EXEMPTION FROM THE PROHIBITIONS AND RESTRICTIONS CONTAINED IN SECTIONS 36-4(a) AND 36-5(a) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, AS THEY RELATE TO THE LEVEL AND HOURS OF NOISE CONCERNING SAID FAIR; CONDITIONING SAID GRANTS HEREIN UPON THE ORGANIZERS PAYING FOR ALL NECESSARY COSTS OF CITY SERVICES AND APPLICABLE FEES ASSOCIATED WITH THE FAIR AND OBTAINING INSURANCE TO PROTECT THE CITY IN THE AMOUNT AS PRESCRIBED BY THE CITY MANAGER OR DESIGNEE. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The requests of the Cuban Municipalities Fair Corporation, the organizers of the Eighteenth Fair of the Cuban Municipalities in Exile (the "Fair"), scheduled for CITY COMOSSION 14EETING OF MAR 2 3 2000 Resolution No. April 6 - 9, 2000, at the grounds of the Flagler Dog Track are hereby granted as follows: (1) the limitation contained in Section 906.9 of Ordinance No. 11000, the Zoning Ordinance of the City of Miami, Florida, as amended, are hereby waived, by a four-fifths affirmative vote, as it relates to the number of., temporary events permitted per site on private property per year, and the Fair shall not be counted as one of the two temporary special events permitted at said site, per year; and (2) an exemption from the prohibitions contained in Section 36-4(a) of the Code of the City of Miami, Florida ("Code"), as amended, as it relates to the level of noise originating from the Fair is hereby declared; and (3) an exemption from the restrictions contained in Section 36-5(a) of the Code as it relates to the hours of noise originating from the Fair is hereby declared between 11:00 P.M. and Midnight on April 7 and 8, 2000. Section 2. The herein grants are hereby conditioned upon the Cuban Municipalities Fair Corporation paying for all costs of City services and fees associated with the Fair and obtaining insurance to protect the City in the amount as prescribed by the City Manager or designee. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor Y �i If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. W. 37 Avenue at 7th Street, Miami. In order to proceed with the organization of the event, we need your approval for the use of such premises, and that this event not nted as one of the two allocated events per site per year, as specified in Resoluti 93-188 garding these types of activities. We aporte here y, are respectfully requesting from such approval so that our event, now on its Seventeenth anniversary, may turn into another succesful "FERIA" as it has been in the past. The schedule for the Eighteenth National Fair is as follows: Thursday April 6 from 6 p.m. to 11 p. m. ( Children day) Friday April 7 from 6 p.m. to 12 p. m. Saturday April 8 from 2 p.m. to 12 midnight Sunday April 9 from 2 p.m. to 11 p. m. We would also appreciate your cooperation in providing us with the necessary permit for the installation of 80-8'x 10'booths in the fairgrounds, including the approval of the Zoning Board for this purpose. Hernandez -Diaz, Executive Director of Cuban Municipalities Fair Corp, has requested a personal appearance before the City Commission on March 23rd, 2000. Mr. Hernandez -Diaz will request a waiver that the event will not count as one of the two allocated annual events for the site. As per the City of Miami Zoning Ordinance # 11000 Section 906.9 © only two events per site, per year can be approved in one site. RECOMMENDATION: The City Commission has traditionally authorized a Resolution waiving that this event does not count as one of the two allocated annual events for the site.
