A RESOLUTION OF THE MIAMI CITY COMMISSION BY
A FOUR FIFTHS (4/5THS ) AFFIRMATIVE VOTE, AFTER
A DULY ADVERTISED PUBLIC HEARING, RATIFYING,
APPROVING AND CONFIRMING THE CITY MANAGER'S
FINDING OF SOLE SOURCE, WAIVING THE
REQUIREMENTS FOR COMPETITIVE SEALED BIDS; AND
APPROVING THE ACQUISITION OF A WIRELESS
CELLULAR DIGITAL PACKET DATA SERVICE, FROM
AT&T WIRELESS SERVICES, THE SOLE SOURCE
PROVIDER, FOR THE DEPARTMENT OF INFORMATION
TECHNOLOGY, AT AN TOTAL ESTIMATED ANNUAL COST
NOT TO EXCEED $225,000, FOR THE INITIAL TERM
OF ONE (1) YEAR, WITH THE OPTION TO EXTEND
FOR THREE (3) ADDITIONAL ONE (1) YEAR TERMS,
AUTHORIZING A MAXIMUM OF A TEN PERCENT (10%)
ANNUAL INCREASE FOR EACH EXTENSION YEAR,.WITH
ANY INCREASE SUBJECT TO NEGOTIATION AND
APPROVAL; ALLOCATING FUNDS THEREFOR FROM THE
OPERATING BUDGETS OF VARIOUS USER
DEPARTMENTS, SUBJECT TO BUDGETARY APPROVAL
PRIOR TO USAGE.
WHEREAS, the Department of Information Technology requires
Circuit Data Packet Data ("CDPD"), a wireless data communications
service, that will allow field personnel to have access to all
City information from any location via a computer; and
WHEREAS, CDPD service would provide field personnel with an
immediate, as -needed connection to information required to
perform their jobs efficiently and effectively thereby, enhancing
their ability to service the needs of the community; and

WHEREAS, having this information readily available in the
field would increase the productivity of field personnel and
their responsiveness to the citizens
of Miami; and
WHEREAS, AT&T Wireless Services is the sole provider of the ✓�
Wireless IP Service Agreement for CDPD Service in the South
Florida area; and
WHEREAS, the Chief Procurement Officer has adopted a finding
that AT&T Wireless Services is the only vendor able to supply
the Wireless IP Service Agreement for CDPD. service in the South
Florida area; and
WHEREAS, the finding of the Chief Procurement Officer has
been approved and adopted as the finding of the City Manager; and.
WHEREAS, the City Manager and the .Director of the Department
of Information Technology recommend that the requirements for
competitive sealed bids be waived and the Wireless IP Service
Agreement for CDPD service from AT&T Wireless Services, the sole
source provider, be approved; and
WHEREAS, funds will be allocated from operating budgets of
various user departments, requiring budgetary approval prior to
usage;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:

Section 1. The recitals and .findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. By a four fifths (4/5th,) affirmative vote of
the members of the City Commission, after a duly advertised
public hearing, the City Manager's finding of sole source and
waiving the requirements for competitive sealed bids are hereby
ratified, approved, and confirmed and the acquisition of the
Wireless Cellular Digital Packet Data CDPD service from AT&T
Wireless Services, the sole source provider, for the Department
Information Technology, at a total estimated annual cost not to
exceed $225,000, for the initial term of one (1) year, with the
option to extend for three (3) additional one (1) year terms,
authorizing a maximum of ten percent (10%) for each extension
year should there be a cost . increase in the service, subject to
negotiation and approval; with funds therefor hereby allocated
from the operating budgets of various user departments, requiring
budgetary approval prior to usage.
Section 3. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.'/
�i If the Mayor does not sign this Resolution, it shall become effective at
the end of ten calendar days from the date it was passed and adopted.
If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by,the City Commission.

It is respectfully recommended that the City Commission adopt the attached Resolution ratifying, approving,
and confirming the City Manager's finding of sole source, waiving the requirements for competitive sealed
bids, and authorizing the procurement of a Wireless IP Service Agreement for Cellular Digital Packet Data
(CDPD) service from AT&T Wireless Services, located at 3223 Commerce Place, Suite 101, West Palm
Beach, Fla. 33407. The provision of these services will be on an as needed basis for various City
departments, for an estimated total annual cost not to exceed $225,000, for the initial term of one (1) year,
with the option to extend for three (3) additional one-year terms. Funds will be allocated from operating
budgets of various user departments and will require budgetary approval of funds from individual
departmental accounts prior to usage. A maximum of ten percent (10%) for the extension years will be
allowed should there be cost increases in this service; however, all increases are subject to negotiation with
the City for approval of any requested increases.
BACKGROUND
Cellular Digital Packet Data (CDPD) service is a wireless data communications service that allows field
personnel to maintain a constant, secure connection to all City information assets from any location within
the City via a computer (no wire or telephone connections are required). CDPD service provides field
personnel with an immediate, as -needed connection to information required to perform their jobs efficiently
and effectively (inspection schedules, permit status, account balances, ownership information, alarm/incident
information, hydrant information, etc.); thereby, enhancing their ability to service the needs of the
community. Having this information readily available in the field would increase the amount of time mobile
City personnel could spend in the field thus increasing their responsiveness to the citizens of Miami.
Building Inspectors, Certificate of Use Inspectors, Net Inspectors, Fire/Police officers and any other mobile
City worker could utilize this service. Moreover, the service can be implemented leveraging the sizeable
inventory of legacy applications currently in place on the City's mainframe. Furthermore, the technology
utilized is flexible enough that it can easily adapt to new client server/web applications as the City
implements new information systems at no additional cost to the communications infrastructure. The project
would consist of providing the communications infrastructure necessary to access the corporate network and
other resources via laptops (or other mobile devices). It is necessary to receive this service from AT&T
Wireless Services, as Cellular Digital Packet Data (CDPD) service is solely owned, marketed and provided
by AT&T WirelessServicesin the South Florida area.

This Department has verified with the Department of Budget that funds are available, in a first year

service. Funds will be allocated from operating budgets of various user departments and requiring the
budgetary approval of funds from individual department accounts prior to usage. A maximum of ten

Sole Source Finding for CDPD Services
An investigation as conducted by staff to determine whether AT&T Wireless Services, a non -minority / non -local
vendor, located at 223 Commerce Place, Suite 101, West Palm Beach, Fla. 33407, is the sole source provider in
the South F)seeki
rea for Cellular Digital Packet Data (CDPA) services. The Department of Information

According to the Department of Information Technology, it is seeking to obtain the Cellular Digital Packet Data
(CDPD) service, which allows field personnel to maintain a constant, secure connection to all City information
assets from any location within the City via a computer as no wire or telephone connections are required. The
CDPD services provides field personnel with an immediate, as -needed connection to information required to
perform their jobs efficiently and effectively, thereby enhancing their ability to service the needs of the community.
Building Inspectors, Certificate of Use Inspectors, NET Inspectors, Fire/Police officer and any other mobile City
worker could utilize this service. This service can only be received from AT&T Wireless Services, as Cellular
Digital Packet Data (CDPD) service is solely owned, marketed and provided by AT&T Wireless Services in the
South Florida area.
As part of the research, staff also contacted AT&T Wireless, who confirmed that while there are other providers in
the State of Florida, only AT&T Wireless provides this service in South Florida. Further research from the Internet
and contact with Mr. Marvin Williams, Contract Administrator with the State of Florida, Department of
Management Services, revealed the same results. BellSouth offers a different technical application in the South
Florida area, and GTE does not provide this type of service in South Florida. No other providers of this service
could be found.
Accordingly, I am recommending that the requirements for competitive bidding be waived, and these findings be
approved: AT&T Wireless Services is the sole source provider in the south Florida area for Cellular Digital Packet
Data (CDPD) services, in an amount not to exceed $225,000.00 for the initial one year term, with the option to
extend for three (3) additional one-year terms. Funds will be allocated from the operating budgets of various user
departments and will require budgetary approval of funds from individual department accounts prior to usage. A
maximum of ten percent (1 ) for each extension year will be allowed should the cost of service increase,
however, all increases are ect to negotiation with the City for approval.

The Information Technology Department requests that you approve a finding that AT&T Wireless Services,
located at 3223 Commerce Place, Suite 101, West Palm Beach, FL 33407, is the sole source provider in the
South Florida area for Cellular Digital Packet Data (CDPD) services.
Cellular Digital Packet Data (CDPD) service is a wireless data communications service that allows field
personnel to maintain a constant, secure connection (providing encryption over the radio link) to all City
information assets from any location -within the City via a computer (no wire or telephone connections are
required). CDPD service provides field personnel with an immediate, as -needed connection to information
required to perform their jobs efficiently and effectively (inspection schedules, permit status, account
balances, ownership information, alarm/incident information, hydrant information, etc.); thereby, enhancing
their ability to service the needs of the community. Having this information readily available in the field
would increase the amount of time mobile City personnel could spend in the field thus increasing their
responsiveness to the citizens of Miami. Building Inspectors, Certificate of Use Inspectors, Net Inspectors,
Fire/Police officers and any other mobile City worker could utilize this service. This service is completely
compatible with the City's existing communications network, ensuring that no additional expenditures
would be necessary to interface this service to existing City of Miami hardware and systems software.
Moreover, the service can be implemented leveraging the sizeable inventory of legacy applications currently
in place on the City's mainframe while at the same time being flexible enough that it can easily adapt to new
client server/web applications as the City implements new information systems at no additional cost to the
communications infrastructure. Additionally, the service is provided by AT&T Wireless Services at an
unlimited flat fee per unit with no roaming charges.
Please reference the attached memo from Marvin Williams, Contract Administrator for the State of Florida,
where it is stated "AT&T Wireless Services is the only vendor that can offer true CDPD services."

Title: Cellular Telephone Equipment and Service
The above referenced state contract's "balance -of -line" - states that CDPD (Circuit Data
Packet Data) services are available from AT&T Wireless Services.
Although AT&T Wireless Services offers CDPD services under their "balance -of- line",
actual pricing has to be procured from each AT&T Wireless Services office in each users
MSA (Metropolitan Statistical Area) under a separate contract for that specific user(s).
in speaking with Mr. John Starling with our Information Technology Program, AT&T
Wireless Services is the only vendor that can offer true CDPD services. GTE can
perform the same services, but with minute roaming charges on each call. BellSouth has
their on range of towers of a different technical application.
A revision will be made to AT&T's "balance -of -line" on the current State contract to
instruct users to contact their local AT&T office to obtain CDPD services and pricing for
their area. Additionally, the State contract has been amended to require any organization
obtaining CDPD services from AT&T Wireless Services to execute a serrate Wireless
IP Service Agreement for this service with AT&T Wireless Services. The separate
contract executed between AT&T and the user is not considered a part of the State
contract. Therefore, the State's General Conditions and Special Conditions do p_ apply.
