RESOLUTION NO. 00— i 9 o A RESOLUTION OF THE MIAMI CITY COMMISSION DENYING THE APPEAL AND AFFIRMING THE DECISION OF THE ZONING BOARD, THEREBY DENYING A VARIANCE FROM ORDINANCE NO. 11000, AS AMENDED, THE ZONING ORDINANCE OF THE CITY OF MIAMI, ARTICLE 4, SECTION 401, SCHEDULE OF DISTRICT REGULATIONS, TO ALLOW A REAR YARD SETBACK OF 6' (20' REQUIRED) FOR A SINGLE FAMILY RESIDENCE FOR THE PROPERTY LOCATED AT. APPROXIMATELY 31 NORTHWEST 65TH AVENUE, MIAMI, FLORIDA. WHEREAS, the Zoning Board at its meeting of January 10, 2000, Item No. 4, following an advertised public hearing, adopted Resolution No. ZB-2000-0266 wherein a motion to. approve the Variance failed by a vote of seven to one (7-1), thereby constituting a denial of the request for a Variance as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter finds that the stated grounds for the appeal and the facts presented in support thereof do not. justify reversing the decision of the Zoning Board on the denial of the Variance as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: CITY COMMISSION MEETING OF F F Q 17 2000 Resolution No. Section 1. The recitals and .findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The City Commission hereby denies the appeal and affirms the decision of the Zoning Board (Resolution No. ZB-2000-0266, adopted January 10, 2000), thereby denying a Variance, per Article 4.Section 401, to allow a rear yard setback of 6' (20' required) for a single family residence for the property located at approximately 31 Northwest 65th Avenue, Miami, Florida. ° Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor." 1� If the Mayor does not sign this Resolution, it,shall become effective at the end of ten calendar days from the date it was passed and adopted. CASE NO: 1999-0282 Pursuant to Section 401 of Ordinance 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, the subject proposal for Variance has been reviewed as follows: Variance for rear setback: Required - 20' 0" Proposed - 6' 0" The following findings have been made: • It is found that there is no hardship to justify the requested variance. The lot is over- sized, having an area of 7,688 Sq. Ft., where a standard lot in the R-1 Single Family Residential zoning district typically has only 5,000 Sq. Ft. • It is found that the additions, as constructed, are excessive and out of proportion with the existing residence and could accommodate more than the permitted one dwelling unit. • It is found that by developing the lot in the manner reflected on the plans submitted, the property owner has derived undue benefits under the Zoning Ordinance. • It is found that the existing additions for which a variance is sought and the other ex- isting additions, results in a overbuilt lot with an overall effect that makes the subject site appear crowded. Additionally, encroachment into the setbacks deprive the adja- cent property owners of their rightful visual separation. • It is found that the subject lot has been developed, to some extent, without the benefit of building permits thereby not leaving space for the subject addition; this is a self imposed hardship and should therefore not be considered a valid justification for any encroachment. Based on these findings, the Planning and Zoning Department is recommending de- nial of the application as presented.
