A RESOLUTION OF THE MIAMI CITY COMMISSION, BY A FOUR FIFTHS (4/5Tas) AFFIRMATIVE VOTE, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING OF AN EMERGENCY, WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDS AND APPROVING THE PURCHASE OF HARDWARE AND FASTENERS FOR STORAGE RACKS AND DOCKS AT THE MARINE STADIUM MARINA FROM FOLLANSBEE, DOCK SYSTEMS, IN THE AMOUNT OF $4,926.39, FOR THE DEPARTMENT OF CONFERENCES, CONVENTIONS AND PUBLIC FACILITIES; ALLOCATING FUNDS THEREFOR FROM THE MARINE STADIUM MARINA FY 99-00 OPERATING BUDGET ACCOUNT NO. 402003.350508.610. WHEREAS, the Department of Conferences, Conventions and Public Facilities initiated storage rack and .dock construction projects at the Miami Marine Stadium facility; and WHEREAS, severe deterioration of the existing vessel storage racks and floating docks caused hazardous conditions at the facility; and WHEREAS, the immediate procurement of hardware and fasteners for the storage racks and docks is essential to avoid the possibility of structural failure of the racks and docks at the Marina; and WHEREAS, the Department of Conferences, Conventions and Public. Facilities was able to locate only two providers of these products for the purpose of securing quotes; and CITY CobMSSION MEETING OF, FEB 17- 2000 Resolution No. 6.0- 17 LE C/ WHEREAS, Follansbee Dock Systems provided the lowest bid price; and WHEREAS, the City Manager made a written finding that an emergency existed and authorized the purchase of the hardware and fasteners from Follansbee Dock Systems; and WHEREAS, funds are available from Marine Stadium Marina FY 99-00 Operating Budget Account No. 402003.350508.610. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. By a four fifths (4/5t'75) affirmative vote of the members of the City Commission, the City Manager's finding of an emergency, waiving the requirements for competitive sealed bids, and approving the purchase of hardware and fasteners for storage racks and docks at the Marine Stadium Marina from Follansbee Dock Systems, in the amount of $4,926.39, is hereby ratified, approved and confirmed, with funds therefor hereby allocated from Marine Stadium Marina FY 99-00 Operating Budget Account No. 402003.350508.610. - 174 Page 2 of 4 Section 3. Warshaw City Manager DATE: rr, FILE SUBJECT: Resolution Approving Emergency Purchase of Storage Rack and Dock Hardware and Fasteners at Marine REFERENCES: Stadium Manna ENCLOSURES: RECOMMENDATION It is respectfully recommended that the City Commission adopt the attached Resolution approving the emergency purchase of storage rack and dock hardware and fasteners from the lowest bidder, Follansbee Dock Systems, for the Marine Stadium Marina. Funds are available in the amount of $4,926.39 from the Marine Stadium Marina FY99-2000 operating budget account No. 402003.350508.610. BACKGROUND The Department of Conferences, Conventions and Public Facilities has initiated dock construction projects at the Marine Stadium Marina to alleviate unsafe conditions caused by the severe deterioration of the vessel storage racks. The immediate procurement of these fasteners and hardware is essential to complete the project, to avoid any possible structural failure of the existing vessel storage racks, and to ensure the safety of the marina customers and the general public. Abrams, Director !\� Ff"C)M Conferences, Conventions, &Public Facilities This memorandum serves to request your approval to purchase on an emergency basis storage rack / dock hardware and fasteners for Marine Stadium Marina. The total cost of this purchase is $4,926.39. There is an immediate need to replace the existing storage racks / timbers to ensure the safety and welfare of the public and the vessels entrusted into the City's care. The existing metal racks and wooden timbers are more than fifteen years old and have deteriorated to an unsafe condition. The City Commission approved C.I.P. Project No. 326008 to replace the Dry Storage Racks at Marine Stadium Marina. Work is slated to begin on or about September 14, 1999, and the project is scheduled to be completed in three weeks time. The hardware and fasteners requested in this memorandum are a critical component of the rack construction project. A provision of our contract with the contractor requires the City provide the hardware and fasteners for the project, and have them on site when construction begins. This Department solicited bids for marine hardware and fasteners from two national manufacturers of these specialty products, who provided the quotes listed below (and attached to this memorandum): 1. Follansbee Dock Systems. $4,926.39 2. Merco Marine $6,511.38 The lowest responsive and responsible bidder, Follansbee Dock Systems, is a non -local, non - minority vendor.
