CONTAINERS FROM REHRIG PACIFIC COMPANY,
AWARDED UNDER EXISTING WEST PALM BEACH COUNTY
CONTRACT NO. SWA 97-16/TR, EFFECTIVE UNTIL
JULY 2, 2000, SUBJECT TO FURTHER EXTENSION BY
WEST PALM BEACH COUNTY, FOR THE DEPARTMENT OF
SOLID WASTE, IN AN AMOUNT NOT TO EXCEED
$11,700; ALLOCATING FUNDS THEREFOR FROM
ACCOUNT CODE NO. 422001.320302.6.850.
WHEREAS, the Department of Solid Waste provides containers
for disposal and containment of recycling material for
residential collection; and
WHEREAS, a need exists for the purchase of 2,500 18 -gallon
recycling containers for Fiscal Year 2000; and
WHEREAS, the City Manager and the Director of the Solid
Waste Department recommend that the procurement of the containers
from Rehrig Pacific Company, awarded under existing West Palm
Beach County Contract No. SWA 97-16/TR, be approved; and
WHEREAS, funds are available from the Department of Solid
Waste Account Code No. 422001.320302.6.850;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The procurement of 2,500 eighteen 18 -gallon
recycling containers for fiscal year 2000, from Rehrig Pacific
Company, awarded under existing West Palm Beach County Contract
No. SWA 97-16/TR, effective until July 2, 2000, subject to
further extensions from West Palm Beach County, for the
Department of Solid Waste, is hereby approved, at a total cost
not to exceed $11,700; with funds therefor hereby allocated from
Account Code No. 422001.320302.6.850.
Section 3. This Resolution shall become effective
immediately upon adoption and signature of'the Mayor.'/
�i If the Mayor does not sign this Resolution, it shall become effective at
the end of the ten calendar days from the date it was passed and
adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.

RECOMMENDATION:
It is respectfully recommended that the City Commission approve
the attached resolution, authorizing the City Manager to approve
the procurement of 2,500 (18 gallon) recycling containers under
an existing West Palm Beach Solid Waste Authority Contract Bid
#SWA 97-16/TR from Rehrig Pacific Company, in an amount not to
exceed $11,700.00. This bid is in effect through July 2, 2000.
Funding is available from Account Code No. 422001.320302.6.850.
BACKGROUND:
The Department of Solid Waste is in need of purchasing additional
(18 gallon) recycling containers. The department has and will
continue to provide quality service to the City's residential
recycling program through its regular collection efforts and
efficient service. Due to.population growth and the inclusion of
multi -family units within our service core, there is a need for
additional containers to ensure a sufficient number of containers
for proper containment.

A purchase order or blanket purchase order will be issued to the awarded bidder with the, -
understanding that all items delivered must meet the specifications herein. Items delivered not as
specified will be picked up by the Bidder at no expense to the Authority. Replacement items
meeting specifications shall be submitted within a reasonable time of rejection• of 'the non-
conforming items.
At the option of the Authority, item(s) from any delivery may be submitted to an independent
testing laboratory to determine conformity to respective specifications. Bidders shall assume full
responsibility for payment of any and all charges for testing and analysis of any product offered or
delivered that does not conform to the minimum required specifications,

34 EATENSION
The successful bidder shall be awarded a contract to supply the goods/services for twelve 12
rnonths with options to renew the contract for two (2) additional twelve (1_2) month periods.
Options for renewal will only be exercised upon mutual written agreement and with all original
terms, discountg, condition and MRA YyS.q.c adhered to with no deviations, except as allowed in the

35 ESCALATION CLAUSE
The Solid Waste Authority acknowledges the fluctuating nature of prices for items specified.
Accordingly an escalator/de-escalator clause will be accepted only under the following conditions:
I Price increase(s) and price decrease(s) comparable to documented manufacturer's
price changes or changes in industry -related indices.
2 Receipt of proper notification, to Purchasing, Twenty-one (21) days prior to the

Bidders must furnish all information requested and in the space provided on the bid form, if airy.
Further, each bidder offering an alternate other than the brand(s) specified must submit with his
proposal, descriptive literature and/or complete specifications covering the products offered.
Reference to literature submitted with a previous bid will not satisfy this provision. Bids which do
not comply with these requirements shall be subject to rejection.

39 PURCHASIN-G-AGREEMENTS WITH OTHER GOVERNMENT AGENCIES
All Bidders submitting a response to this Invitation to Bid agree that such response also constitutes
a bid to all political subdivisions under the same conditions, for the same prices and the same
effective period' as this bid, should the Biddcr feel it is in their best interest to do so.
This agreement in no way restricts or interferes with the right of any political subdivision to rebid
any or all items.
40 QUANTITY, ESTIMATED
The quantities shown are estimated. The Authority reserves the right to increase or decrease the
total quantities as necessary to meet actual requirements. We anticipate Purchasing 15,000 to
18,000 units during the initial contract period from 7/16/97 Thru 7/15/98. Award will be based on
the maximum estimated quantity.
41 WARRANTY FOR SPECIFIED PERIOD
The successful Bidder shall fully warranty all containers furnished hereunder against defect in
materials and/or workmanship for a period of five (5) years from date of delivery and acceptance by
the Authority. Should any defect in materials or workmanship, excepting ordinary wear and tear,
appear during the above stated warranty period, the successful bidder shall repair or replace same at
no cost to the Authority, immediately upon written notice from th:. Assistant Director of Purchasing
Services or his designee.
42 MEASUREMENTS
Customary measurements appearing in these specifications are not intended to preclude bid for
commodities with metric measurements. If bids are based on equivalent products, indicate on the
bid, cuts, sketches, and descriptive literature and/or complete specifications. Reference to literature
submitted with a previous bid will not satisfy this provision, The Authority reserves the right to
determine acceptance of items(s) as an approved equivalent. Bids which do not comply with the

for inspection and written approval within 2 weeks of receipt of a purchase order.

The purpose and intent of this Invitation to Bid is to obtain a firm price for the purchase of new
unused Recycling Containers with a minimum post consumer recycled material content of
50%.
Any additions, deletions, or variations from the foltowing specifications must be noted These
