A RESOLUTION OF THE MIAMI CITY COMMISSION URGING THE FEDERAL GOVERNMENT TO EXTEND THE DEADLINE FOR A PERIOD OF SIX MONTHS FOR THOSE INDIVIDUALS ELIGIBLE TO FILE APPLICATIONS AND MOTIONS TO GAIN LAWFUL IMMIGRATION STATUS UNDER THE NICARAGUAN AND CENTRAL AMERICAN RELIEF ACT ("NACARA"); FURTHER URGING THE FEDERAL GOVERNMENT TO ADOPT AND IMPLEMENT LEGISLATION TO EXTEND THE SAME RIGHTS AND PRIVILEGES GRANTED UNDER NACARA TO HAITIAN IMMIGRANTS; AND DIRECTING THE CITY CLERK TO TRANSMIT A COPY OF THIS RESOLUTION TO THE OFFICIALS DESIGNATED HEREIN. WHEREAS, in 1997, the Senate and House of Representatives of the United States enacted legislation, known as the Nicaraguan and Central American Relief Act ("NACARA"), to provide nationals from Nicaragua and certain Central American countries relief from removal and deportation from the United States; and WHEREAS, the deadline to submit and complete NACARA applications with supporting documents and motions expired November, 1999; and WHEREAS, the City Commission wishes that the same privileges and rights bestowed to Nicaraguan and Central American nationals be extended to Haitian immigrants; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: CITY COMMSSION, NEETI21G OF JAN 2 7 2000 Resolution No. o U- 00 Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The Federal Government is hereby urged to extend the deadline for a period of six months for those individuals eligible to file, applications and motions to gain lawful immigration status under the Nicaraguan and Central American Relief Act ("NACARA"). Section 3. The Federal Government is hereby further urged to enact and implement legislation to extend the same rights and privileges granted under NACARA to Haitian immigrants. Section 4. The City Clerk is hereby directed to transmit a copy of this Resolution to President William J. Clinton, Vice -President Albert Gore, Jr., Speaker of the House of Representatives J. Dennis Hastert, Attorney General Janet Reno, United States Immigration and Naturalization Service Commissioner Doris Meissner, Senators Connie Mack and Bob Graham, and all the members of the United States House of Representatives for Miami - Dade County. Foeman City Clerk City of Miami 3500 Pan American Drive Miami, FL 33233 Dear Mr. Foeman: APR 21 2000 This is in response to your February 25 memorandum to the President, and others, attaching a copy of Resolution 00-100, passed and adopted by the City of Miami Commission. That resolution urges the Federal Government to enact legislation for Haitians similar to the rights and privileges extended to Nicaraguans and Cubans under the Nicaraguan Adjustment and Central American Relief Act (NACARA), and to extend the NACARA application deadline from November 1999 for a period of 6 months. Your letter was referred to the Immigration and Naturalization Service (INS) for response. On October 21, 1998, section 902 of the Haitian Refugee Immigration Fairness Act of 1998 (HRIFA) was signed into law providing relief in the form of adjustment of status to that of lawful permanent resident to eligible Haitian nationals. Although the application periods for both NACARA and HRIFA ended on March 31, 2000, you may be aware that legislation has been introduced in Congress to provide applicants an additional 6 months to file for permanent residence and related benefits under those respective programs. If Congress passes this proposed legislation and it is signed into law, the INS would be prepared to implement it efficiently and fairly. Because of the interest in the legislation expressed by the Administration and Members of Congress, the INS will defer removal of those persons who appear eligible for permanent residence under NACARA or HRIFA while Congress deliberates the proposed application period extension during its current session. If you wish to obtain additional information regarding HRIFA and NACARA benefits, you may wish to visit the INS website at the folfowing address: www.ins.usdoj.gov. Information is available at that website in the form of press releases, frequently asked questions and answers, and links to laws and regulations applicable to HRIFA and NACARA benefits.
