Please be advised that the processing of your tentative plat cannot proceed until these conditions have been satisfied: 1. A twelve (12) inch water main extension is required along NW 61 Street. Contact Rafael Ballesteros, Miami -Dade Water and Sewer Department, at 305- 665-7477. 2. One fire hydrant required. Contact Lt. The Plat and Street Committee in reviewing the request to close the 10 -foot wide utility easement lying along the rear side of Lots 12, 13, 14, 15, 16, 17, 18, 19, 20 and 21, of Block 2 of BAYAMI PARK, recorded in Plat Book 13 at Page 68, has considered the public interest requirements as found in Chapter 55 of the Miami City Code. State and local laws require the installation of various physical improvements in the public rights-of-way when property is platted. These subdivision improvements include paving, drainage, landscaping, sidewalks, etc. In some cases this could represent a substantial investment on your part. 2. The alteration, relocation or installation of utilities such as storm and sanitary sewers, electric, telephone, water, etc., caused by this plat will be at the property owner's expense. It is in correct form for submission to the City Commission and is forwarded with a recommendation that it be approved. PERTINENT INFORMATION REGARDING THE PLAT: 1. ARTICLE V - MEMBERSHIP** Section 1: Oualifications This Church shall welcome into its membership any person who loves and accepts Jesus Christ as Lord and who promises to live according to His law of love, recognizing all people as brothers and sisters for whom He gave His life. Section 2: Conditions** The membership of this Church shall consist of those who present letters of transfer from other churches; or confess or reaffirm their Christian Faith; and have been accepted by the Diaconate in behalf of the Congregation. Memh whip may include both regular and associate members. 1. A Regular Member is one who has qualified for membership in the Church and recognizes this Church as his/her primary church affiliation. ..2. An Associate Member is one with church membership in good standing elsewhere who desires to become a member of this Church without withdrawing from the church to which he/she already belongs. An Associate Member may not hold elective office. Section 3: Reception All persons desiring to become members of this Church shall attend orientation sessions conducted by the Pastor and/or representatives from the Diaconate prior to presenting themselves for reception by the membership. Section 4: Responsibilities Members are expected to be faithful to all responsibilities essential to the Christian life; to attend regularly the services of the Church; to give systematically for its support and its benevolence; to share in its organized work; and to seek diligently the spiritual welfare of the Church and the winning of others to Christ. Section 5: Rights Members in good standing may act in all transactions of who have reached age eighteen (18) the Church. C,0- 86 2 01 Section 6: Termination of Membership** 02 Upon the recommendation of the Diaconate, membership may be 03 terminated: 04 1. By letter of withdrawal 05 A member in good standing may on request: 06 a. Be granted a letter of transfer to any Christian Church, but the 07 particular local church shall be named in the letter of transfer, 08 and a general letter without such specifications shall not be 09 granted; 10 b. Be given a certificate of church membership and his/her name 11 removed from the roll if he/she wishes to join a body not in 12 fellowship with this Church; or 13 c. Be released from membership if, after due conference and 14 deliberation, he/she is insistent in his/her request for such 15 release. 16 17 2. By Retirement** 18 Members whose addresses have long been unknown or who for 19 a period of two years, in spite of kindly reminders such as 20 telephone calls, home visits, letters, counseling, or any other 21 documented communicative techniques or efforts, have not 22 demonstrated their intention to remain in active membership status, 23 may by vote of the Church be transferred to the Inactive or Retired 24 List. 25 26 From the date of such transfer, such persons shall cease to 27 be reported on the active membership roll. If after the expiration 28 of a year, their addresses are still unknown or they are unwilling 29 to renew their active connection with the Church, their names shall 30 be dropped from the roll by a further vote of the Church. 31 32 2. By Exclusion 33 Should a member become an offense to the Church and 34 continuously disregard his/her covenant responsibilities, the 35 Church may terminate his/her membership. However, no member shall 36 be terminated by exclusion at the meeting at which the motion for 37 exclusion is made. Only after due notice and hearing and after 38 faithful efforts have been made to bring such member to repentance 39 and amendment shall a membership be terminated. 40 41 Any person whose membership is terminated may, for good and 42 sufficient reasons, be restored to membership by vote of the Church 43 upon recommendation of the Diaconate. (Matthew 18: 15-17) 44 45 ARTICLE VI - SERVICES AND MEETINGS 46 47 Section 1: Worship 48 The forms and rituals used in connection with the worship 49 services of this Church shall be in keeping with those in general 50 use by the churches of our faith and order. 51' 52 Section 2: Business 53 The Annual Meeting shall be held on the third Wednesday of 54 January to transact the business of the Church and to adopt plans 55 for the new year. The call for the meeting must be published two 56 weeks prior to said meeting. B e Pastor; b. By the Clerk on request of the Council; c. By any ten members in good standing on written request to the Council, pending the Council's approval of the validity of the issue. Notice of special meetings shall be announced at least two weeks prior to such meeting. Section 4: Quorum Twenty percent of the resident membership shall constitute a quorum at any business meeting of the Church. Section 5: Maiority Vote A majority vote of the members present at any meeting shall be decisive of all questions except the calling or retiring of a Pastor, which shall require an affirmative vote of two-thirds of the membership of the Church. ARTICLE VII - OFFICES** The officers of the Church shall be the following: Section 1: Pastor** The Pastor, unless specifically stated and otherwise mutually agreed, shall be called for an indefinite time by a two-thirds vote of the membership of the Church. When a vacancy occurs in the pastorate, the Church Council shall appoint a pastoral search committee which, after seeking the guidance of the Divine Spirit, shall, with the cooperation of the executive head of the State Conference and the Constitution and By- laws of the United Church of Christ, make a canvass of'available ministers, settle on the one who. in its judgment shall be called to the pastorate, introduce him/her to the Church, and at a duly called meeting propose his/her election. The Pastor shall be responsible for the spiritual welfare and development of the Church with the assistance of the Diaconate Board. He/She shall seek to enlist people as followers of Christ, preach the gospel, administer the activities of the Church in cooperation with the various boards and committees. He/She shall be an advisory member ex officio of all boards and committees. The relationship may be terminated by either party at any time by a two-thirds vote of the membership of the Church at a meeting called for this purpose. Whether termination is requested by the Church or by the Pastor, sixty days notice must be given. Section 2: Associate Pastor** At its discretion, the Church may employ an ordained associate pastor. As soon as an associate pastoral vacancy occurs, the Senior Pastor, in close consultation with the Diaconate, shall recommend and present to the Church, with the endorsement of the Church Council, the name of a candidate to fill the vacancy. The associate pastor will be a full-time member of the pastoral staff. He/She will work cooperatively with the Pastor in providing Christian leadership in the mission and life of the Church. The associate pastor will be responsible for planning, organizing and implementing comprehensive programs for youth and young adult ministries, Christian social action and Evangelism and Christian education. 4 00- 86 O,i 02 03 04 05 06 07 08 09 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 48 49 50 51 52 53 54 55 56 57 58 59 60 Section 3: Church -Moderator The Church Moderator shall preside at all official meetings of the Church and serve as.chairperson of the Church Council. He/She shall be elected at the Annual Meeting for a term of three years. He/She may succeed himself/herself for another term. However, after serving two consecutive full terms, he/she shall for one year be ineligible for re-election to this office. Section 4: Superintendent of the Church School The Superintendent of the Church School shall be nominated by the Board of Christian Education and elected at the Annual Meeting to serve for one year. His/Her duties shall be prescribed by the Board of Christian Education. He/She shall be a member of the Church Council. Section 5: Clerk The Clerk shall keep a faithful record of the proceedings of the Church Council. With the assistance of the Pastor's secretary, he/she shall keep a register with the addresses of the members of the Church, with dates and modes of their reception and removal. He/She shall -also keep a record of baptisms and marriages. He/She shall issue letters of transfer; preserve on file all communications and written reports; notify all persons elected to offices and committees, give legal notices of all meetings when such notices are necessary; conduct all correspondence so far as this is not otherwise provided for, and perform such other duties as are prescribed by law.or as usually pertain to the office of a clerk or secretary of an assembly. Section 6: Treasurer The Treasurer shall be the chief fiscal and banking officer of the Church. He/She shall receive all monies of the Church and deposit same as the Trustee Board shall order and shall make all disbursements authorized by the Board. He/She shall keep an accurate account of all funds (regular and special) and report the same to the Trustee Board monthly and to the congregation annually. He/She shall have the books audited annually and perform such other duties as may be authorized by the Board. A copy of the audit shall be made available to the Congregation at the annual meeting. He/She shall be -a member of the Church Council and of any fund- raising activity and a member ex officio of the Trustee Board. Section 7: Assistant Treasurer The Assistant Treasurer shall perform such duties as are designated for him/her by the Treasurer and shall assume all responsibilities of the Treasurer in the Treasurer's absence. He/She shall be a member of the Trustee Board. Section 8: Historian At the Annual Meeting a Historian shall be elected for one year, who shall keep a journal of all significant occurrences in the life of the Church. Section 11: Vacancies Should a vacancy occur in any elected office, the Church Council shall select an eligible church member to serve until the succeeding Annual Meeting, except in the case of the financial officers, where the responsibility of replacement shall rest with the Trustee Board. ARTICLE VIII - THE OFFICIAL BOARDS" There shall be a Diaconate Board,'a Trustee Board, a Board of Christian Education, and a Stewardship Board.. They shall be composed of Church members elected at the Annual Meeting, for a term of three years. They shall be elected in such manner that approximately an equal number of terms expire each year. After serving two consecutive terms, a board member shall for one year be ineligible for re-election to the same board. Increase in the active membership of the boards shall be on the basis of an additional board member for every fifty new members added to the church roll. Within one week following the Annual Meeting, each board shall meetand choose such officers and committees as it deems necessary. Each board shall at this time appoint one representative to serve with its chairperson on the Church Council, with the exception of the Board of Christian Education, which shall be represented by its chairperson and the Church School Superintendent. Each board shall elect an alternate who will represent the board in the absence of the chairperson or the designated representative. A majority of the voting members of any board shall be required to constitute a quorum. Each board shall meet regularly at times of its own choosing, or on the call of the chairperson. Special meetings shall be held at the request of at least one-third of the membership of any board. The purpose of the meeting shall be stated in the call, which shall be presented in writing over their signatures to all other members not less than five days in advance of the proposed meeting date. In case a vacancy occurs in any board, the remaining members of the board may appoint to his/her place any church member, subject to the approval of the Church Council. Such replacements shall be only until the succeeding Annual Meeting of the Church. Each Board and committee shall include in its membership young adults under age forty (40). It shall be the duty of each board member to participate faithfully and regularly in the activities of the board and in services of public worship. 01 1. The Diaconate Board 02 The Diaconate Board shall consist of Twenty-four (24) 03 active members (twelve men and twelve women) who shall serve for at 04 least. one term of three years. The Board shall receive applications for church 14 membership on confession of faith, reaffirmation of faith or by 15 letter of transfer. Members of the Board shall introduce new 16 families into the life of the Church and visit resident members. 17 They shall make an annual survey of the Church roll and at the 18 Annual Meeting submit recommendations to the Church regarding 19 necessary revision. They shall provide for the supply of the 20 pulpit in case of vacancy or absence of the Pastor. 21 22 2. The Board of Christian Education 23 The Board of Christian Education shall consist of the 24 Pastor, Superintendent of the Church School, Church School Staff 25 and a minimum of three elected members. The Board shall have 26 supervision and direction of the educational work of the Church. 27 It is authorized to nominate a superintendent of the Church School 28 and have charge of the Church School, with full power to appoint 29 teachers and officers not otherwise provided for; also to 30 inaugurate and maintain other religious, social and educational 31 activities. The Board shall determine the appropriation of funds 32 contributed by the Church School. 33 34 3. The Trustee Board** 35 The Trustee Board shall consist of twelve (12) active 36 members. The Stewardship Board There shall be a Stewardship Board consisting of nine or more members, to serve on a rotating basis, one-third of whom shall be elected at each Annual Meeting. This Board shall have these responsibilities: a. To conduct a continuous program of stewardship education; b. To initiate and conduct the Christian Enlistment Campaign; and c. To review and recommend contributions over which the Trustee Board exercises control. ARTICLE IX - THE CHURCH COUNCIL** The Church Council shall consist of the following: . the Moderator, acting as Chairperson; the Pastor; the Assistant Pastor; officers elected by the Church including the Clerk; the Superintendent of the Church School; the Treasurer; the Assistant Treasurer; the Historian (as well as any other officers elected as needed); the chairperson and a designated representative of each official Board, (Diaconate Board, Board of Christian Education, Trustee Board, and Stewardship Board); two representatives of each standing committee and all other organized bodies of the Church; and two members from the Church at large, elected at the Annual meeting. Each organized body shall elect an alternate who will represent that body..in the absence of the chairperson or designated representative. The Council shall meet monthly. It shall elect a vice - moderator and appoint such other officers and committees as it deems necessary. Special meetings may be called by the Moderator or as follows: Upon written request, signed by any five members of the Church, and subject to review by the executive committee of the Council, the Clerk shall call a meeting, notifying all Council members at least five days in advance of the proposed meeting, stating its purpose and the names of its callers. The executive committee shall consist of the Moderator, the Vice Moderator, the Pastor, the Assistant Pastor, and those officers elected by the Church. A quorum for any regular or special meeting of the Council shall consist of one-third of its members. It shall be the function of the Church Council to coordinate the calendar and general program of the Church. To this end the Council shall conduct annually a leadership workshop involving newly elected chairpersons of boards and organizations for the primary purpose of acquainting them with their duties and responsibilities as stipulated in these By -Laws. The Council may act for the Church in minor matters, always assuming that unless such action is taken with practical unanimity, it must have the confirmation of the Church. The Council shall submit to the Annual Meeting a comprehensive program involving the chief objectives of the Church for the coming year. All officers, boards, committees and other organized bodies shall present their plans and programs to the Church Council for its information. At the end of each calendar year, the Council shall conduct a Church program review and evaluation. The Nominating Committee shall prepare a ballot, nominating one person, who has given his/her written consent, for each office to be filled at the Annual Meeting. Such ballots shall be available at the Church not later than two Sundays prior to the Annual Meeting. The ballot thus prepared shall be the official ballot at the Annual Meeting. The right of a member to make..a nomination from the floor shall always be recognized. Section 2: Standing Committees** The Church Council shall appoint a music committee, a personnel committee, an usher's committee, a publicity committee, and a Pastoral Relations committee to operate in the fields indicated. Section 3: Other Committees Other committees may be appointed by the Church or the Church Council as needed. ARTICLE XI - FINANCES** Section 1: Offerings The Church shall seek support by contributions of individuals and organizations. Opportunity shall be offered to all members of the Church to underwrite the budget. Major fund-raising projects shall be under plans approved by vote of the Church. Auxiliary organizations are invited to contribute under plans of their own choosing. Section 2: Permanent Funds All legacies not specifically designated by the donors shall be set aside in a special fund. To this fund shall be added any special contributions and gifts. The corpus of the fund shall generally be used for objects other than the routine expenses of the Church. The Trustee Board shall have authority to draw on the corpus of this special fund to stabilize the treasury. ARTICLE XII** The Corporation shall have perpetual existence. In the event of dissolution, the assets of the corporation shall be disposed of in accordance with the Florida Statute governing non-profit corporations.
