A RESOLUTION OF THE MIAMI CITY COMMISSION
RESCINDING RESOLUTION NO. 99-889 WHICH
AUTHORIZED THE CITY MANAGER TO EXECUTE A
PROFESSIONAL SERVICES AGREEMENT WITH MATZ,
TRAKTMAN, FELDMAN & WILDNER COURT REPORTERS
TO PROVIDE COURT REPORTING SERVICES TO THE
OFFICE OF THE CITY CLERK FOR FISCAL YEAR
1999-2000, IN AN AMOUNT NOT TO EXCEED
$27,360; FURTHER REINSTATING SAID FUNDS INTO
ACCOUNT CODE 022301.220106-270.
WHEREAS, Resolution No. 99-889, adopted November 16, 1999,
authorized the execution of a Professional Services Agreement
with Matz, Traktman, Feldman & Wildnerr Court Reporters, at a
total cost of $27,360 for the provision of court reporting
services for the Office of the City Clerk; and
WHEREAS, at the time of inquiry of cost to provide said
services, the Office of the City Clerk was unaware of certain
additional costs; and
WHEREAS, in order to meet the special needs. of the Office of
the City Clerk, the additional costs would double the cost of the
amount of said services; and

WHEREAS, because this Agreement is not advantageous to the
needs of the Office of the City Clerk, it was determined that is
was in the City's best interest to rescind Resolution No. 99-889;
and
WHEREAS, funds shall. be reinstated into Account Code
No.022301.220106-270; and
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. Resolution No. 99-889, adopted
November 16, 1999, authorizing the City Manager to execute a
Professional Services Agreement with Matz, Traktman, Feldman &
Wildner Court Reporters, to provide court reporting services to.
the Office of the City Clerk for Fiscal Year 1999-2000, in an
amount not to exceed $27,360, is hereby rescinded; with funds
therefor hereby reinstated into Account Code
No. -022301.220106-270.

Section 3. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.'/

It is respectfully recommended that the City Commission adopt the attached Resolution rescinding
the award for court reporting services to the firm of Matz, Traktman, Feldman & Wildner Court
Reporters in the amount of $27,360 and reinstate said funds to Account Code 022301.220106-270.
BACKGROUND
On November 16, 1999 the City Commission passed Resolution No. 99-889, which authorized the
City Manager to execute a professional services agreement, in an amount not to exceed $27,360,
with Matz, Traktman, Feldman & Wildner Court Reporters for the provision of court reporter
services to the Office of the City Clerk. At the time our office inquired about the cost to provide
said services, we were not aware of certain additional costs (i.e., industry standard of double
spacing transcripts) which would double the cost to provide said services in order to meet our
office special needs.
As a result of a meeting which occurred on Wednesday, November 24`x, we are informed of new
additional information to provide services to the Clerk's Office. Subsequent to said meeting, it
was determined that the firm of Matz, Traktman, Feldman & Wildner Court Reporters was not
giving the City the most advantageous proposal.

ENCLOSURES:
Pursuant to your instructions, Joyce Jones- and I attended a meeting with Mr. Gerald Traktman of
Matz, Traktman, Feldman & Wildner Court Reporters on Wednesday, November 24, 1999. Ms.
Jones and I explained to Mr. Traktman the format of the minutes of the meetings of the City
Commission. Mr. Traktman explained to us that the fees he had previously quoted would have to
be increased as follows:
1. Each page would cost $15 instead of $8 because his transcriptions are always done double
spaced and we require single spacing.
2. If a reporter had to work after 5:30 p.m., there would be an additional fee of $40 for each
hour past said time (in addition to the $255 fee per session).
3. In the event a portion of the meeting was requested to be expedited, there would be an
additional fee for said portion, based on a per page fee.

ACCEPTABLE TO THE CITY ATTORNEY, WITH MATZ
TRAKTMAN, TO PROVIDE COURT REPORTING SERVICES
TO THE OFFICE OF THE CITY CLERK FOR FISCAL
YEAR 1999/2000, IN AN AMOUNT NOT TO EXCEED
$27,360; ALLOCATING FUNDS THEREFOR FROM
ACCOUNT CODE 022301.220106-270;
WHEREAS, the Office of the City Clerk has a need to enter
into a Professional Services Agreement with a court reporting
service to timely produce verbatim transcription of City
Commission proceedings; and
WHEREAS, the City Clerk does not have available staff
resources for the numerous meetings, i.e., Regular, Special,.
Planning and Zoning, and Commission workshops, during the fiscal
year; and
WHEREAS, the Office of the City Clerk, in conjunction with
the City's Purchasing Department, analyzed comparative costs,
including, but not limited to, the Miami -Dade County Bid
No. 0628-2/02/OTR-SW} for court reporting services; and
WHEREAS, although Official Court Reporting is the vendor for
Miami -Dade County, Matz Traktman was found to be both
competitively advantageous and cost efficient by providing said

services at a-2.7 percent ($799.99) savings to the-City; and
WHEREAS, based on .the cost savings, it is recommended that
the Miami City Commission authorize the.City Manager'to execute a
Professional Services Agreement, ..with Matz Traktman for court
reporting services for one year;
NOW, THEREFORE, BE IT RESOLVED BY-THE CITY COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The recitals and -finding' contained in the
Preamble to this Resolution are hereby adopted by reference,
thereto and incorporated herein as if fully set forth in this
Section.
Section 2 The City Manager is hereby authorized!' to execute
a Professional Services Agreement, in a form acceptable to the
City Attorney, with Mata Traktman, to provide court reporting
services for the Office of the City Clerk for the Fiscal Year
�i The herein authorization is further subject to compliance with
all requirements that may be imposed by the City Attorney,
including but not limited to those prescribed by applicable City
Charter and Code provisions.
