A RESOLUTION OF THE MIAMI CITY COMMISSION
CLASSIFYING TEN (10) LIGHT POLES AND FIFTY-
SIX (56) LIGHT FIXTURES LOCATED AT
ROBERT E. LEE MIDDLE SCHOOL, 3100 N.W. 5TH
AVENUE, AS CATEGORY "A" SURPLUS STOCK;
FURTHER DONATING SAME TO THE MIAMI-DADE
SCHOOL BOARD.
WHEREAS, the Department of Public Works desires to have ten
(10) light poles and fifty-six (56) light fixtures declared as
surplus stock to donate to the Miami -Dade School Board ("Board");
and
WHEREAS, on November 29, 1977, the City of Miami ("City")
entered into a lease agreement with the Board for use of the
Robert E. Lee Middle School playfield area as a community park;
and
WHEREAS, pursuant to the lease agreement, the City was
responsiblefor certain recreational improvements to the premises
which, upon termination or cancellation of the agreement, were to
remain property of the City; and
WHEREAS, light poles and fixtures were initially installed
for a baseball field with Community Development Block Grant funds
and later replaced as a result of Hurricane Andrew damage with
insurance funds; and

WHEREAS, on March 1, 1998, the Board exercised its option to
cancel the City's lease to construct new school facilities; and
WHEREAS, the Department of Public Works examined the -light
poles and determined that it would be more expensive to relocate
the poles to another park facility than it would be to purchase
new poles and recommends that they be donated to the Board; and
WHEREAS, the Department of Public Works has determined that
the City has no present or future use for the light poles and
desires to have them classified as Category "A" surplus stock
pursuant to City Code §18-75(a);
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The ten (10) light poles and fifty-six (56)
light fixtures located at Robert E. Lee Middle School, 3100
Northwest. 5th Avenue, are hereby classified as category "A"
surplus stock.
Section 3. Said Category "A" surplus stock is hereby
donated to the Miami -Dade County School Board.

Section 4. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.'/

the end of ten calendar days from the date it was passed and adopted.
If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.

It is respectfully recommended that the City Commission
adopt the attached resolution classifying ten (10) light
poles and fifty-six (56) light fixtures located at Robert E.
Lee Middle School, 3100 N.W. Stn Avenue, as category "A"
surplus stock and donating the same to the Miami -Dade County
School Board.
BACKGROUND:
At one time the City of Miami had a twenty (20) year lease
with the Miami -Dade School Board to use a portion of the
property at Robert E. Lee Middle School as a baseball field
and other park use for City residents. The City installed
the light poles and fixtures as physical improvements to the
site. Originally, these lights were purchased with
Community Development Block Grant Funds. These lights were
eventually replaced as a result of Hurricane Andrew damage
with the funding coming from insurance funds.
In November, 1997 the School Board advised the City of its
intentions to exercise its option to cancel the City's lease
because of the need to construct new school facilities as
part of the School Board's Capital Improvements Program.
Our Public Works Department evaluated this matter and
determined that it would cost more money to relocate these
light poles than it would to buy new ones. On October 8,
1998, the School Board was advised that pending City
Commission approval it would be the City's intention not to
remove the existing light poles and fixtures from the
property. Accordingly,

The purpose of this memorandum is to request that the City donate the fifty-six (56)
light fixtures and ten (10) light poles which the City installed at Robert E. Lee
Middle School, located at 3100 N.W. 5`s Avenue, when the City leased a portion of
the school ground for a baseball field and other park use.
The Miami -Dade County School Board exercised its option to cancel the City's lease
on the Robert E. Lee School site on November 3, 1997 because of the need to
construct new school facilities as part of the Board's Capital Improvement
Program.
Our Public Works Department evaluated this matter and determined that it would
cost more money to relocate these light poles than it would to buy new ones. On
October 8, 1998, the Parks Department verbally advised the School Board that it
would be the City's intention (pending City Commission approval) not to remove
the existing light poles and fixtures from the property. Accordingly, we believe it is
appropriate to donate these City assets to the School Board for their use as they
deem necessary.
Attached for your review, is a draft resolution for this proposed donation. Please
advise us of the next step that needs to be undertaken to schedule this donation for
City Commission approval.

Dear Mt. Ruder.
Because of liability issues, Miami -Dade County Public Schools (M-DCPS) is requesting the City
of Miami (City) make a determination regarding the removal of field lighting poles at the former
City of Miami Park adjacent to Robert E. Lee Middle -School; property location is 3100 N.W. 5
Avenue. As you are aware, the School Board of Miami -Dade County (Board) and the City entered
into a lease agreement on November 29, 1977, for the use of the Robert E. Lee Middle School
piayfteld area as a community park. Following provisions within the lease agreement, the Board
exercised it's option on November 3, 1997, to cancel the agreement effective March 1, 1998. The
cancellation was due to the construction of a new school facility on the existing site. Per the
agreement, the City was responsible for certain recreational improvements to the premises which
included construction of lighting fixtures. Upon termination or cancellation of the agreement, all
installed improvements were to remain personal property of the City.
Construction of the new school is scheduled to be completed by November 1, 1999. M-DCPS is
requesting that if the intent of the City is the removal of the poles; all work should be completed by
October 4, 1999. Any and all work should be coordinated through Mr. Sidney Benson with M-
DCPS Office of Capital Improvement Projects. ]& Benson may be reached at (305) 9954546.
Should the City choose not to remove the poles by the specified date, we will consider them
abandoned property and ownership reverted to the Board. Should you have any questions, please
feel free to contact me at (3 05) 995-7486; nonetheless, please. notify me in writing by August 16,
1999, as to the City's disposition concerning this matter.

Dear Mr. Ruder:
As discussed on October 8, 1998, you advised that the City of Miami (City) will not remove the.
existing light poles at the above referenced school site in the foreseeable future. Further, the Ciry has
no objection to the District relocating some poles, as required, in order to accommodate on=going
construction of the new school facility. It is anticipated that City and District staff will hold
discussions within the next several weeks concerni W the possible use of the recreation area by the
City, during non -school hours, for public park purposes.

The purpose of this memorandum is to inform you that we are in the process
of preparing the necessary City Commission legislation to donate the sports
lights at the former Robert E. Lee Park to the Dade County School Board. It
is our understanding that these lights were originally purchased with
Community Development Block Grant funds. These lights were eventually
replaced as a result of Hurricane Andrew damage with the funding coming
from insurance funds.
The City of Miami had a lease with the Dade County School Board to operate
the field at the former Robert E. Lee Middle School as a City park. When the
School Board decided to build a new school in the area where the old facility
was located, it needed to utilize part of the field as a construction staging
area. Also, to accommodate the size of the new school building, it became
necessary to use part of the land that. encompassed the former City park. As
a result, the School Board opted not to renew its lease with the City.
The City's Public Works Department examined the lights and determined that
it would be more expensive to relocate them to a different park facility than
it would be to purchase new ones. As a result, we have decided, pending
City Commission approval, to donate them to the School Board.
We wanted to advise you of this matter because of the fact that originally
these lights were purchased with Community Development Block Grant
funds. Should we not hear any objections from you by Thursday, October 7,
1999, we will assume that your department has no problem with the
decision to donate these lights to the Dade County School Board.
