A RESOLUTION OF THE MIAMI CITY COMMISSION
AUTHORIZING THE CITY MANAGER TO EXECUTE AN
ASSIGNMENT OF A PROFESSIONAL SERVICES
AGREEMENT FROM THE ARCHITECTURAL FIRM OF
DUANY, PLATER-ZYBERK AND COMPANY TO
R. J. HEISENBOTTLE ARCHITECTS, P.A., IN A
FORM ACCEPTABLE TO THE CITY ATTORNEY, TO
PROVIDE THE DESIGNS, CONSTRUCTION PLANS AND
OTHER PROFESSIONAL SERVICES REQUIRED FOR THE
VIRRICK COMMUNITY CENTER WATER SPORTS CENTER,
PROJECT NO. 333124.
WHEREAS, pursuant to Resolution No. 98-1073, adopted
October 27, 1998, the architectural firm of Duany, Plater-Zyberk
and Company entered into a Professional Services Agreement with
the City of Miami to design and provide construction plans for
the Virrick Community Water Sports Center project; and
WHEREAS, the architectural firm of R. J. Heisenbottle
Architects, P.A., is sub --consultant to Duany, Plater-Zyberk and
Company on the project for historic preservation and the building
and site redevelopment and whose conceptual plan for the project
was approved in principal by Resolution No. 98-719, adopted
July 14, 1998; and
WHEREAS, the architectural firm of Duany, Plater-Zyberk and
Company has decided to concentrate its professional practice on

town and city planning projects, and desires to assign the
Professional Services Agreement for the Virrick Community Water
Sports Center to its sub -consultant, R. J. HEISENBOTTLE,
Architects, to provide the designs, construction plans and other
professional services required for the project; and
WHEREAS, the professional services agreement cannot be
assigned to another architectural firm without the consent of the
City of Miami; and
WHEREAS, the Parks and Recreation Department, Shake -A -Leg
Miami, Inc., and the YMCA of Greater Miami, Inc., the program
providers for the operation of the project, recommend the
assignment of the Professional Services Agreement to
R. J. Heisenbottle, Architects; and
WHEREAS, the City Manager recommends the assignment of the
Professional Services Agreement for the Virrick Community Water
Sports Center to R. J. Heisenbottle, Architects, for continuity
of the project; and
WHEREAS, R. J. Heisenbottle, Architects desires to acquire
the rights and is willing to assume the obligations of Duany,
Plater-Zyberk and Company under the Professional Services

Agreement for the existing funding and fees, except as to the new
floating dock improvements already completed;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The City Manager is hereby authorizedl� to
execute an Assignment of the Professional services Agreement,
from the architectural firm of Duany, Plater-Zyberk and Company
to R. J. Heisenbottle Architects, P.A., in a form acceptable to
the City Attorney, to provide designs, construction plans and
other professional services required for the Virrick Community
Water Sports Center project.
Section 3. The remaining funds for said agreement shall
be allocated to R. J. Heisenbottle Architects, P.A., upon final

the end of ten calendar days from the date it was passed and adopted.
If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.

it is respectfully recommended that the City Commission adopt the attached
Resolution authorizing the City Manager to execute the Assignment of Professional
Services Agreement between the architectural firms of Duany, Plater-Zyberk &
Company (DPZ) and R. J. Heisenbottle Architects (RJH) for the later firm to provide
the design, construction plans and other professional services required for the
Virrick Community Water Sports Center project.
BACKGROUND
On July 14, 1998, the City Commission adopted Resolution No. 98-718 approving the
City Manager's recommendation that the firm of DPZ, with sub -consultant RJH
and other sub -consultants approved by the City be contracted for the Virrick
Water Sports Center project. Pursuant to Resolution No. 1073, DPZ entered into a
Professional Services Agreement dated April 9, 1999, to design and provide
construction plans for the project. The DPZ firm is nationally known for its Town
and City planning design work and subsequently decided to concentrate its
professional practice on these types of services. DPZ required that sub -consultant
RJH be assigned Its Professional Services Agreement under Article 15 of the
Agreement since RJH was the firm most familiar with the project and was working
with the Parks & Recreation Department, Shake -A -Leg, Inc. and the YMCA of Greater
Miami on programming and conceptual designs of the final project.
RJH desires to acquire rights and is willing to assume the obligations of DPZ under
the Professional Services Agreement for the existing funding and fees, except for
the new floating dock improvements already completed. The YMCA of Greater
Miami, Shake -A -Leg, and the Parks and Recreation Department are all in agreement
and highly recommend the assignment of the Agreement to RJH for the sake .of }
continuity and the urgent need.to complete the designs and construction plans. =
Based on these recommendations, the City Manager recommends the assignment.
of this Professional Services Agreement from DPZ to RJH with no additional
funding required. The Professional Services Agreement by its terms is assignable
upon written consent by the City Commission.

I would like to bring up as a pocket item on the January 13, 2000, Commission
Meeting a resolution authorizing the City Manager to execute an assignment of a
professional services agreement from the architectural firm of Duany, Plater-Zyberk,
and company to R.J. Heisenbottle Architects, P.A.. For the purpose of providing the
designs, construction plans and other professional services required for the Virrick
Community Center Water Sports Center. Attached is a copy of the City Manager's
recommendation and resolution.
