A RESOLUTION OF THE MIAMI CITY COMMISSION
AUTHORIZING THE ALLOCATION OF FUNDS, IN AN
AMOUNT NOT TO EXCEED $500,000, FOR SPECIAL
OVERTIME PAY TO CONDUCT VEHICLE IMPOUNDMENT
PROGRAM STING OPERATIONS; ALLOCATING FUNDS
THEREFOR FROM THE LAW ENFORCEMENT TRUST FUND,
PROJECT NUMBERS 690002 AND 690003, SUCH
EXPENDITURES HAVING BEEN APPROVED BY THE
CHIEF OF POLICE AS COMPLYING WITH THE
U.S. DEPARTMENT OF THE TREASURY'S "GUIDE TO
EQUITABLE SHARING," AND FLORIDA STATE
STATUTE 932.7055, AS AMENDED.
WHEREAS, the U.S. Department of the Treasury's "Guide to
Equitable Sharing" and Florida State Statute 932.7055, as
amended, authorize the expenditure of forfeiture cash or proceeds
for certain law enforcement purposes not considered normal
operating expenses; and
WHEREAS, funds will be used for special overtime pay during
Fiscal Year 1999/2000 to conduct Vehicle Impoundment Program Sting
Operations, which are proactive anti-crime operations that target
narcotics and prostitution; and
WHEREAS, it is the City Commission's position that Law
Enforcement Trust Fund monies not be utilized to cover any
expenses related to the "Mayor's Summit of the Americas", held
November 14 - 21, 1999; and
WHEREAS, funds to cover this expenditure have not been
included in the Police Department's normal operating budget and
are available in the City of Miami Law Enforcement Tru

WHEREAS, the Chief of Police has recommended adoption of
this Resolution and has determined that the expenditures proposed
comply with the U.S. Department of the Treasury's "Guide to
Equitable Sharing" and Florida State Statute 932.7055, as
amended;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The allocation of funds, in an amount not to
exceed $500,000, for special overtime pay to conduct Vehicle
Impoundment Program Sting Operations, excluding overtime pay for
expenses related solely to the "Mayor's Summit of the Americas",
held November 14 - 21, 1999, is hereby authorized, with funds
therefor hereby allocated from the Law Enforcement Trust Fund,
Project Numbers 690002, and 690003, such expenditure having been
approved by the Chief of Police as complying with the
U.S. Department of the Treasury's "Guide to Equitable Sharing"
and Florida State Statute 932.7055, as amended.

Section 3. This Resolution; shall become effective
immediately upon its adoption and signature of the Mayor Y

the end of ten calendar days from the date it was passed and adopted.
If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.

RECOMMENDATION
It is respectfully recommended that the City Commission adopt the attached Resolution,
authorizing the funding of special overtime, and allocating funds therefor, in an amount not to
exceed $500,000. Funding is to be provided from the Law Enforcement Trust Fund; Project
Numbers 690002 and 690003.
BACKGROUND
These funds will be used for special overtime to conduct Vehicle Impoundment Program Stings,
pro -active crime operations, etc. During the City Commission's Budget Hearing of September
28"', 1999, Chief William E. O'Brien authorized the expenditures of $500,000 from the Law
Enforcement Trust Fund for said purpose, which was approved by the City Commission.

The Police Department has verified that funds area available with the Department of Management
& Budget, for the funding of special overtime to conduct Vehicle Impoundment Program Stings,
