AND APPROVING THE INSTALLATION OF STEEL PICKET FENCE FROM RONALD GIBBONS FENCE CO., AT WAINWRIGHT PARK AND SEWELL PARK FOR THE PARKS AND RECREATION DEPARTMENT, IN THE TOTAL AMOUNT NOT TO EXCEED $44,999; ALLOCATING FUNDS THEREFOR FROM THE SAFE NEIGHBORHOOD PARK BOND FUNDS APPROPRIATED IN CAPITAL IMPROVEMENT PROJECT NOS. 333100 AND PROJECT NO. 333105. WHEREAS, Resolution No. 98-946 adopted on September 8, 1998, awarded the August 11, 1998 bids submitted by Sovereign Construction, Inc. for the furnishing and installation of steel picket fencing at Sewell, Alice Wainwright and Athalie Range city parks, in the amount of $62,456.49, and Ronald M. Gibbons Fence Company for the furnishing and installation of steel picket fencing at Coral Gate city park, in the amount of $15,404, for a total cost of $77,860.49, for the Department of Parks and Recreation; and WHEREAS, after months of correspondence and discussions with Sovereign Construction Group, Inc., the lowest bidder, they CITY COMUSSION MgETI G OF JAN 1 3 2000 Resolution No. • declined to do the work for failure to meet the bid specifications; and WHEREAS, Ronald Gibbons Fence Co., the next lowest responsible and responsive bidder, was awarded the bid for Wainwright and Sewell parks pursuant to Bid No. 97-98-175; and WHEREAS, the City Manager has made a written finding.that an emergency existed and authorized the procurement and installation of steel picket fences at Wainwright Park and Sewell Park; and WHEREAS, funds are available from the Safe Neighborhoods Park Bonds appropriated in Capital Improvement Project Nos. 333100 AND 333105. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. By a four-fifths (4/5th,) affirmative vote of the members of the City Commission, the City Manager's finding of an emergency, waiving the, requirements for competitive sealed bids, and amending Resolution No. 98-846 by rescinding the bid award to Sovereign Construction, Inc. and approving the installation of steel picket fences at Wainwright Park and Sewell Park for the Department of Parks and Recreation, in an amount not to exceed $44,999 by Ronald Gibbons Fence Co.,. is hereby ratified, approved and confirmed, with funds therefor hereby allocated from funds available from the Safe Neighborhood Park Page 2 of 3 O- 030 Bond program appropriated in Capital Improvement Project Nos. 333100 and 333105. However, after months of back and forth discussions and correspondence with Sovereign over whether they could meet the specifications of the bid, and indeed, whether they were actually going to perform the work or pass it to another company, they decided to decline to do the work.
