ORDINANCE NO.
AN ORDINANCE OF THE MIAMI CITY COMMISSION
AMENDING ORDINANCE NO. 11000, AS AMENDED, THE
ZONING ORDINANCE OF THE CITY OF MIAMI, BY
AMENDING ARTICLE 9, SECTION 916, INTERIM
PARKING, TO MODIFY PROVISIONS RELATED TO
INTERIM PARKING; CONTAINING A REPEALER
PROVISION AND SEVERABILITY CLAUSE; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Miami Planning Advisory Board, at its meeting
of October 18, 2000, Item No. 13, following an advertised
hearing, adopted Resolution No. PAB 63-00, by a vote of four to
one -(4-1), RECOMMENDING APPROVAL of amending Zoning Ordinance
No. 11000 as hereinafter set forth subject to the limitation that
no extensions be approved beyond December 31, 2002; and
WHEREAS, the City Commission after careful consideration of
this matter, and notwithstanding the recommended condition of the
Planning Advisory Board, deems it advisable and in the best
interest of the general welfare of the City of Miami and its
inhabitants to amend Ordinance No. 11000 as hereinafter set
f orth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:

Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. Ordinance No. 11000, as amended, the Zoning
Ordinance of the City of Miami, Florida, is hereby amended by
amending the text of said Ordinance as follows:'/
ARTICLE 9. GENERAL AND SUPPLEMENTARY REGULATIONS
Sec. 916. Interim parking.
916.2.2. Short-term event parking facilities.
Short-term event parking facilities shall be permitted
as a conditional use on non -residentially zoned lots,
within a six hundred (600) foot radius of the major
public facility they are intended to serve, pursuant to
a Class II Special Permit for a duration of no more than
one year, and only in conjunction with major public
facilities such as major sports facilities, arenas,
exhibition centers, performing arts centers and any

words and/or figures shall be added. The remaining provisions are now
in effect and remain unchanged. Asterisks indicate omitted and
unchanged material.

other such major public facility whose scale and
operation warrant the use of interim parking facilities
on an event -by -event basis versus daily year-round use.
The intent in permitting these types of interim parking
facilities is to obtain full code compliance within a
one-year period. Renewals may only be granted by the
City Manager upon findings and recommendations by the
Director of the Department of Planning and Zoning that
such renewals are in the best interest of the city for
reasons related to insufficient parking within proximity
of a major facility; such renewals shall not be extended
beyond December 31, 2002. Parking spaces provided on
this type of interim parking facility shall not be
counted toward meeting required parking for any such
major public facility.
Section 3. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.

Section 5. This Ordinance shall become effective thirty
(30) days after final reading'and adoption thereof.al

Zoning Ordinance of the City of Miami, Florida by amending
Article 9, Section 916 in order to modify provisions related to
interim parking
PLANNING
RECOMMENDATION Approval.
BACKGROUND AND This ordinance is being proposed due to a proliferation of
ANALYSIS interim parking lots in the downtown area and a negative overall
appearance as a result. Interim parking lots were never intended
to be a permanent solution to major public facility parking
needs. These lots do not provide sufficient landscape and as
stated, the result has been adverse to the general appearance of
certain areas of downtown Miami. By limiting interim parking
lots to no more than one year, (with extensions granted only by
the City Manager as set forth in the attached legislation) in which
they must come into full code compliance (including
landscaping), the Planning and Zoning Department are hoping to
improve the appearance of downtown.
