ORDINANCE NO.
AN EMERGENCY ORDINANCE OF THE MIAMI CITY
COMMISSION AMENDING CHAPTERS 2 AND 53 OF THE
CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED, TO (1) DELETE ALL REFERENCES TO THE
BOBBY MADURO STADIUM; AND (2) CREATE AND
ESTABLISH THE ORANGE BOWL ADVISORY BOARD
("BOARD"); SETTING FORTH THE BOARD'S PURPOSE,
POWERS, AND DUTIES; AND TO PROVIDE FOR
"SUNSET" REVIEW, MEMBERSHIP, TERMS OF OFFICE,
VACANCIES, OFFICERS, RULES OF PROCEDURE,
MEETINGS, VOTING AND QUORUM, ATTENDANCE
REQUIREMENTS, ASSIGNMENT OF PERSONNEL, AND
COUNSEL; SUNSETTING THE, ORANGE BOWL STEERING
COMMITTEE AND RESCINDING RESOLUTION
NO. 99-802 IN ITS ENTIRETY; AND MORE
PARTICULARLY BY DELETING ALL REFERENCES TO
THE BOBBY MADURO STADIUM CONTAINED IN
SECTIONS 2-358, 53-1, 53-26, 53-86, AND
53-121, AMENDING SECTION 2-892, AND CREATING
NEW DIVISION 4 IN CHAPTER 53 CONTAINING"'
SECTIONS 53-121 THROUGH 53-128 TO SAID CODE;
AND CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE.
WHEREAS, pursuant to Resolution No. 99-802, adopted
October 26, 1999, the City Commission created the Orange Bowl
Steering Committee, for a period of one year, to advise and make
recommendations to the City Commission related to the
rehabilitation and marketing of the Orange Bowl; and
WHEREAS, it has been determined that the rehabilitation and
marketing of the Orange Bowl will require the attention of a
advisory group for a longer period than one year; and

WHEREAS, Section 2-883 of the Code of the City of- Miami,
Florida, as amended, requires that all City boards existing for
more than one year be created by ordinance; and
WHEREAS, it is therefore appropriate to create the Orange
Bowl Advisory Board and to sunset the Orange Bowl Steering
Committee; and
WHEREAS, it is further in order to delete all references to
the Bobby Maduro Stadium as contained in Chapters 2 and 53 of the
Code as the City -facility and property was sold to private
enterprise several years ago;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1.
The recitals and findings contained in the
Preamble to this Ordinance
are hereby adopted by reference and
incorporated as if fully
set forth in this Section.
Section 2.
The Code of the City of Miami, Florida, as
amended, is hereby
further amended as follows to delete all
references to the
Bobby Maduro Stadium, as contained in the
following Sections,
as such property and facility are no longer
owned by the City of
Miami:
Amend:
(a) Section 2-358;
(b) Section 53-1;
(c) Section 53-26; and
(d) Section 53-86.
Delete:
Division 4 of Chapter 53 in its entirety,
including Section 53-121 contained thereto.

Section 3. Chapter 2, Article XI, of the Code of the
City of Miami, Florida, as amended, is hereby amended in the
following particulars:l/
"Chapter 2
ADMINISTRATION
Article XI. BOARDS, COMMITTEES, COMMISSIONS
DIVISION 2. STANDARDS FOR CREATION AND
REVIEW OF BOARDS GENERALLY
Sec. 2-892. "Sunset" review of boards.
Commencing with the year 1995, each city board
shall be reviewed in the following manner:
(4) The following boards hall initially be reviewed in
the following years and shall be reviewed every
four years thereafter:

Section 4. Chapter 53, Article II, of the Code of the
City of Miami, Florida, as amended, is hereby further amended by
creating new Division 4 containing Sections 53-121 through 53-128
in the following particulars:/
"Chapter 53
STADIUMS AND CONVENTION CENTERS
ARTICLE II City Stadiums
Division 4. Orange Bowl Advisory Board
Sec. 53-121. Established.
There is hereby established and created a limited
agency and instrumentality of the City of Miami to be
known as the Orange Bowl Advisory Board ("Board")
Sec. 53-122. Purposes, powers and duties.
The purpose, powers and duties of the Board are to
serve in an advisory capacity and make recommendations
in writing to the City Commission as they relate to the
Orange Bowl which shall include, but not be limited to:
(1) Identification of essential capital
improvements to modernize and restore the
Orange Bowl as a first class facility;
(2) Identification of funding sources to finance
said capital improvements;
(3) Identification of new and enthusiastic
promotional strategies to market and attract
diverse events to the Orange Bowl;
(4) Recommendations for the solicitation of
corporate sponsorship of the Orange Bowl
facility and its components (skyboxes, etc.);
(5) Presentation of reports the Board's findings,
as directed by the City Commission.

Sec. 53-124. Membership, terms of office; vacancies.
(a) Membership. The Board shall consist of
fourteen (14) voting members who shall serve without
compensation, but shall be reimbursed for _necessary
expenses incurred in their official duties, as may be
determined and approved by the City Commission, and
shall be composed as follows:
(1) A City Commissioner who shall serve as
Chairperson.
(2) The Athletic Director of the University of
Miami.
(3) Two (2) individuals appointed by the Mayor
who shall be qualified electors of the City
of Miami.
(4) Ten (10) individuals, two (2) appointed by
each member of the City Commission, who shall
be qualified electors of the City of Miami.
(b) Terms of office; vacancies. The provisions
set forth in Section 2-885 of this Code shall apply to
the appointment of all members and the filling of
vacancies for the Board.
Sec. 53-125. Officers.
The members of the Board shall select and
designate a Vice -Chairperson from among its members to
serve as Chairperson at any meeting should the
Chairperson be absent from such meeting. Other
officers. as may be deemed necessarv, may be designated
by the Board.
Sec. 53-126. Meetings; voting and quorum; attendance
requirements; rules of procedure.
(a) Meetings and quorum. All meetings of the Board
shall be open to the public. A quorum for all
Board meetings shall consist of 50 percent plus
one of the Board's total membership. An
affirmative vote of not less than fifty percent
(50%) of the members present and voting at any
meeting is required for any action to be taken by
the members.
(b) Attendance requirements. The provisions set forth
in Section 2-886 of this Code shall apply to all
members of the Board.

(c) Rules of procedure. The Board may adopt its own
order of business and rules of procedure governing
its meetings, and actions on matters within its
jurisdiction, not inconsistent with the provisions
set forth herein, which rules of procedure shall
be filed with the City Clerk. Copies of minutes of
all Board meetings shall be furnished to the
Mayor, Commissioners and the City Manager.
Sec. 53-127. Assignment of personnel; Counsel.
(a) Assignment of personnel. It shall be the duty of
the City Manager to provide full cooperation and
sufficient administrative support to the Board,
including assignment of personnel and
administrative support when requested by the
Board, which shall include the services of an
individual to maintain minutes of meetings and
Board correspondence, post meeting notices, file
reports and perform all other necessary support
functions.
(b) Counsel. The City Attorney shall provide legal
services to the Board.
Sec. 53-128. Notices and filing of records.
It shall be the duty of the City Clerk to comply
with applicable laws related to -ublic notice and
filing of records."
Section 5. The Orange Bowl Steering Committee is hereby
sunsetted and Resolution No. 99-802, adopted October 26, 1999,
which created said Committee, is hereby rescinded in its
entirety.
Section 6. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 7. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.

Section 8. This Ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami.
Section 9. The requirement of reading this Ordinance on
two separate days is hereby dispensed with by an affirmative vote
of not less than four -fifths of the members of the Commission.
Section 10. This Ordinance shall become effective
immediately upon its adoption and signature of the Mayor.'/

renowned City of Miami Orange Bowl Stadium. Due to this overwhelming task, I

additional year.
