AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 18/ARTICLE VIII, OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "FINANCE/STORMWATER UTILITY FEES AND FUND" TO CHANGE REFERENCES THEREIN FROM "MIAMI RIVER COORDINATING COMMITTEE" TO "MIAMI RIVER COMMISSION," MORE PARTICULARLY BY AMENDING SECTION 18-298(6); CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on January 1, 1986, the Governor of the State of Florida created the Miami River Coordinating Committee by Executive Order 86-4 for a period of one year; and WHEREAS, the Florida Legislature by passage of Chapter 98-402, Section 5, Laws of Florida (Section 163.05, Fla. Stat. (1999)), created the Miami River Commission which in addition to other responsibilities, was charged with performing substantially all of the coordinating and intergovernmental cooperation roles that the Miami River Coordinating Committee had previously performed; and WHEREAS, the City desires to hereby amend Section 18-298(6) of the City Code to change the references therein from "Miami River Coordinating Committee" to "Miami River Commission"; 11996 NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference and incorporated as if fully set forth in this Section. Section 2. Chapter 18/Article VIII, of the Code of the City of Miami, Florida, as amended, is hereby further amended in the following particulars:l/ "Chapter 18 FINANCE ARTICLE VIII. STORMWATER UTILITY FEES AND FUND Sec. 18-298. Stormwater utility trust funds. There shall be established a stormwater utility trust fund for the deposit of all fees and charges collected and interest accrued by the stormwater utility. These funds shall be for the exclusive use of the department of public works for the following expenditures: (6) Annual fair share funding support for the Miami River Commission. 1� Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. Page 2 of 3 11996 Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. The Memorandum of Understanding clarifies and delineates the responsibilities of the City, County and State in governing and maintaining the Miami River. .City of Miami Ordinance No. 10616 passed and adopted July 13, 1989, amended the City Code by adding Section 18-298 to provide funding support for the Miami' River Coordinating Committee and subsequently the Miami River Commission.
