AN EMERGENCY ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING ORDINANCE NO. 11970, THE ANNUAL APPROPRIATIONS FOR FISCAL YEAR ENDING SEPTEMBER 30, 2001 FOR THE PURPOSE OF ADJUSTING SAID APPROPRIATIONS RELATING TO OPERATIONAL AND BUDGETARY REQUIREMENTS OF CERTAIN CITY DEPARTMENTS AS MORE PARTICULARLY SET FORTH HEREIN; REVISING ONGOING CAPITAL IMPROVEMENT PROJECTS; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City Commission adopted Ordinance No. 11970, the Annual Appropriations Ordinance on September 28, 2000, establishing revenues and appropriations. for the City of Miami, Florida, for Fiscal Year ending September 30, 2001; and WHEREAS, the City Commission adopted Ordinance No. 11969 on September 28, 2000, to appropriate Fiscal Year 1999-00 year-end Surplus Funds in the amount of $5,531,791 for designated uses relating to the Miami River Dredging Project, Capital Improvement Projects and Project deficits, operating Capital outlays, a grant to the SEOPW CRA, payment to SEOPW CRA for Fiscal Year 1999-2000 obligations, Miami Development Summit Conference, equipment for the Office of the City Clerk, and the Department of Community Development for the final payment to U.S. HUD; and 1�993 • 0 WHEREAS, it is necessary to appropriate $2,291,OOO of the Fiscal Year 1999-00 Surplus Funds in the Fiscal Year 2001 Operating Budget for expenditures during the current fiscal year; and WHEREAS, it is necessary to revise previously approved Capital Improvement Project No. 311016 to reflect the $1,460,791 of Fiscal Year 1999-00 Surplus Funds approved for various capital uses; and WHEREAS, the City Commission approved Resolution No. 00-711, as amended, to approve funding in the amount of $200,000 for the Bicentennial Park/FEC Slip Waterfront Renewal Project; and WHEREAS, it is necessary to appropriate the funding for the Bicentennial Park/FEC Slip Waterfront Renewal Project in the Fiscal Year 2001 Operating Budget from the undesignated fund balance; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference and incorporated as if fully set forth in this Section. Section 2. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provision of this Ordinance shall not be affected. Section 5. This Ordinance, is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace,. health, safety, and property of the City L of Miami, and upon the further grounds of the necessity to make the required and necessary payments to its employees and officers, payment-of'`its debts, necessary and required purchases of goods and supplies and to generally carry on the functions and duties of municipal affairs. Section 6. The requirements of reading this Ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four -fifths of the members of the Commission. Section 7. This Ordinance shall become effective immediately upon adoption and signature of the.Mayor.2/ This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later. BACKGROUND On September 28, 2000, as part of the budget hearings for the Fiscal Year 2001 Budget, the City Commission adopted Ordinance No. 11969 to appropriate $5,531,791 from Fiscal Year 2000 year-end surplus funds for designated uses relating to Miami River Dredging Project, Capital Improvement Projects and Project deficits, operating Capital outlays, a grant to the SEOPW CRA, payment to SEOPW CRA for Fiscal Year 1999-2000 obligations, Miami Development Summit Conference, equipment for the Office of the City Clerk, and the Department of Community Development for the final payment to U.S. HUD. The expenditure of $2,291,000 of these funds will take place during the current fiscal year so it is in order to appropriate the funds in the Fiscal Year 2001 Operating Budget.
