AN ORDINANCE OF THE MIAMI CITY COMMISSION ESTABLISHING A NEW SPECIAL REVENUE FUND ENTITLED: "MIAMI RIVER BROWNSFIELD PROJECT FUND" AND APPROPRIATING FUNDS IN THE AMOUNT OF $185,000 RECEIVED BY THE CITY AS A GRANT FOR THE DEPARTMENT OF REAL ESTATE AND ECONOMIC DEVELOPMENT FROM THE U.S. ENVIRONMENTAL PROTECTION AGENCY FOR BROWNSFIELD RESEARCH AND ENVIRONMENTAL ASSESSMENT; RATIFYING, APPROVING, AND CONFIRMING THE CITY MANAGER'S ACTION IN ACCEPTING THE GRANT AND EXECUTING THE NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, TO IMPLEMENT THE TERMS AND CONDITIONS OF THE GRANT; FURTHER AUTHORIZING THE CITY MANAGER TO ENTER INTO A PROFESSIONAL SERVICES AGREEMENT WITH THE TRUST FOR PUBLIC LAND AS A COLLABORATING PARTNER, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, TO IMPLEMENT GRANT FUNDED ACTIVITIES; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Department of Real Estate and Economic Development established a Brownsfield Program, and received state and federal funding for same since 1996; and WHEREAS, the Department of Real Estate and Economic Development determined that the City of Miami is eligible to apply for federal funding assistance from the Brownsfield Pilots Cooperative Agreements Grant Program (CFDA # 66.811) sponsored by the U.S. Environmental Protection Agency; and WHEREAS, the Department of Real Estate and Economic Development submitted a timely application to the U.S. Environmental Protection Agency on December 20, 1999, which was amended on June 16, 2000; and WHEREAS, on August 11, 2000, the U.S. Environmental Protection Agency awarded a grant to the City of Miami, in the amount of $185,000 to carry out the purpose and scope of work proposed in the City's grant application, consisting of Brownsfield research and assessment activity along the Miami River in collaboration with the Trust for Public Land; and WHEREAS, the grant will be administered through the Atlanta Regional Office of the U.S. Environmental Protection Agency; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The following new Special Revenue Fund is established and resources are appropriated as described: FUND TITLE: "Miami River Brownsfield Project Fund" RESOURCES: U.S. Environmental Protection Agency $185,000 APPROPRIATION: $185,000 Page 2 of 4 1: Ll Section 3. The City Manager's action in accepting the grant and executing the necessary documents, in a form acceptable to the City Attorney, to implement the terms and conditions of the grant award is ratified, approved and confirmed. Section 4. The City Manager is authorizedil to enter into a professional services agreement with the Trust for Public Land as a collaborating partner, in a form acceptable to the City Attorney, to implement grant funded activities. Section 5. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are repealed. Section 6. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 7. BACKGROUND: The Department of Real Estate & Economic Development has established a viable Brownfields Redevelopment Program that was initiated by the infusion of both Federal and State grant funding. The Department of Real Estate & Economic Development initially received $100,000 from the U.S. EPA in October 1996 for the Wynwood Brownfields Project and received supplemental assistance of $100,000 in October 1997. In January 1998, the City was awarded $500,000 from the State of Florida for Brownfields Redevelopment. To help guide the Brownfields Redevelopment Program the City Commission established the Brownfields Advisory Board in May 1998. This new EPA grant will enable the City.to foster private sector investment and subsequent job creation on sites with actual or perceived contamination along the Miami River, by carrying out assessment activity, as well as to further Miami River greenway planning. The grant provides $137,000 for Brownfields planning and assessment activities along the Miami River, as well as $48,000 for Miami River greenway planning.
