ORDINANCE NO.
AN ORDINANCE OF THE MIAMI CITY COMMISSION
ESTABLISHING A SPECIAL REVENUE FUND ENTITLED:
"DOMESTIC PREPAREDNESS EQUIPMENT SUPPORT
PROGRAM FUND" AND APPROPRIATING FUNDS IN` THE
AMOUNT OF $98,634, RECEIVED AS A GRANT FROM
THE U.S. DEPARTMENT OF JUSTICE, OFFICE OF
JUSTICE PROGRAMS; AUTHORIZING THE CITY
MANAGER TO ACCEPT THE FUNDS AND TO EXECUTE
ALL NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE
TO THE CITY ATTORNEY, FOR ACCEPTANCE OF SAID
AWARD; AND CONTAINING A REPEALER PROVISION
AND SEVERABILITY CLAUSE.
WHEREAS, the City of Miami as been awarded a grant from the
U.S. Department of Justice, Office of Justice Programs, in the
amount of $98,634, to be administered by the Department of Police
for purposes of (1) training individuals to respond to domestic
terrorism involving the use of chemical or biological agents,
radiological explosives and incendiary devices, and (2) procuring
the specialized emergency response equipment related to defense
against such terrorism; and
WHEREAS, any purchases must comply with the equipment
categories/ types provided in the FY 1999 Grant Application Kit
and applicable City Code procurement procedures;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The following Special Revenue Fund is hereby
established and resources are hereby appropriated as described
herein:

RESOURCES: U.S. DEPARTMENT OF JUSTICE,
OFFICE OF JUSTICE PROGRAMS $98,634
APPROPRIATIONS: $98,634
Section 3. The City Manager is hereby authorizedll to
accept the grant from the U.S. Department of Justice, Office of
Justice Programs, in the amount of $98,634, and to execute all
necessary documents, in a form acceptable to the City Attorney,
for acceptance of the aforesaid funds.
Section 4. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
The herein authorization is further subject to compliance with all
requirements that may be imposed by the City Attorney, including but not
limited to those prescribed by applicable City Charter and Code
provisions.

Section 5. If any section, part of section, paragraph,
clause, phrase, or word of this Ordinance is declared invalid,
the remaining provisions of this Ordinance shall not be affected.
Section 6. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof.21

by the Mayor within ten days from the date it was passed and adopted. If
the Mayor vetoes this Ordinance, it shall become effective immediately

It is respectfully recommended that the City Commission adopt the attached Ordinance which
establishes initial resources and initial appropriations for a Special Revenue Fund entitled:
"Domestic Preparedness Equipment Support Program Grant," accepting a grant from the U. S.
Department of Justice, Office of Justice Programs, in the amount of $98,634.
BACKGROUND
The City of Miami has been awarded a grant, in the amount of $98,634, from the U. S. Department
of Justice, Office of Justice Programs. This grant award is for the procurement of specialized
emergency response equipment, which will enhance both the Fire and Police Department's basic
defensive capability to respond to incidents of domestic terrorism involving the use of chemical or
biological agents, radiological explosives and incendiary devices. The Police Department will
administer the grant and ensure the purchase of equipment and the required training for its use.

SPECIAL CONDITIONS
1. The recipient agrees to comply with the financial'and
administrative requirements set forth in the current edition
of the Office of Justice Programs (OJP) Financial Guide.
2. The recipient agrees to comply with the organizational audit
requirements of OMB Circular, A-133, Audits of States, Local
Governments, and Non -Profit Organizations, as further
described in OJP's Financial Guide, Chapter 19.
3. The recipient agrees to supplement and not supplant State or
local funds.
4. The recipient acknowledges that failure to submit an
acceptable Equal Employment Opportunity Plan (if recipient
is.required to submit one pursuant to 28 CFR Section
42.302), that is approved by the Office of Civil Rights, -
a violation of its Certified Assurances and may result in
funds from the award being frozen, until such time as the
recipient is in compliance.
S. The grantee agrees that all equipment purchased with grant
funds must comply with the equipment categories/types
provided in the FY 1999 grant application kit and will be
purchased to enhance the "basic defensive capabilities" of
first responders. For purposes of this grant program first
responders include members of the fire service, hazardous
materials teams, emergency medical personnel and law
enforcement. Equipment that does not comply with these
categories shall not be purchased by the grantee unless a
request..and justification for the equipment is submitted by
the grantee and approved by the program office, and.a grant
adjustment notice (GAN) has been issued.

The City of Miami will use the $98,634 grant to enhance its response to a nuclear, biological, or chemical (NBC)
terrorist event. The applicant worked with 13 groups, committees and governmental entities in order to plan a
coordinated multi -agency equipment acquisition program and response. The equipment selected includes bomb snits
with bio -chem helmet and shield, disposable encapsulated suits, portable safety showers, chmical/biological Soaks
and canisters, portable wireless x-ray imaging systems, Photo-Ionixation meter, bio -kits, and integrated
ccssamicatiom system.
Equipment purchases will be allocated as follows: PPE $40,800, Decontamination $1,524, Detection $42,310, and
Communications $14,000.

ING CHAPTER 38,. ARTICLE ll, --OF THE CODE OF THE -CITY"
OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "PARKS AND
RECREATION/USE REGULATIONS," TO PERMIT THE SALE
AND CONSUMPTION OF ALCOHOLIC BEVERAGES ON A
REGULAR BASIS AT THE ALLEN MORRIS BRICKELL PARK,
LOCATED AT 25. SOUTHEAST 10TH STREET, MIAMI, FLORI-
DA; MORE PARTICULARLY BY AMENDING SECTION 38-69
OF SAID CODE; CONTAINING,A REPEALER PROVISION
AND A SEVERABILITY CLAUSE; AND PROVIDING FOR AN
EFFECTIVE DATE.
Said proposed ordinances may be inspected by the public at the
Office of the City Clerk, 3500 Pan American Drive, Miami, Flori-
da, Monday, through :Friday,, excluding holidays, between the
hours of 8 a.m. and 5 p.m,. ,
All interested -persons may appear at the meeting and may be heard
with respect to the proposed ordinances. Should any person desire to ap-
peal any decision of the City. Commission with respect to any matter to be
considered at this meeting,. that person shall ensure that a verbatim
record of the proceedings is made including all testimony and evidence,
upon which any appeal may be based.
