ORDINANCE NO.
AN EMERGENCY ORDINANCE OF THE MIAMI CITY
COMMISSION AMENDING ORDINANCE NOS. 11705, AS
AMENDED, AND 11839, AS AMENDED, BY INCREASING
THE APPROPRIATIONS FOR TWO CAPITAL
IMPROVEMENT PROJECTS '("CIP") AS FOLLOWS:
(1) FUNDS IN THE AMOUNT OF $375,000 FOR THE
HADLEY PARK SENIOR CENTER, CIP PROJECT
NO. 331391, CONSISTING OF FUNDS PROVIDED FROM
THE FISCAL YEAR 2000 GENERAL FUND SURPLUS,
AND (2) FUNDS IN THE AMOUNT OF $600,000 FOR
VIRRICK PARK RENOVATIONS, CIP PROJECT
NO. 331316, CONSISTING OF $150,000 RECEIVED
AS A GRANT FROM THE STATE OF FLORIDA
DEPARTMENT OF ENVIRONMENTAL PROTECTION,
FLORIDA RECREATION ASSISTANCE PROGRAM
("FRDAP"), AND $450,000 PROVIDED FROM THE
FISCAL YEAR 2000 GENERAL FUND SURPLUS, WHICH
AMOUNT INCLUDES THE CASH MATCH REQUIRED BY
THE CITY IN THE AMOUNT OF $150,000;
AUTHORIZING THE CITY MANAGER TO ACCEPT THE
GRANT FROM FRDAP FOR VIRRICK PARK OUTDOOR
RECREATION IMPROVEMENTS AND EXECUTE THE
NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO
THE CITY ATTORNEY, FOR SAID PURPOSE;
CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE.
WHEREAS, the City of Miami Commission adopted Ordinance
Nos. 11705, as amended, 11839, which Ordinances established
appropriations for Capital Improvement Projects; and
WHEREAS, increased appropriations are required to proceed
with two of the Capital Improvement Projects ("CIP"), namely, the
Hadley Park Senior Center, CIP No. 331391, in the amount of
$375,000, and the Virrick Park Renovations, CIP Project
No. 331316, in the amount of $600,000; and
•
WHEREAS, the City of Miami received a grant, in the amount
of $150,000 from the State of Florida Department of Environmental
Protection Recreation Assistance Program ("FRDAP") to fund
outdoor recreation improvements at Virrick Park, which grant
requires a dollar for dollar cash match by the City; and
WHEREAS, the remaining required funds for both CIPS are
available from the Fiscal Year 2000 General Fund Budget Surplus;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. Ordinance No. 11705, as amended, and
Ordinance No. 11839, as amended, are hereby further amended in
the following particulars:11

The following appropriations are made for implementation of
all municipal capital improvements of the City of Miami, Florida,
including new capital improvement projects scheduled to begin
during Fiscal Year 1998-99. The appropriations which are
designated by reference to descriptive project title and number
also include appropriations for previously approved. scheduled
projects as well as appropriations of prior fund appropriations.
The sources of revenues to support the appropriations are
identified and being set forth for seven program (I -VII) areas
base upon use or functional category within said areas:

Section 3. The City Manager is hereby authorized2l to
accept the grant from FRDAP for Virrick Park outdoor recreation
improvements and execute the necessary documents, in a form
acceptable to the City Attorney, for said purpose.
Section 4. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 5. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 6. This Ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami, and upon the further grounds of the necessity to make
the required and necessary payments to its employees and
officers, payment of its debts, necessary and required purchases
of goods and supplies and to generally carry on the functions and
duties of municipal affairs.
Section 7. The requirement of reading this Ordinance on
two separate days is hereby dispensed with by an affirmative vote
of not less than four-fifths of the members of the Commission.
The herein authorization is further subject to compliance with all
requirements that may be imposed by the City Attorney, including but not
limited to those prescribed by applicable City Charter and Code
provisions.

It is respectfully requested that the City Commission adopt the attached Emergency
Ordinance revising previously approved Capital Projects as follows: $450,000 for Virrick
Park (Project No. 331316), and $375,000 for Hadley Park (Project No. 331391). This
Ordinance also accepts and appropriates a Grant from the State Of Florida Department of
Environmental Protection, Florida Recreation Assistance Program (FRDAP), in the amount
of $150,000 for Virrick Park outdoor recreation improvements (Project No. 331316)
Outdoor Recreation Improvements.
BACKGROUND:
On June 21, 2000 the City of Miami was awarded a grant in the amount of $150,000 from
the State of Florida Department of Environmental Protection, Florida Recreation
Assistance Program. The grant will be used to fund outdoor improvements at Virrick Park.
These improvements include a new playground, site furnishings, walkways, upgrade to the
site lighting, renovations to the shelters, stage area, concrete chess board and refurbishment
of the basketball courts. Furthermore, on September 28, 2000, the City Commission
approved an Emergency Ordinance appropriating surplus dollars from the FY2000 General
Fund to complete capital improvement projects at Virrick and Hadley Parks. An amount of
$150,000 from the surplus funding of $450,000 allocated to Virrick Park will be used as
matching funds for the grant. The $375,000 funding approved for Hadley Park will be used
toward the construction of the proposed recreation building and ancillary site
improvements.
This attached Emergency Ordinance increases the capital projects appropriations for these
projects. _
