AN ORDINANCE OF THE MIAMI CITY COMMISSION MAKING APPROPRIATIONS FROM THE DOWNTOWN DEVELOPMENT DISTRICT AD VALOREM TAX LEVY AND OTHER MISCELLANEOUS INCOME FOR THE DOWNTOWN DEVELOPMENT AUTHORITY OF THE CITY OF MIAMI, FLORIDA, FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2000 AND ENDING SEPTEMBER 30, 2001; AUTHORIZING THE DOWNTOWN DEVELOPMENT AUTHORITY TO INVITE AND. ADVERTISE REQUIRED BIDS; PROVIDING FOR BUDGETARY FLEXIBILITY; PROVIDING THAT THIS ORDINANCE BE DEEMED SUPPLEMENTAL AND IN ADDITION TO THE ORDINANCE MAKING APPROPRIATIONS FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2000 AND ENDING SEPTEMBER 30, 2001 FOR THE OPERATIONS FOR THE CITY OF MIAMI; CONTAINING A REPEALER PROVISION, SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Board of Directors of the Downtown Development Authority of the City of Miami, Florida, has approved and submitted to the City Commission an estimated budget of the expenditures and revenues of the Downtown Development Authority for the Fiscal Year beginning October 1, 2000 and ending September 30, 2001, as prepared by the Executive Director of. the Downtown Development Authority, a copy of said budget having been made available in a newspaper of general circulation of the City; and WHEREAS, the City Commission has reviewed the Downtown Development Authority's Budget; X1972 NOW, THEREFORE,'BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference and incorporated as fully set forth in this Section. Section 2. The following appropriations for Fiscal Year 2000-2001 are hereby approved for the _maintenance and for the purpose of. financing the operations and other legal and proper purposes of the Downtown Development Authority of the City of Miami, Florida: Appropriation Amount Personnel Services $ 514,794.00. Special Projects & Professional Services °$1,006,186.00 Operating Expenses $ 374,011.00 Sub -Total Required Funds $1,894,991.00 Contingencies $ 30,000.00 Total Appropriated Funds $1,924,991.00 SOURCE OF REVENUE Ad Valorem Tax Levy Within The Downtown Development District $1,924,991.00 Total Revenue For Budget $1,924,991.00 Section 3. Said appropriations are the anticipated expenditure requirements for the Downtown Development Authority for the period October 1, 2000 to September 30, 2001, but are not mandatory should efficient, administration of the Downtown Development Authority or altered economic conditions indicate that a curtailment in certain expenditures is necessary. The Board of Directors of the Downtown Development Authority is specifically authorized to withhold any of these appropriated funds from encumbrance or expenditure shall such action appear Page 2 of 4 11 7 2 advantageous to the economic and efficient operation of the Downtown Development Authority. Section 4. The Downtown Development Authority is hereby authorized to make transfers between the detailed accounts comprising any of the amounts appropriated by Section 2 hereof, in order that the available and required balance in any such account may be used for other necessary and proper purposes, however, no provision contained in this Ordinance shall be construed to violate the Anti -Deficiency Act, as set forth in Sections 18-500 through Sections 18-503 of the Code of the City of Miami, Florida, as amended. Section 5. The Downtown Development Authority is hereby authorized to invite or advertise for bids for the purpose of any material, equipment or services embraced in the aforementioned appropriations, for which formal bidding is required, such bids to be returnable as required by law. Section 6. The Ordinance shall be deemed supplemental and in addition to the Ordinance making appropriations for the Fiscal Year beginning October 1, 2000 and ending September'30, 2001, for operations of the City of Miami. Section 7. All ordinances or parts of ordinances insofar as they are inconsistent of in conflict with the provisions of this Ordinance are hereby repealed. Section 8. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. 1197 Page 3 of 4 Q Section 9. Background Chapter 14 of the City of Miami Code authorizes the City Commission to levy an additional ad valorem tax on all real and personal property within the Downtown Development Authority District for the purpose of financing the operations of the Downtown Development Authority. . The proposed DDA budget for the Fiscal Year 2000-2001 is based on an estimated increase in revenues of $ 238,230.00 (14%). The Executive Director of the DDA is directed to prepare and. file with the City Clerk of the City Miami, Florida detailed statement of the proposed expenditures and estimated revenues for the Fiscal Year 2000-2001 which shall be entitled "Annual Budget of the Downtown Development Authority: Fiscal Year October 1, 2000 through September 30, 2001". Section 6. A copy of this Resolution and the attachment shall be filled with the City Clerk of the City of Miami, Florida after adoption of the millage by the City of Miami Commission.
