AN ORDINANCE OF THE MIAMI CITY COMMISSION ESTABLISHING A SPECIAL REVENUE FUND ENTITLED "VIRGINIA KEY NATURE TRIAL DEVELOPMENT FUND"; APPROPRIATING FUNDS FOR SAID PROJECT IN THE AMOUNT OF $79,873, CONSISTING OF A GRANT APPORTIONED BY THE SOUTH FLORIDA COMMUNITY URBAN RESOURCES PARTNERSHIP ("SFCURP") FROM T THE U.S. DEPARTMENT OF AGRICULTURE, NATURAL RESOURCES AND CONSERVATION SERVICE, IN THE AMOUNT OF $19,973,. AND IN-KIND MATCHING FUNDS, IN THE AMOUNT OF $59,900, FROM THE DEPARTMENT OF PARKS AND RECREATION GENERAL OPERATING BUDGET; AUTHORIZING THE CITY MANAGER TO ACCEPT SAID GRANT AND EXECUTE THE NECESSARY DOCUMENT(S), IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, WITH THE SOUTH FLORIDA COMMUNITY URBAN RESOURCES PARTNERSHIP, ADMINISTRATOR OF SAID GRANT; CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Virginia Key is part of a master plan for environmental protection, restoration, preservation, and development; and WHEREAS, the Department of Parks and Recreation is implementing a project to build a nature trial and create an environmental education program at Virginia Key; and WHEREAS, the Department of Parks and Recreation has determined that the City of Miami is eligible for funding 11959 assistance from the South Florida Community Urban Resources Partnership ("SFCURP"), a South Florida 501(c)(3) non-profit corporation, whose principal source of grant -making authority is derived from monies received from the U.S. Department of Agriculture; and WHEREAS, on June 2, 2000, the Department of Parks and Recreation's application for grant was approved by SFCURP, in the amount of $24,973, conditioned upon matching in-kind funds from the City of Miami, in an amount of $59,900, to develop a nature trail at Virginia Key and the create an environmental education program; and WHEREAS, said grant will be administered through the SFCURP; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The following new Special Revenue Fund is hereby established and resources are hereby appropriated as described herein: Page 2 of 4 119 5 9 FUND TITLE: "Virginia Key Nature Trail Development" RESOURCES: South Florida Community Urban Resources Partnership $19,973 City of Miami Department of Parks and Recreation General Operating Budget $59,900 APPROPRIATION: $79,873 Section 3. The City Manager is hereby authorized" to accept the aforementioned grant and execute the necessary document(s), in a form acceptable to the City Attorney, for acceptance of said Grant. Section 4. All ordinances or parts of ordinances insofar as they are inconsistent of in conflict with the provisions of this Ordinance are hereby repealed. Section 5. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 6. This Ordinance shall become effective thirty (30) days after final reading and adoption thereof.21 �i The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. zi This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later. BACKGROUND: On April 24,2000 the Department of Parks and Recreation submitted a grant application in response to a solicitation from the South Florida Community Urban Resources Partnership (SFCURP) for development of a nature trail and a companion environmental education program at Virginia Key. On June 2, 2000, the SFCURP approved the grant application in the firm amount of $19,973 subject only to the negotiation of a final grant agreement. When tendered for signature the final agreement will be for the same amount as the, letter that announced the grant approval. This grant award advances important plan objectives contained in the 1987 Virginia Key Master Plan as well as the City's most current I Comprehensive Plan. CIMENEZ City Manager Thank you for your letter of June 2, 2000. We are pleased to know that this project has been approved for funding subject to a budget revision and execution of a final grant agreement. We understand by the terms of your approval letter that the formal award will be for $19,973.00. Our original budget of_ $24,973 has been reduced by $5,000 to comply with your contemplated award amount. The reductions are reflected in the attached revised budget and are summarized as follows: • $2,153 of the reduction is reflected in a mistaken allocation of $2,000 to Mable Miller, our environmental education consultant. She is donating her time but the $2,000 (as well as $153 as fringe) was mistakenly included as part of the SFClJRP amount. • Printing is reduced from $3,500 to $1,750. Less material will be initially printed. The compensation will be that the materials will be on the web site as text and PDF files that can be downloaded and printed by others. • The funding associated with visitor surveys and survey analysis—a total of $1,326 is taken out of the original budget. Instead, the survey form will be on our website. This deletion will have some impact on our ability to collect evaluation data from the public but of all the options, it seems the best choice at this time.
