ORDINANCE NO.
AN ORDINANCE OF THE MIAMI CITY COMMISSION
ESTABLISHING A SPECIAL REVENUE FUND ENTITLED:
"AUTO THEFT PREVENTION FUND;" AND
APPROPRIATING FUNDS IN THE'AMOUNT OF $5,000
RECEIVED BY THE CITY AS A CONTRIBUTION FROM
THE MIAMI-DADE CIRCUIT AND COUNTY COURTS;
AUTHORIZING THE CITY MANAGER TO ACCEPT THE
FUNDS AND TO EXECUTE THE NECESSARY DOCUMENTS;
IN A FORM ACCEPTABLE TO THE CITY ATTORNEY,
FOR SAID PURPOSES; CONTAINING A REPEALER
PROVISION AND SEVERABILITY CLAUSE.
WHEREAS, the Miami Police Department's Auto Theft Detail has
been identified by the State Attorney's Office as a participant
of the Auto Theft Cost Recovery Program; and
WHEREAS, the purpose of the program is to use funds from
fines collected from defendants found guilty of auto theft crimes
to pay for costs related to auto theft investigations; and
WHEREAS, the funds may be used only for equipment related to
auto theft prevention such as vehicle rentals, purchase of auto
theft prevention devices (i.e., steering wheel locking devices,
LoJack Systems) and other related items or services; and
WHEREAS, preventive equipment will be distributed by the
Police Department to City residents at auto theft fairs organized
by the Auto Theft Detail; and

WHEREAS, any Auto Theft Detail expenditures must comply with
applicable City Code procurement procedures;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The following Special Revenue Fund is hereby
established and resources are hereby appropriated as described
herein:
FUND TITLE: AUTO THEFT PREVENTION FUND
RESOURCES: STATE ATTORNEY'S OFFICE $5,000.00
COST RECOVERY PROGRAM
APPROPRIATIONS: $5,000.00
Section 3. The City Manager is hereby authorizedl� to
accept the contribution from the State Attorney's Office Cost
Recovery Program, and to execute all necessary documents, in a
form acceptable to the City Attorney, for acceptance of the
aforesaid funds.
Section 4. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
�i The herein authorization is further subject to compliance with all
requirements that may be imposed by the City Attorney, including but not
limited to those prescribed by applicable City Charter and Code
provisions.

Section 5. If any section, part of section, paragraph,
clause, phrase, or word of this Ordinance is declared invalid,
the remaining provisions of this Ordinance shall not be affected.
Section 6. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereofY

This Ordinance shall become effective as specified herein unless vetoed
by the Mayor within ten days from the date it was passed and adopted. If
the Mayor vetoes this Ordinance, it shall become effective immediately
upon override of the veto by the City Commission or upon the effective
date stated herein, whichever is later.

It is respectfully recommended that the City Commission adopt the attached Ordinance
establishing a Special Revenue Fund entitled: "Auto Theft Fund," authorizing acceptance of
contributions from the Miami -Dade County Courts, in an amount not to exceed $5,000, for Auto
Theft Prevention purposes by the Department of Police.
BACKGROUND
The State Attorney's Office has initiated a cost recovery program through the court system
whereby judges impose a $500 fine on defendants who are found guilty of auto theft crimes. The
State Attorney's Office will forward these funds to the department as cost recovery involving
arrest(s) and investigation(s) of defendants for auto theft related charges. According to the State
Attorney's Office, these funds can only be used for cost related to Auto Theft investigations such
as vehicle rentals, purchase of auto theft prevention equipment (i.e., steering wheel locking
devices, LoJack Systems), and other items and/or services related to auto theft prevention. The
department distributes these types of preventive equipment to City of Miami residents at Auto
Theft. Fairs that are organized by the Auto Theft Detail.
