ORDINANCE NO.
AN ORDINANCE AMENDING ORDINANCE 11000, AS
AMENDED, THE ZONING ORDINANCE OF THE CITY OF
MIAMI, BY AMENDING ARTICLE 6, SD SPECIAL
DISTRICTS GENERAL PROVISIONS, SECTIONS 605
AND 607; IN ORDER' TO MODIFY UPPER LEVEL
SETBACK PROVISIONS FOR THE SD -5 AND SD -7
ZONING DISTRICTS; CONTAINING A REPEALER
PROVISION AND SEVERABILITY CLAUSE; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Miami Planning Advisory Board, at its meeting
of May 31,, 2000, Item No. 7, following an advertised hearing,
adopted Resolution No. PAB 25-00 by a vote of six to zero (6-0),
RECOMMENDING APPROVAL of amending Zoning Ordinance No. 11000 as
hereinafter set forth; and
WHEREAS, the City Commission after careful consideration of
this matter deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to amend
Ordinance No. 11000 as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.

Section 2. Ordinance No. 11000, as amended, the Zoning
Ordinance of the City of Miami, Florida, is hereby amended by
amending the text of said Ordinance as follows:"
"ARTICLE 6. SD SPECIAL DISTRICTS GENERAL
PROVISIONS
Sec. 605. SD -5 Brickell Avenue Area Office -
Residential District.
Sec. 605.8.. Minimum yards, setbacks, open, space,
through block connections, waterfront walkways.
605.8.2. Reserved.
Sec. 607. SD -7 Central Brickell Rapid Transit
Commercial -Residential District.

Section 3. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section S. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof.'

ANALYSIS FOR AMENDMENT TO
ARTICLES 6, Sections 605 and 607
OF THE ZONING ORDINANCE
APPLICATION: No. 2000-028
The proposed amendment to the Zoning Ordinance is being requested in order
to eliminate the upper level setback provisions for the SD -5 and SD -7 Special
Zoning Districts. These special districts are located in the Brickell and Central
Brickell areas, which are very urban in nature. The upper level setback
provisions serve to prescribe a certain configuration to urbanism in these areas
rather than to allow for flexibility and creativity in the implementation of new
projects. The height at which the upper level setbacks begin also dictate
building pedestals where parking is usually located. The elimination of these will
allow for more efficient uses of space and thereby eliminate the monotonous look
that a prescribed height usually brings. The proposed amendment eliminates
these arbitrary setbacks.
The Planning and Zoning Department is recommending approval of the
proposed amendment finding that it will help the Brickell and Central Brickell
area to realize more creative and urban projects to fulfill it's role in downtown
Miami.
