AN ORDINANCE AMENDING ORDINANCE 11000, AS AMENDED, THE ZONING ORDINANCE OF THE CITY OF MIAMI, BY AMENDING ARTICLE 4, SECTION 401 SCHEDULE OF DISTRICT REGULATIONS, AND ARTICLE 6 SD SPECIAL DISTRICTS GENERAL PROVISIONS, SECTION 616, TO MODIFY PARKING PROVISIONS FOR THE CBD CENTRAL BUSINESS DISTRICT COMMERCIAL AND SD -16 ZONING DISTRICTS; CONTAINING A REPEALER PROVISION AND SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Miami Planning Advisory Board, at its meeting of May 31,. 2000, Item No. 6, following an advertised hearing, adopted Resolution No. PAB 24-00 by a vote of six to zero (6-0), RECOMMENDING APPROVAL of amending Zoning Ordinance No. 11000 as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to amend Ordinance No. 11000 as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: 11955 Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, is hereby amended by amending the text of said Ordinance as follows:!' "ARTICLE 4. ZONING DISTRICTS Sec. 40i. Schedule of district regulations. CBD Central Business District Commercial. Permitted Principal Uses: As for C-1, except: 2. Parking lots and garages as a principal use by Speeial Emeeptien Class II Special Permit only (see Conditional Principal uses below). Conditional Principal Uses: 1' words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. Page 2 of 5 As for C-1, and in addition: 4. Parking lots and garages by Class II Special Permit only, subject to the limitations of section 14-71 of the City Code. "ARTICLE 6. SD SPECIAL DISTRICTS GENERAL PROVISIONS Sec. 616. SD -16, 16.1, 16.2 Southeast Overtown- Park West Commercial- Residential Districts. Sec. 616.4 Principal uses and structures. 616.4.2. SD -16, 16.1, 16.2 conditional principal uses and structures. The following uses shall be permitted by Class II Special Permit only: 1. Child daycare centers, subject to the restrictions and limitations in section 936. 2. Adult daycare facilities, subject to the restrictions and limitations in section 935. 3. Parking lots, parking garages provided that there shall be no vehicular access to such facilities directly from primary pedestrian pathways. Unenclosed parking areas with any portion adjacent to a primary pedestrian pathway shall only be permitted as a temporary use with time limits and conditions for renewal (if allowable) specified. Page 3 of 5 11955 The following uses shall be permitted only by Special Exception: 1. Automotive service stations. 2. Drive-through facilities for financial institutions, with city commission approval. 3. Drive-through restaurants, by Special Exception only. 4. Sports arenas and exhibition halls. -6— 5. Repair service establishments including appliance and office equipment, but not repair garages, repair of heavy equipment or paint and body shops. Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5.
