ORDINANCE NO.
AN EMERGENCY ORDINANCE OF THE MIAMI CITY
COMMISSION AMENDING CHAPTER 54/ARTICLE
V/SECTION 54-190 OF THE CODE OF THE CITY OF
MIAMI, FLORIDA, AS AMENDED, ENTITLED "STREETS
AND SIDEWALKS/BASE BUILDING LINES/NONSTANDARD
STREET WIDTHS", TO MODIFY THE WIDTH OF
CERTAIN STREETS AND AVENUES IN THE SOUTHEAST
OVERTOWN/PARK WEST COMMUNITY, MIAMI, FLORIDA;
CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, Article V of Chapter 54 of the Miami City Code
establishes base building line locations for all public streets
within the City of Miami; and
WHEREAS, the City Commission approved the Design Standards
and Guidelines for the Southeast Overtown/Park West Redevelopment
Project on March 21, 1985, which requires numerous modifications
to the base building line location within the project area; and
WHEREAS, the City Commission adopted Ordinance No. 10031 on
September 12, 1985, which increased the zoned width of certain
streets in the Southeast Overtown/Park West Project area in order
to accommodate future vehicular and pedestrian traffic
anticipated by the redevelopment project; and
WHEREAS, since the adoption of the redevelopment project,
conditions in the Park West area have not materialized to allow
the intensity of residential development that was anticipated and

such traffic demand through the Southeast Overtown/Park West
community will not be as high or distributed as previously stated
in the redevelopment plan; and
WHEREAS, the type of development now anticipated in the
Southeast Overtown/Park West area varies significantly from the
original redevelopment plan and includes major technology and job
creation projects; and
WHEREAS, the increased .zoned street width of the roadways
surrounding these projects negatively impact the building sites
of the new proposed development; and
WHEREAS, in order to meet the building requirements for the
Network Access Point (NAP) center, the existing property
dimensions must be fully utilized; and
WHEREAS, the City Administration's review of these
transportation corridors reveal that the original 50 and 70 foot
wide developed roadways will adequately serve the present and
future transportation needs of the public; and
WHEREAS, the Police, Fire -Rescue and Solid Waste Departments
have evaluated the effects of the reduction of the zoned street
width of these certain roadways in the Southeast Overtown/Park
West community on their operations and have no substantial
objections;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference

thereto and incorporated herein as if fully set forth in this
Section.
Section 2. Chapter 54/Article V/Section 54-190 of the
Code of the City of Miami, Florida, as amended, entitled "Streets
and Sidewalks/Base Building Lines/Nonstandard Street Widths" is
hereby amended in the following particulars:l/

Section 3. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 5. This Ordinance is hereby declared to be an
emergency measure on the grounds of a commitment by the City of
Miami to an accelerated construction schedule for the Network
Access Point center that will meet the requirements and needs of
interrelated communication providers that serve the general
public.
Section 6. The requirement of reading this Ordinance on
two separate days is hereby dispensed with by an affirmative vote
of not less than four-fifths of the members of the Commission.

Section 7. This Ordinance shall become effective
immediately upon its adoption and signature of the Mayor/

RECOMMENDATION:
It is respectfully recommended that the City Commission adopt the attached Emergency
Ordinance amending Chapter 54 of the Code of the City of Miami, Florida, entitled "Streets and
Sidewalks" by amending Section 54-190 entitled "Nonstandard Street Widths".
BACKGROUND:
On March 21, 1985, the City Commission approved the Design Standards and Guidelines for the
Southeast Overtown/Park West Redevelopment Project. This project requires numerous
modifications to the base building line location within the project area. The City Commission
adopted Ordinance No. 10031 on September 12, 1985, which increased the zoned width of
certain streets within the project area in order to accommodate future vehicular and
pedestrian traffic anticipated by new development.
Since the adoption of the redevelopment project, conditions in the Southeast Overtown/Park
West area have not materialized to allow the intensity of residential development that was
anticipated and traffic demand through the Southeast Overtown/Park West will not be as high
or distributed as previously stated in the redevelopment plan. The type of development now
anticipated varies significantly from the original redevelopment plan and includes major
technology and job creation projects, most notably the proposed Network Access Point (NAP)
Center.
In order to meet the building requirements for the NAP project, the existing property
dimensions must be fully utilized. The increased zoned width of the roadways surrounding the
NAP project, including NE 8 Street, NE 9 Street, North Miami Avenue and NE 1 Avenue,
negatively impact the building site and the proposed structure. These roadways were
originally zoned a narrower width than what was anticipated in the Southeast Overtown/Park
West redevelopment plan and were developed with pavement, curb and gutter and sidewalk
conforming to the narrower width. None of the additional reserved private property has been
dedicated for street purposes to the widths contained in the Southeast Overtown/Park West
redevelopment plan. The Public Works Department's review of this transportation corridor
reveals that the developed roadways within the original zoned street widths adequately serve
the transportation needs of the public. The Police, Fire -Rescue and Solid Waste Departments
have been notified of the proposed reduction of the zoned width of these roadways.
This Emergency Ordinance is necessary due to a commitment by the City to an accelerated
construction schedule that will meet the requirements and needs of interrelated
communication providers.
