AN EMERGENCY ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 40/ARTICLE IV/ DIVISION 2, OF THE CODE OF THE CITY OF MIAMI, FLORIDA, . AS AMENDED, ENTITLED "PERSONNEL, PENSION AND RETIREMENT PLAN, CITY OF MIAMI FIREFIGHTERS' AND POLICE OFFICERS' RETIREMENT TRUST ("FIPO)," THEREBY COMPLYING WITH CHAPTERS 175 AND 185, FLORIDA STATUTES (SUPP. 1999), TO PROVIDE, EFFECTIVE ON OR AFTER DECEMBER 31, 1999, ELIGIBLE MEMBERS OF FI PO (1) WITH UP TO A MAXIMUM OF FIVE YEARS OF ACTIVE SERVICE CREDIT FOR QUALIFYING MILITARY SERVICE, AND (2) ADDITIONAL RETIREMENT ALLOWANCES TO CERTAIN MEMBERS OR THEIR BENEFICIARIES FOR A PERIOD OF TEN YEARS; FURTHER DELETING PROVISIONS RELATED TO CREDIT FOR DISABILITY RETIREMENT UPON RESTORATION OF BENEFICIARY TO SERVICE; MORE PARTICULARLY BY AMENDING SECTIONS 40- 202 AND 40-203 OF SAID CODE; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Chapters 175 and 185, Florida Statutes (Supp. 1999); (the "Statutes") provide eligible firefighters and police officers, effective on or after December 31, 1999, with up to a maximum of five years of active service credit for periods of military service, and additional death benefits to members or their beneficiaries for a period of ten years; and WHEREAS, certain provisions of the Code of the City of Miami, Florida, as amended (the "Code"), permit application for 1194;4 active service credit by beneficiaries of disability retirement upon restoration of the beneficiary to active service; and WHEREAS, it is now in order for the City Commission to amend the Code to comply with the Statutes and to prevent periods of disability retirement from counting towards pension accrual upon reemployment; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Chapter 40/Article IV/Division 2 of the Code of the City of Miami, Florida, as amended, entitled "Personnel/Pension and Retirement Plan/City of Miami Firefighters' and Police Officers' Retirement Trust" is hereby amended in the following particulars:l/ "Chapter 40 PERSONNEL Article IV. Pension and Retirement Plan �i Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. Page 2 of 10 11 4 4 Division 2. City of Miami Firefighters' and Police Officers' Retirement Trust Sec. 40-202. Paybacks for membership credit. Members shall have the right to receive membership credit in the retirement system in accordance with the following provisions: (3) Credit for military service. a. Notwithstanding any provision in this division to the contrary, any employee who was a member of the retirement system prior to entry into military service, and who did not withdraw accumulated contributions prior to military service, who was granted a leave of absence by the city under the provisions of Resolution No. 16366, passed and adopted by the commission August 28, 1940, as amended by Resolution No. 18115, passed and adopted by the commission March 24, 1943, and who returns to service under the provisions of such resolution, shall retain membership in the retirement system regardless of the length of the period of absence. In determining the creditable service of any firefighter or police officer whose retirement becomes effective on or after December 31, 1999, credit for up to a maximum of five years of the time spent in the military service of the Armed Forces of the United States shall be added to the years of actual service, if: (i) the firefighter or police officer is in the active employ of the city prior to such service and leaves a position, other than a temporary position, for the purpose of voluntary or involuntary service in the Armed Forces of the United States; and (ii) the firefighter or police officer is entitled to reemployment under the provisions of the Uniformed Services Employment and Reemployment Rights Act; and (iii) the firefighter or the police officer returns to his or her employment as a Page 3 of 10 119 4-4 firefighter or police officer of the city within one year from the date of his or her release from such active service. Any member of the retirement system who qualifies for service credit as hereinabove set forth and serves a period of time in excess of five years shall, receive membership credit for the time spent in the military service in excess of five years, by contributing the amount he or she would have contributed had he or she remained in service for the period of time absent, -reeeive- meFpJeership—credit fer the tiffl.e spent in military serviee in excess of five years. Payments made to the retirement system pursuant to this paragraph shall be made in such manner as the board prescribes. (,&5) Restoration of service credit for prior continuous service. (46) Creditable service years purchase from leave balance. Sec. 40-203. Benefits. (f) ordinary disability retirement. I1`944 Page 4 of 10 (2) a. d. For those members who retire effective on or after December 31, 1999, the retirement allowance shall be payable for life, except that in the event the member dies before such allowance has been received for a Teriod of ten (10) years, the member's beneficiary or beneficiaries shall be paid the same allowance for the remainder of the ten (10) year period. (g) Accidental or service incurred disability retirement. (5) a. Upon retirement for accidental disability or service -incurred disability, a member shall receive a pension which shall be equal to 66 2/3 percent of his average final compensation or 66.2/3 percent of his final compensation, whichever is greater. b. For those members who retire effective on or after December 31, 1999, upon retirement for accidental disability or service -incurred disability, a member shall receive a retirement allowance payable for life which shall be equal to 66 2/3 percent of the member's average final compensation or 66 2/3 percent of the member's final compensation, whichever is greater, except that in the event a member dies before such allowance has been received for a period of 10 years, the member's beneficiary or beneficiaries shall be paid the same allowance for the remainder of the ten (10) year period. (7) In lieu of the benefits set forth in (5) above, T3upon the, death of any member who has Page 5 of 10 11944 • received an accidental or service -incurred disability retirement, the spouse of said member who has been nominated and designated by the member as said member's beneficiary if eligible shall receive the payment of an amount equal to 40 percent of the member's monthly retirement allowance during the lifetime of said spouse, in accordance with subsection (n) of this division. (h) Ordinary death benefit. 2) For those members who retire effective on or after December 31, 1999, the member's beneficiary or beneficiaries shall be entitled to the benefits otherwise payable to the member at early or normal retirement age for a period of ten (10) years, should a member having at least ten (10) years of creditable service die prior to retirement. Anything herein to the contrary, notwithstanding this provision, shall not be implemented as to police officer members unless and until there are "additional premium tax revenues" as defined in §185.35(1)(b), Fla. Stat., to the extent necessary to fund such benefit. (2-3) a. Notwithstanding any provision in this division to the contrary, in the event a member who has become eligible for service, early service or rule of 64 retirement but has not retired dies, the member shall be considered to have been retired on the date of death. In such event, the payment of 40 percent of the member's monthly retirement allowance shall be paid at the member's death to the member's spouse during the lifetime of such spouse or, at the option of such spouse the spouse shall receive the sum of the deceased member's accumulated contributions to the date of death plus a benefit equal to a lump -sum payment of 50 percent of the earnable compensation received by the member during the year immediately preceding the member's death. In lieu of the benefits set forth in (2) above, for those members who retire effective on or after December 31, 1999, in the event a member who has become eligible for service, or early service retirement but has not retired dies, the member shall be considered to have been retired on the date of death. In such event, the payment of 40 percent of the member's monthly retirement allowance shall be paid at the member's death to the member's spouse during the lifetime of such spouse or, at the option of such spouse the spouse shall receive the sum of the deceased member's accumulated contributions to 'the date of death plus a benefit equal to a lump -sum payment of 50 percent of the earnable compensation received by the member during the year immediately preceding the member's death. (374) If a retired member dies prior to having received 12 monthly retirement allowance payments and prior to any optional allowance elected by the member having become effective, there shall be paid to such person, if any as the member shall have nominated by written designation duly executed and filed with the board, otherwise, to the member's legal representative, a lump - sum benefit equal to the sum of the 12 monthly retirement allowance payments to which the member would otherwise have become entitled, less the payments the member received. (i) Accidental death benefits. (1) If the board shall decide that the death of a member in service was the result of an accident in the performance of duty and not caused by willful negligence on the part of the member, then there shall be paid an amount equal to one-half of the member's average final compensation, which amount shall be paid yearly in monthly installments, to the member's spouse, if he or she leaves a spouse, to continue until the death or remarriage of such spouse; or if there be no spouse, or if the spouse dies or remarries before the youngest child of such deceased member shall have attained the age of 18, then to his or her children under such age, Page 7 of 10 1914 4 if he or she leaves children, divided in such manner as the board in its discretion shall determine, to continue as a joint and survivorship pension for the benefit of the children under such age until every child dies or attains such age; or if there be no spouse or children under the age of 18 years living at the death of such member, then to his or her dependent father or dependent mother, as the board in its discretion shall direct, to continue for life; provided that if there be no such beneficiary, the amount which otherwise would have been paid as an ordinary death benefit shall be paid to the member's legal representative.. Provided, however, in the event a member who retires effective on or after December 31, 1999, has at least ten (10) years of creditable service dies prior to retirement, the member's beneficiary or beneficiaries shall be entitled to the benefits otherwise payable to the member at early or normal retirement age for a period of ten (10) years. Anythinq herein to the contrary notwithstanding, this provision shall not be implemented as to police officer members unless and until there are "additional premium tax revenues" as defined in §185.35 (1) (b) , Fla. Stat. , to the extent necessary to fund such benefit. (m) Optional allowances. (1) Any member may elect to receive in lieu of the retirement allowance otherwise payable to him or her, the actuarial equivalent at that time of his or her retirement allowance in a reduced retirement allowance payable as follows; provided, that no election of an optional allowance shall be effective in case a beneficiary dies within ten days after the election of an option as provided in this section, and further provided that such a beneficiary shall be considered as a member in service at the time of death, until the first payment on account of any benefit becomes normally due: Option 6: Any member upon service, early service or rule of 64 retirement may elect to receive benefits in one of the following three forms,. in Page 8 of 10 11944 • 0 lieu of the retirement allowance otherwise payable to the member: a. * C. Such member may direct the payment of a benefit of 40 percent of the member's monthly retirement allowance to be paid at the member's death to his or her spouse nominated and designated by him or her at the time of retirement, such benefit to be payable during the lifetime of such spouse-; or d. For those members who retire effective on or after December 31, 1999, such member may elect to receive his or her normal monthly service retirement allowance payable for life; except that in the event the member dies before he or she has received such allowance for a period of ten (10) years, the member's beneficiary or beneficiaries shall be paid the same allowance for the remainder of the ten (10) year period. Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon the further grounds of the necessity to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases I'M Page 9 of 10 • E of goods and supplies and to generally carry on the functions and duties of municipal affairs. Section 6. The requirement of reading this ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four-fifths of the members 'of the Commission. Section 7. Page 10 of 10 11944 CITY OF MIAMI, FLORIDA INTER -OFFICE MEMORANDUM TO: The Honorable Mayor and DATE: JUL 18 2000 FILE Members of the City Commission SUBJECT: Amendments to Sections 40-202 And 40-203 of the City Code - Emergency Ordinance FROM: 4CityMana e REFERENCES: er ENCLOSURES: RECOMMENDATION The Administration recommends that the City Commission approve the attached Ordinance amending Sections 40-202 and 40-203 of the City of Miami Code. The amendments to Sections 40-202(3)(a) and 40-203(m)(1) will bring plan provisions of the Fire Fighters' and Police Officers' Retirement Trust (FIPO) into compliance with the 1999 Legislative Amendments to S.112.63 and S.112.65, Florida Statutes and the amendment to Section 40-202 (5) will prevent periods of disability retirement from counting towards pension accrual. BACKGROUND In 1999 certain legislative amendments were made requiring supplemental plans to meet the minimum benefits and standards set forth in Chapters 175 and 185 (Firefighters and Police Officers Pension Relief Fund). The FIPO Trust was notified by the State of Florida, Division of Retirement that some of the provisions of the FIPO Trust do not currently meet the minimum benefits and standards now required by Chapters 175 and 185. Specifically, the required language changes include service credit of up to five years for military service and a pension benefit option allowing the normal monthly service pension allowance to be paid to a beneficiary or beneficiaries for in the event of the death of the member before a period of 10 years of retirement for the balance of that 10 -year period. The State of Florida, Division of Retirement, has requested that the City's Ordinance be brought into compliance with Chapters 175 and 185 with an effective date of no later than December 31, 1999. The proposed amendments to Section 40-202(3)(a) and Section 40-203(m)(1) will bring the FIPO Trust into compliance with Chapters 175 and 185 as required by State law. The FIPO Trust actuary, Randall L. Stanley, F.S.A., has indicated that there will be no cost impact to the City as a result of these amendments. (Please see the attached letter). In recently concluded litigation the City of Miami and the FIPO Trust were sued by a former firefighter and police officer who had received disability retirements and were requesting to be reemployed by the City. Under the current language of Section 40-202 (5) a former firefighter or police officer receiving a disability retirement and reemployed by the City may receive membership credit for the period of the disability retirement. The, administration of the City and the FIPO 'Trust are proposing the deletion of this language to prevent periods of disability retirement from counting towards pension accrual upon reemployment. NATURE OF EMERGENCY ORDINANCE The amendments to Sections 40-202 and 40-203 of the City of Miami Code are requested on an emergency basis to bring the FIPO ' Trust into compliance with state law. As a result of the City Commission not meeting during the month of August, amendments to' Sections 40-202 and 40-203 would delay implementation until September 2000. November 16, 1999 Pension Board City of Miami Firefighters' and Police Officers' Retirement Trust Post Office Box 330708 Miami, FI 33233-0708 Dear Board Members: • Changes to Chapters 175 and 185 - Actuarial Impact on City of Miami Firefighters' and Police Officers' Retirement Trust The purpose of this letter is to serve as the actuarial impact statement required by Florida Law whenever pension benefits are changed. As you know, certain changes are required due to Chapter 99-1 enacted earlier this year. Normal Form of Benefit The current FIPO normal form of benefit is Joint & Survivor, with a 40% continuation to the surviving spouse. Alternatively, members may elect other options (actuarially equiva- lent) or life annuity for 105% of the monthly benefit available under the normal form. For funding purposes, the assumption is made that 100% of employees are married and that they will elect the 40% J&S form. Since the 40% J&S form is at least as valuable as any other option under the Plan for most expected retirement ages, the election of another option would result in no gain/loss. (actuarially equivalent options) or an actuarial gain (life annuity option). The introduction of a 10 years certain & life option as a minimum normal form can be expected to have no measurable actuarial impact, since it is less valuable than the 40% J&S form for all realistically conceivable age combinations. Covered Compensation FIPO does not currently cover overtime pay. The new Law requires that at least 300 hours of overtime be recognized for police officers each year. Our understanding is that the Miami FIPO Trust is a Supplemental Plan Municipality, which is permitted to continue to use its current definition of compensation. Firefighters' and Police Officers' Retirement Trust Military Service FIPO currently provides credits for certain periods of military service if a member was granted a leave of absence and makes the contributions he would have made during the leave. Other wartime service, up to a maximum of four years, may be credited if the member pays the member contributions plus interest. Under Chapter 99-1, credit for up to five years of military service is required, if the member was an employee before the militaryservice. Since there is no actuarial assumption dealing with military service, the expansion from four to five years will have no immediate actuarial impact. Instead, any increase in liabilities associated with members receiving credit for the additional military service, or associated with the lack of employee contributions therefor, would emerge as actuarial losses. Other Provisions Our analysis of the other provisions of the Law is that the Miami FIPO Retirement Trust benefits are superior to the new requirements: mmary and Conclusion This analysis is based on a comparison of the current provisions of the Miami FIPO' Retirement Trust end our understanding of the .1999 Legislative Amendments to SA 12.63 and S.112.65, Florida Statutes: Since the benefit provisions of the Miami FIPO Trust are, in our opinion, superior to those required by the Legislative Amendments, there is no actuarial impact as a result of these Amendments.
