D 11.94. 11 AN ORDINANCE AMENDING CHAPTER 2, ARTICLE II OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED ."ADMINISTRATION/CITY COMMISSION/ORDER OF .BUSINESS AND .RULES. OF PROCEDURE", TO PROVIDE THAT THE FOLLOWING BE POSTED ON THE INTERNET: (1) THE -CITY COMMISSION AGENDA ' SIMULTANEOUS WITH THE AGENDA'S DISTRIBUTION, (2) THE SUPPLEMENTAL AGENDA AND ANY INFORMATION RELATED TO THE UPCOMING AGENDA SIMULTANEOUS WITH ITS DISTRIBUTION, AND (3) THE CITY CLERK'S REPORT AND ANNOTATIONS TO THE AGENDA IMMEDIATELY AFTER RELEASE OF SAME BY THE CITY CLERK AFTER A CITY COMMISSION MEETING; MORE PARTICULARLY BY AMENDING SECTION 2-33 BY ADDING NEW SUBSECTION (f) AND RELETTERING EXISTING SUBSECTIONS 2-33(f) THROUGH (k) OF THE CODE; CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission directed that the City Clerk establish a comprehensive, integrated agenda tracking system which will provide for the availability on the Internet of all City Commission Agendas, Supplemental Agendas and information prior to a City Commission meeting, and for the availability of the City Clerk's Report and annotated Agendas after a City Commission Meeting; and 11942 11 WHEREAS, it is appropriate to amend the Code of the City of Miami, Florida, as amended, to include, as part of the Rules of Procedure related to distribution of the Agenda, provisions for such posting; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Chapter 2, Article II of the Code of the City of Miami, Florida, as amended, is hereby amended in the following particulars:,/ "Chapter 2 ADMINISTRATION ARTICLE II. CITY COMMISSION Sec. 2-33. Order of business and rules of procedure. (e) A copy of each resolution and ordinance shall be furnished the mayor and members of the city commission five days before meeting, with the exception of veto items, to enable the heads of the departments affected to prepare necessary memoranda, data or reports. In the event a copy of each resolution or ordinance is not furnished within the required five days, the proposed resolution or ordinance may be heard by the city commission provided that the city commission unanimously deems such resolution or ordinance to be of an emergency nature. The number of nonscheduled ("pocket") items is limited to one that each commissioner and the mayor may introduce and two that the city manager may introduce for consideration by the city commission at any city commission meeting, unless the city commission waives said limitation by a four- fifths vote of its members, provided a written copy of J words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. The conclusion of the regularly scheduled agenda, or at 8:00 p.m., whichever occurs first, is designated as the time that ".such nonscheduled items shall be introduced. Any nonscheduled item. which has a fiscal impact upon the city shall be reviewed by the city manager, who shall make a written recommendation to the city commission prior to consideration of the items by the commission. Furthermore, all non-scheduled items shall be provided to the city manager and the city attorney for review, recommendation and drafting of legislation if appropriate, at least four days in advance of the city commission meeting, unless the city commission unanimously waives said requirement. f) Consistent with the time frame requirements set forth in Section 2-33(e) above the following shall be posted on the Internet: (1) the City Commission Agenda simultaneous with its distribution; (2) the Suipplemental Agenda and any information related to the upcoming Agenda simultaneous with its distribution; and (3) the City Clerk's Report and annotations to the Agenda immediately after its release by the City Clerk subsequent to the City Commission meeting to which it applies. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. _. 11942 Page 3 of 4 Section 4.
