AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 2/ARTICLE XI OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS, AMENDED, ENTITLED "BOARDS, COMMITTEES, COMMISSIONS" TO PERMIT THE EXECUTIVE DIRECTOR OF THE INTERNATIONAL TRADE BOARD TO EXERCISE DISCRETION REGARDING EXCUSABLE BOARD MEMBER ABSENCES; MORE PARTICULARLY BY AMENDING SECTION 2-923; CONTAINING A REPEALER PROVISION AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, from time to time members of the City's International Trade Board ("ITB") travel outside the country to promote the welfare and betterment of the City; and WHEREAS, Section 2-923 of the Code of the City of Miami, Florida, as amended (`Code"), currently permits ITB members three successive absences from meetings or four meetings within one calendar year, before a member is automatically removed from the ITB; and WHEREAS, the period of time ITB members travel outside the country often does not fall within the time period currently permitted in the Code regarding ITB member absences; and 11940 WHEREAS, the City values the time and effort that members of the ITB put forth, and recognizes that international travel by ITB members confers a benefit on,the City; and WHEREAS, amending the Code to permit the ITB Executive Director to exercise discretion regarding excusable ITB member absences will ensure ITB members are able to comply with the Code's absentee provisions, while guaranteeing the board retains its valued members; and NOW THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. Chapter 2/Article XI/Section 2-923, of the Code of the City of Miami, Florida, as amended, is hereby amended in the following particulars: 1/ . 1 words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. Page 2 of 4 "Chapter 2 ADMINISTRATION ARTICLE XI. BOARDS, COMMITTEES, COMMISSIONS Sec. 2-923. Membership, terms of office; meetings. DIVISION 3. INTERNATIONAL TRADE BOARD (f) Absences. Members of the board who are absent for more than three successive meetings or four meetings within one calendar year shall ..,:tc.,..,t-c,„ 1 be removed and the position declared vacant_ by epe2Fatien ef law. However, any such absence may be excused by the executive director if it is deemed unavoidable. Notice of such removal is to be provided by the chairperson, in writing, to the city clerk. Section 3. For purposes of this Ordinance only, and in accordance with Section 2-886, Attendance Requirement, of the Code, the City Commission by a four-fifths vote of all Commission members, hereby agrees to waive the provisions set forth in Section 2-886 of the Code. Section 4. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 5. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected.
