AN EMERGENCY ORDINANCE OF THE MIAMI CITY
COMMISSION ESTABLISHING FOUR (4) SPECIAL
REVENUE FUNDS AND APPROPRIATING FUNDS AS
HEREIN SPECIFIED: COMMUNITY DEVELOPMENT BLOCK
GRANT (TWENTY-SIXTH YEAR) - $12,700,000 AND
$732,250 OF COMMUNITY DEVELOPMENT BLOCK GRANT
(CDBG) PROGRAM INCOME AS APPROVED BY THE
DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT
(HUD) FOR A TOTAL APPROPRIATION OF
$13,432,250; HOME INVESTMENT PARTNERSHIP
(HOME) - $4,881,000; EMERGENCY SHELTER GRANT
(ESG) - $451,000; AND HOUSING OPPORTUNITIES
FOR PERSONS WITH AIDS (HOPWA) - $10,139,000;
CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE.
WHEREAS, the City of Miami has been advised that it will
receive entitlement grant awards from the Department of Housing
and Urban Development for the period commencing October 1, 2000,
and ending September 30, 2001, for the following programs and at
the specified amounts:
Twenty-sixth Year Community Development Block Grant (CDBG)
Program for the provision of community development
activities - $12,700,000.
HOME Investment Partnership (HOME) Program to provide
affordable housing activities for low and moderate income
persons - $4,881,000.
Emergency Shelter Grant (ESG) Program to provide activities
for homeless persons - $451,000.
Housing Opportunities for Persons With AIDS (HOPWA) Program
to provide housing services to eligible HOPWA clients -
$10,139,000.

WHEREAS, the Department of Community Development has
projected that during the same time frame, income amounting to
$732,000 will be generated from the CDBG Program;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals .and findings contained in the
Preamble to this Ordinance are hereby adopted by reference
thereto and incorporated herein as if fully set forth in the
Section.
Section 2. The following Special Revenue Funds are
hereby established and resources are hereby appropriated as
described herein:
(1) FUND TITLE: Community Development Block

and Urban Development
Community Development Block $ 732,250
Grant Program Income
APPROPRIATIONS: $13,432,250
(2) FUND TITLE HOME Investment Partnership

Section 3. The herein appropriations are contingent upon
funding by the U.S. Department of Housing and Urban Development
and the City Manager's acceptance thereof.
Section 4. The City Manager is hereby authorized" to
accept the aforementioned grant and execute the necessary
documents, in a form acceptable to the City Attorney, to
implement acceptance .of the grants.
Section 5. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
the Ordinances, are hereby repealed. .
Section 6. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 7. This Ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami, and upon the further grounds of the necessity to make
the required and necessary payments to its employees and
officers, payment of its debts, necessary and required purchases
of goods and supplies and to generally carry on the functions and
duties of municipal affairs.
Section 8. The requirement of reading this Ordinance on
two separate days is hereby dispensed with by an affirmative vote
of not less than four-fifths of the members of the Commission.
�i The herein authorization is further subject to compliance with all
requirements that may be imposed by the City Attorney, including but not
limited to those prescribed by applicable City Charter and Code
provisions.

Section 9. This Ordinance shall become effective
immediately upon its adoption and signature of the Mayor./

RECOMMENDATION:
It is respectfully recommended that the City Commission adopt the attached emergency
ordinance authorizing the City Manager establishing four (4) Special Revenue Funds to
appropriate grant funds from the U.S. Department of Housing and Urban Development (HUD) to
implement the Community Development Block Grant (CDBG) Program - $12,700,000 CDBG
funds and $732,250 of program income; the'HOME Investment Partnerships (HOME) Program -
$4,881,000; Housing Opportunities for Persons With AIDS (HOPWA) Program - $10,139,000;
and the Emergency Shelter Grant (ESG) Program - $451,000.
BACKGROUND:
The U.S. Department of Housing and Urban Development (HUD) has advised the City of Miami
that it will receive the following entitlement grants for the 2000-2001 Fiscal Year:
• Community Development Block Grant (CDBG) $12,700,000
• Emergency Shelter Grant (ESG) 451,000
• Housing Opportunities for Persons with AIDS (HOPWA) 10,139,000
• HOME Investment Partnerships (HOME) 4,881,000
Total Grant Funds $28,171,000
The Department of Community Development has prepared the attached emergency ordinance to
establish four (4) Special Revenue Funds to appropriate the HUD grant awards identified above.
This ordinance is provided on an emergency basis to execute the appropriate documents to ensure
that the grant supported human service, housing and economic development activities are able to
continue without interruption.
It is recommended that the City Commission adopt the proposed emergency ordinance to
establish the four (4) Special Revenue Funds relating to the City's HUD grant programs.
